A man is dead after falling off a ladder while cutting a tree branch following Hurricane Irma.Hillsborough County, Florida Fire Rescue responded to Puritan Road in Tampa, at approximately 2:54 p.m. on Thursday, after receiving a call about a person down.Upon arrival, firefighters found 60-year-old John Knight on the ground.According to a witness, Knight was cutting a tree branch when it hit him and knocked him off his ladder, causing him to fall between 20 to 25 feet.Firefighters pronounced Knight dead at the scene. 559

A Brooklyn woman whose racist, profanity-laced tirade on the New York subway was captured on video this week has been charged with felony assault after she struck a fellow passenger, authorities said.The dispute between Anna Lushchinskaya, a 40-year-old white woman, and the 24-year-old passenger, a woman of Asian descent, began after Lushchinskaya bumped into the woman early Tuesday, the New York Police Department told CNN.Lushchinskaya yelled profanities at the victim on the northbound D train, hitting her with an umbrella and keys, the NYPD said. On video captured by witnesses, Lushchinskaya can be heard calling the woman a racial slur.Lushchinskaya was apprehended at the 36th Street Station and arrested, the NYPD said.CNN could not reach Lushchinskaya or her attorneys for comment Friday.Lushchinskaya was arraigned in Kings County Criminal Court following the incident, according to Brooklyn District Attorney spokesperson Oren Yaniv. She pleaded not guilty and posted ,000 cash bond, according to court records.She is due back in court January 22.The victim suffered cuts to her face, the NYPD said. She told CNN affiliate WABC, which said she wanted to remain anonymous, that she was grateful people intervened.A 30-year old good Samaritan suffered scratches when he intervened, the NYPD said.Several subway riders captured the tirade on video. The incident has since been viewed by millions of people on social media.The video shows the woman yelling profanities at the victim and calling another rider "retarded.""F*** off," Lushchinskaya allegedly said several times before striking the victim with her hand.She then took off her sunglasses and gloves, pulled her hair back and took her umbrella and keys from her bag, according to the video. Then, she began kicking the woman, who defended herself.Passengers intervened, trying to restrain Lushchinskaya, and told her to stop. One person threatened to call the police.The video shows Lushchinskaya striking the woman several times with her umbrella and her keys and again kicking her."She's not even fighting you back," one person is heard saying.At least two subway riders tried to wrestle the umbrella away.Lushchinskaya is seen spitting in the direction of the victim before yelling more profanity and a racial slur.Juan Ayala, who was filming the incident, said he decided to intervene, but Lushchinskaya lashed out at him. A video posted by another user shows Ayala talking to Lushchinskaya."Do not spit at me," Ayala says in the video, to which Lushchinskaya replies, "What are you, her attorney? F***ing Mohammed."The subway car erupts in a gasp and Ayala gives his reply: "What? B****, I'm Dominican!"Fellow subway riders protested. "Your white privilege ain't working over here," one man is heard saying.The victim told WABC she felt lucky the woman didn't have a weapon like a gun or a knife "because it could have got a lot worse.""I'm lucky that people were on the train who were helping me, especially the first Asian guy who stood in front of me right away because he wasn't recording. He just stood in front of me to help me, because I know other people were recording, but their recording didn't do anything until later on when it escalated," she said.This is Lushchinskaya's second arrest this year for a subway altercation -- both took place at the 36th Street Station in Brooklyn. In June, she was arrested for allegedly pepper spraying a man and woman, according to DCPI detective Sophia Mason. Both were Hispanic. A group of Republicans are making good on their threat to attempt to force an immigration floor vote in the House -- potentially paving the way for a showdown among proposals to save the Deferred Action for Childhood Arrivals program.The lawmakers on Tuesday signed what's known as a discharge petition -- a procedural maneuver that can bring legislation to the House floor if it is signed by a majority of House members regardless of whether it has moved through committee, as is traditionally the case for most legislation. If the petition were to pick up enough supporters, it would set up a floor debate on four different immigration measures as early as June.The move is unusual for members of the majority party, who are effectively going around House Speaker Paul Ryan to set up a vote on legislation that GOP leadership has refused to call to the floor for a vote. Still, the members insist they are making an effort to be deferential to leadership, by leaving one bill open to the speaker's choosing.The effort is being spearheaded by three moderate Republicans who have long been vocal about trying to save DACA, a program that protected young undocumented immigrants who came to the US as children -- Reps. Will Hurd of Texas, Jeff Denham of California, and Carlos Curbelo of Florida. Curbelo officially introduced the petition Wednesday morning.In an exclusive interview with CNN, the three moderates said the goal was to have a long overdue immigration debate without a predetermined outcome."This institution should be driven by courage, not by cowardice, and the goal should not be to suppress members from pursuing their legislative goals, it should be to empower each member, and that's what we're trying to do," Curbelo said. "The goal is to empower each member of the House, including the speaker, to advance the solution that each member believes is the best one for this challenge and to try to gain supporters for that solution. So this is not in defiance of anyone."A spokeswoman for Ryan didn't comment specifically on the petition, saying efforts to pass immigration legislation continue in general."We continue to work with our members to find a solution that can both pass the House and get the president's signature," AshLee Strong said.The three members who pitched the proposal held a news conference Wednesday afternoon announcing their move, and were joined by fellow Republican Reps. Mario Diaz-Balart, of Florida, John Faso, of New York; Mia Love, of Utah; and Ileana Ros-Lehtinen, of Florida.The petition has more than a dozen Republicans on it already, Denham said, and while the members would not reveal their list of supporters in advance, they did note the signatories come from across the ideological spectrum.As of mid-afternoon Wednesday, the petition had 15 signatories, mostly moderates.Some more conservative members of the House could back the effort because it would allow a vote on a hardline immigration measure they've supported, and circumvent what conservatives often complain is overly restrictive procedural controls by leadership."I think you'll see many different caucuses throughout the House that are engaged in this debate that are focused on different solutions," Denham said. "I think it's our job. Congress needs to do its job and be held accountable."President Donald Trump sought to end the executive program put in place under the Obama administration last September, but a collection of court rulings have found Trump's action likely does not pass legal muster, and kept the program largely in place. A group of red states recently sued in a different court to try to have the program itself declared unconstitutional.Lawmakers have sought to pass legislation that would enshrine the program in law, which would address critics who say it goes beyond the authority of the executive branch. But efforts to protect it in Congress have been unsuccessful.It remains unclear if the new effort will pick up enough support to force a House showdown. While it starts with a number of Republicans in support, it would still need to roughly double the number of GOP members signing on and pick up all Democrats in the House. Effective discharge petitions have been rare in House history, though not unheard of.Democrats have insisted on a path to citizenship for DACA recipients and have opposed measures that they say are too aggressive or punitive to immigrants in return, though they have agreed to billion in border security funding. Most Republicans have been split about a path to citizenship, and have insisted any such deal must include cuts to legal immigration and hardline measures to target illegal immigration, as well.The discharge petition would support what's known as a "queen-of-the-hill" rule, which would bring four competing immigration-related bills to the floor for debate and a vote. Denham and Hurd had previously announced the rule had the support of 50 Republicans and 190 Democrats, more than 20 members over the threshold for a majority of the House, but it's unclear if all of them will back the petition.Denham, Hurd and Curbelo's move Tuesday would pave the way for a floor vote on a hardline bill from Republican Reps. Bob Goodlatte, Mike McCaul and others that does not include a path to citizenship; a creation of a program like DACA without any border security measures from Democrats; a bill Ryan would offer; and a bipartisan bill?from Hurd and California Rep. Pete Aguilar that would pair a path to citizenship with a direction to the administration to gain "operational control" of the border by the best means available. The rule also allows for the authors of the bills to change them, and the members expected all of the proposals would evolve before a floor vote -- especially to include language that would appropriate billions for border security.GOP leadership has agreed to whip the Goodlatte bill, but it has failed to gain the support of enough Republicans to make it viable to pass the House. The President has backed Goodlatte's legislation and rejected all the other proposals put forth besides his own hardline plan. The reserved spot for the speaker could be any bill of his choosing.The "queen-of-the-hill" procedure would mimic an exercise in the Senate earlier this year, when votes on four competing immigration proposals ended with none reaching the number of votes necessary to move forward, including the President's plan."This debate is too important not to have," said Hurd, who has roughly one-third of the entire southern border as part of his district, more than any other single member. "Let's have this debate on the House floor and let everybody bring their ideas to the forefront." 6770

