LITTLETON, Colo. — In one Colorado neighborhood, life is quiet, which makes what happened last Sunday hard to understand for many residents.A man named Scott Smith was arrested after claiming that his wife, Kanokwan Smith, tried to kill him with a butcher knife in their Littleton home. In an affidavit detailing the incident, he said he had no choice but to shoot and kill her. As of Sunday evening, Scott had not been charged in connection to the case and he is not in custody.For neighbor Dominique Naylor, who has known Kanokwan for more than a decade, the pain is unbearable. She said she was a hard worker and juggled three jobs."She’ll never be able to wrap her arms around her little girl again and he shouldn’t have that right," Naylor said. "He shouldn’t be out and he shouldn’t be free."She said there's not a question in her mind that Scott killed her, and other neighbors and friends agree, adding that Scott "wasn't the kind of person you ever wanted to see (Kanokwan) with."She said anybody who knew her friend knows she wouldn't hurt a fly."It just seems so unfair to live in a world that doesn’t have her in it because she’s just so kind and worked so hard and how could anyone hurt her?" LEE COUNTY, Fla., — Your child gives it their all, both time and effort, yet struggles to complete a homework assignment.Another child scribbles their name on a piece of paper and turns it in.Technically, both students could get the same grade according to an investigation by Scripps station WFTX in Fort Myers, Florida that’s uncovering the tactics teachers and administrators are using to boost low grades.WFTX's Tony Sadiku obtained emails from a Harns Marsh Middle School assistant principal to teachers asking for everyone’s commitment to follow the school’s grading policy, '50% minimum, 0 = 50' in a practice known as minimum grading.Teachers say students who would otherwise get a zero are given between a 50 to 59 percent regardless of whether they prove they’ve learned anything. If a student doesn’t turn in a single assignment all quarter, they’ve earned a 50% at some schools. The principal at Harns Marsh told teachers in 2016 via email, “A 60 for our students that are trying but are several grade levels behind academically is fair.”Some parents said they disagree.  “I don’t believe it’s fair, by no means,” said one parent of a 7th grader at the school.Several parents said they've never heard of minimum grading.  Even some Lee County School Board members said they were unaware of the school’s grading practice.  “I know of no such policy, formal or informal, in Lee County schools,” said Board Member Cathleen Morgan.“I am not aware of such a policy,” said Board Member Dr. Jane Kuckel. “I think every parent needs to be aware of the grading policy,” said Mark Castellano, a former Lee County public school teacher. The Lee County School District said minimum grading is not a District policy, but a practice implemented by some schools and teachers to encourage struggling students. “Often times a zero can completely deteriorate a grade and they will lose interest because they think there’s no way for them to get a passing grade,”  said Dr. Wanda Creel, the District’s Chief Academic Officer. “When students will grasp those concepts is really is on a personalized individualized basis. Minimum grading allows students to stay engaged while still learning and for teachers to continue to work with them through the process.”Creel said the goal is for students to pass on their own.But does a better grade on a report card mean students are actually learning?While students may have a better shot at passing their classes because of minimum grading, numbers from the Florida Department of Education show many still aren’t testing well.At Harns Marsh Middle school, 38 percent passed the English Language Arts Florida Standards Assessment test in 2017. In the entire District, 53 percent of middle schoolers passed.Harns Marsh kids also had lower numbers in the FSA Mathematics Test. Only 35 percent of kids passed last year compared to 51 percent of middle schoolers in the District who passed.Middle school students who don’t pass are still promoted to the next grade level, but may be more likely to struggle down the road.Statistically, 8th graders are more likely to be retained than 6th and 7th graders according to the Florida Department of Education.“Teachers will begin to think that I need to retain because this child doesn’t seem to be able to tackle the issues in high school,” Creel said. “A retained 8th grader can be one of the highest indicators of a dropout. We are finding strategies to help our overaged 8th graders to get the credits they need so they can move on to high school.”“You have kids that are absolutely motivated and they love learning. Those kids you rarely have to do anything. Then you have kids that struggle. They struggle with their home life. They struggle with their socioeconomic situations,” Castellano said.But is adjusting a student’s grade closer to passing the solution?“What are we teaching kids in terms of their personal responsibility for their education?” Castellano said.Castellans says in his nearly 30+ years of teaching, not once has he used the practice. “What they’re saying is for those kids the grade is irrelevant, it’s not going to motivate them,” said Robert Kenny, a professor of education at Florida Gulf Coast University. School Board Member Jane Kuckel supports minimum grading policies at some schools.“All students learn and thrive in different ways," she said. "The outcomes are non-negotiable. The process for getting there needs to be tailored to the achievement levels and learning styles of the students.”One parent argues her child earning the grade matters more.“It’s a big deal cause he needs to learn and he needs to make it in this world," the parent said. "The world is not going to give him a free pass forever and they don’t need to learn that in middle school.” The District said they plan to set up committees next fall to evaluate how minimum grading is being done to come up with a more uniform approach across the District.  5113

