SAN DIEGO (CNS) - A community vigil to honor last week's El Paso shooting victims is set for 7 p.m. Sunday in Balboa Park, organizers said Saturday."We wanted to express our grief and be there for the community," Jessica Yanez Perez, a vigil organizer, said. "As a border city with strong Latino heritage, we stand with El Paso and grieve with them."The two-hour event will be held outside the Centro Cultural de la Raza in Balboa Park and will feature community speakers, a prayer vigil and biographies of the 22 victims of Aug. 3's mass shooting, Perez said."This event is an opportunity to bring the community together as we mourn, remember and hopefully, in time, heal," Perez said. "It's our shared responsibility to speak out against white supremacy and intolerance, and to build an America where all of us are safe."A traditional mariachi band will perform at the vigil, she said. SALT LAKE CITY, Utah -- A Salt Lake City K-9 officer has been charged with aggravated assault in connection with an April 24 incident.Officer Nickolas John Pearce, 39, responded to a report of domestic violence that day. Pearce is accused of commanding his K-9, Tuco, to bite Jeffery Ryans, even though Ryans was on his knees and had his hands in the air."When K-9 Tuco engaged and was biting Ryans, [Pearce] continually praised and encouraged K-9 Tuco," a probable cause statement said. "While he was being attacked by K-9 Tuco, Ryans expressed extreme emotions reflective of pain from being bitten by K-9 Tuco and plead with the officers to stop the biting. He questioned why he was being attacked when he was not resisting."Ryans suffered large lacerations and required hospitalization for his injuries. After receiving treatment for his injuries, Ryans was booked into the Salt Lake County Metro Jail on a charge of violating a protective order.In an interview with KSTU on Wednesday, Salt Lake County District Attorney Sim Gill said they looked to see if the force used was reasonable."And in this case, the conclusion of our attorneys when we reviewed the body cam video, we looked at the reports that were generated, and we could find no lawful reason to use that police dog in the fashion that it did and resulting in the injury caused on Mr. Ryans," Gill said.(Warning: the following body camera video contains graphic language and violence) 1458

SAN CARLOS, Calif. (KGTV) -- Police are searching for a suspect caught on video stealing a bike from a San Carlos garage in late October. According to police, the theft happened on the 6600 block of Bell Bluff Avenue on October 25 around 2 p.m. Police say the suspect backed his truck into the victim’s garage before using bolt cutters to cut a lock and steal a M80 mountain bike. According to police, the theft wasn’t the first time mountain bikes were stolen from the same home. On October 13 and 15, the victim had two other mountain bikes stolen from the garage. The total value of the three bikes is ,000, police say. At this time, it’s unknown if the same suspect is responsible for all three thefts. The suspect is described as a white male in his 30s or 40s with short, blonde hair and a full beard. SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. -SAN CLEMENTE ISLAND (CNS) - The remains of seven U.S. Marines and a Navy sailor were recovered Friday after going missing near San Clemente Island when their amphibious vehicle sank during a training mission last month.The remains were recovered during underwater salvage operations, the 1st Marine Expeditionary Force announced Friday evening. The remains will be transferred to Dover Air Force Base in Delaware to be prepared for burial."Our hearts and thoughts of the 15th Marine Expeditionary Unit are with the families of our recovered Marines and Sailor," said Col. Christopher Bronzi, commanding officer of the 15th Marine Expeditionary Unit. "We hope the successful recovery of our fallen warriors brings some measure of comfort."The U.S. military announced Tuesday it had located the amphibious assault vehicle that sank last week off the coast of San Diego County, killing nine young servicemen, and confirmed the presence of human remains where the vessel came to rest on the sea floor.The naval Undersea Rescue Command made the discovery near San Clemente Island on Monday using video systems remotely operated aboard the HOS Dominator, a merchant vessel whose crew specializes in undersea search and rescue.The amphibious troop-transport vehicle was en route to a waiting ship during a maritime training mission about 80 miles west of Encinitas when it foundered for unknown reasons about 5:45 p.m. July 30, according to Lt. Gen. Joseph Osterman, commanding general of I MEF.The 26-ton vessel went down roughly 1,600 yards from a beach on the northwest side of the island in water nearly 400 feet deep.Seven members of the Camp Pendleton-based crew survived the accident. Medics took two of them to Scripps Memorial Hospital La Jolla, where both were admitted in critical status. One was upgraded to stable condition as of Sunday night.The other five rescued Marines received clean bills of health and returned to their units.Pronounced dead at the scene of the accident was Lance Cpl.