  

A Fort Myers, Florida woman was maced in her face while working at the McDonald's on Cleveland Avenue.This happened Saturday evening. Alisha Irons, 24, was arrested and charged with battery."My eyes were swollen, and I couldn't even open them for two days," Tatiana Green, 24, said.The the victim said Irons, the girl who maced her, used to be her best friend. "She sprayed it in my eyes. It burnt so bad, I couldn't see," Green said.Green told Scripps station WFTX in Fort Myers it started Thursday when Iron's cousin took her bank card. Green said she reported it to Fort Myers Police. On Saturday, she said Irons showed up during her shift at McDonald's and used bear mace."Anything could have happened to me. I could have went blind. And it was so humiliating because I had to come out of my clothes, and I'm in my bra and panties, and I'm running around on fire," Green said."To be helpless, I started pouring water and soap on her to cool off and that's something no mother should have to go through," Green's mom, Crystal Hayes, said.When initially asked for a comment, Irons referred WFTX to a rap video of herself she posted on Facebook.She also posted a message saying "I don't regret anything ... The only thing I'll do different is mace the (expletive) when she clocked out, simple."Irons has since bonded out of jail and lives next door to Green."I could hear her door shutting and it's terrifying, because I don't know what else she's going to do to me," Green said.Fort Myers Police said a girl claiming to be related to Green was arrested after showing up to Irons' apartment and firing a gunshot in the air. When WFTX asked Green about this, she said she was in the hospital at the time.Irons also said she knows it was wrong of her to show up to Green's place of employment, but there's more to the story.Green is filing a restraining order against Irons. 1906

  

A driver was life-flighted to Cleveland Clinic Akron General Medical Center after leading troopers on a chase that caused him to miss a stop sign, before going airborne in Medina County on Wednesday morning.Troopers attempted to initiate a traffic stop on a white 2009 Mazda 6 for a speed violation of going 76 miles per hour in a 35 mph speed zone on US 42 near Grafton Road.Authorities said the driver attempted to get away from troopers by traveling westbound on Grafton Road in Medina County when he missed the stop sign at Marks Road, causing him to go airborne for about the length of a football field. The car cut off the top of two trees that were about 15-20 feet in the air before coming to a stop in a front yard.The driver sustained non-life threatening injuries as a result of the crash. Authorities said alcohol is suspected at this time, but it's unclear why the driver was evading police. 942