LAHAINA, Maui (KGTV) - A wildfire put a twist on the Hurricane Lane response in Maui Friday.California resident Victoria Monroe is visiting Lahaina and posted photos to Twitter showing high winds slamming the Maui coastline. She also captured the brush fire moving toward the coast.The fire grew to 300 acres by Friday morning, with reports of structures lost. One woman suffered burns to her hands and legs.10News received an email from San Diego resident Jodi Vachon who owns a home in the fire area."I'm just worried about not only the hurricane but the fire as well. So, it's coming from both ends," said Vachon.Vachon told 10news her home is all right, but she's heard from neighbors in Maui that at least two homes have been lost.She said they're hoping Hurricane Lane will bring some heavy downpours to the burn area.Meanwhile, travelers at San Diego International Airport are prepared for a bumpy ride as they board flights to Honolulu, where the effects of Lane have yet to interfere with flights."I like a little rock and roll," said Dr. George Pratt, a Clinical Psychologist with Scripps Hospital in La Jolla.  He flew to a lead a seminar on the big island of Hawaii on the subject of success.As for a successful flight for nervous fliers, he said, "Meditate. LA MESA, Calif (KGTV) - According to the California Department of Public Health, seven deficiencies were issued after an investigation of Sharp Grossmont Hospital. In April state investigators conducted a survey consisting of 14 closed medical records. According to the investigator's findings documented in a statement of deficiencies and plan of correction report, "Hospital leadership did not provide notification of a potential investigation and the use of video recording during medical treatment without patient's consent." Investigators also noted deficiencies with regulations related to medical staff accountability, patient's rights, and use of restraint or seclusion. According to the state document, "The patient has the right to personal privacy. This Statute is not met as evidenced by: Based on interview and record review, the hospital failed to ensure the privacy of all patients undergoing medical treatment in the WHC (women's health center) ORs (operating rooms) when the hospital's Admission Agreement for Inpatient and Outpatient Services was utilized as consent to allow video recording during medical treatment. Also, the Admission Agreement did not allow the patients' the option to acknowledge and/or decline video recording. As a result, the hospital leadership allowed video recording of patients undergoing medical treatment without knowledge or consent." The deficiencies listed fall under violations to conditions of participation for a hospital as listed in title 42 of the federal code of regulations.   A deficiency is a violation of a federal or state law or regulation that the California Department of Public Health cites during a survey or investigation.Officials with the California Department of Public Health tell 10News issuing deficiencies is a form of enforcement action. It requires the facility to submit a Plans of Correction to fix any violations. According to Sharp officials, in 2012 they were alerted that beginning in 2011, potentially powerful drugs and equipment were missing from the anesthesia cart in each of Sharp Grossmont Hospital's three Women's Center operating rooms. The hospital installed a computer monitor with a motion-activated camera in each of the three Women's Center operating rooms. Between July 2012 and June 2013, the videos were recorded. The hospital says the cameras were intended to record only individuals in front of the anesthesia carts. In a statement to 10News, a spokesperson for Sharp wrote:"In their survey, the California Department of Public Health (CDPH) identified areas where opportunities for improvement existed. The hospital addressed each area of concern and created a plan of correction for those findings. Both CDPH and the Centers for Medicare & Medicaid Services (CMS) accepted Sharp Grossmont’s plan of correction, as confirmed in a follow-up survey. The hospital’s plan of correction provides that:The specific techniques used in the 2012-13 investigation have not been used since and will not be used for any future investigations.Any potential future investigations are required to strictly adhere to Sharp’s policies and procedures;Medical staff will be kept informed of any similar future investigations that may occur;Patients will receive full disclosure of any future investigations that may affect their privacy;The patient grievance practices have been strengthened to ensure patient complaints and grievances are appropriately and efficiently managed; andAdditional measures are in place to safeguard against the inadvertent release of patient information to third parties. Staff and clinicians have been educated on the hospital’s plan of correction and policies. While we are pleased that CDPH and CMS accepted our plan of correction, we regret that the investigation inadvertently recorded patients and may have caused distress to those we serve."More than 400 women who claim they were secretly recorded are suing the hospital.Court records show a hearing is scheduled in September. 4026
