SAN DIEGO, Calif. (KGTV) -- An appeals court today overturned a ruling that would have allowed the conditional release of the “Bolder Than Most” rapist, Alvin Quarles. The ruling was issued by the 4th District Court of Appeals Monday. The court said, in part that “Quarles is a serial rapist whose crimes were shockingly brutal and destructive. If he fails after he is conditionally released, considering his past, we shudder to contemplate the consequences of such a failure.”After news broke of the reversal, Dianne Jacob, who serves on the San Diego County Board of Supervisors and has been adamantly against the release, spoke out on Twitter. We must continue to fight the placement of sexually violent predators into our communities,” Jacob said in part. The ruling comes after San Diego County Superior Court Judge David M. Gill's decision to release Quarles to a home somewhere in San Diego County. After his release, he would have undergone treatment through a conditional release program.Gill's ruling followed a series of closed-door hearings that involved testimony from psychiatrists and other experts. Quarles was dubbed the "Bolder Than Most" rapist due to the way he attacked his victims at knifepoint, sometimes forcing the women's husbands or boyfriends to watch. In 1989, he pleaded guilty to committing over a dozen sexual assaults in the mid-to-late 1980s. He was sentenced to 50 years in prison. SAN DIEGO, Calif, (KGTV) - An information meeting Thursday evening is one of the final steps before plans to expand the Miramar Landfill are sent to the state. Currently, the landfill is expected to close Sept. of 2025, but this new plans will extend that to an estimated closure of Nov. of 2031, and also increase the height of the landfill by a maximum of 25 feet. Program Manager for the Solid Waste Local Enforcement Agency Bill Prinz said these dates could change depending on how quickly trash is put into the landfill. He also said this increase in capacity means about 10 million cubic yards of trash are being added to the already about 87 million cubic yards. Currently, 87,760,000 cubic yards of Gross Airspace are being used, and the plan will bring the maximum height to 97,354,7355 cubic yards of Gross Airspace. The meeting Thursday, May 28 is from 5:30 p.m. to 7 p.m. and will be information focused. The public can tune in virtually to listen, ask questions and offer feedback, however no decisions will be made. Prinz said the LEA will send the plans, including the feedback from the meeting, to Sacramento, and the state will have 60 days to either accept or deny the plan. SAN DIEGO COUNTY (KGTV)-- Scattered showers sprinkled all across San Diego County Saturday, bringing with it up to a quarter inch of rain. While rain totals were not significant, it was the reason for hundreds of car accidents.At 11:40 AM, 10News found a passenger van flipped onto its side. The driver said he was turning onto the Home on-ramp on WB 94 when he hydroplaned and flipped over. With some help from good Samaritans, he was able to climb up out of the passenger side door. He was not hurt. There were no passengers. One of many solo spin-outs happened on the 163 S to the 8 E on-ramp. The driver said at around 12:30 PM, he lost control of his truck at the top of the loop, then smashed into the concrete barrier. He said he felt lucky he did not roll down into a 50-foot embankment like another car did just a few hours prior in the same spot.RELATED: Check today's San Diego forecast10News crews also saw countless fender benders and flatbed tow trucks roaming the highways. Mother nature also wreaked havoc onto herself. At around 2:30 PM, a tree toppled onto Northbound 805 near Plaza South.Branches partially blocked the slow lane until clean up crews arrived.By afternoon, the rain clouds started to concentrate over North County. A three-car crash happened along Westbound 78 near the Nordahl Rd on-ramp in San Marcos. The small red vehicle ended up mangled, and the Prius somehow climbed up an embankment. Firefighters said all airbags on the Prius were deployed, and thankfully no-one was injured. 1526

SAN DIEGO, Calif. (KGTV) - A former North County Boy Scout said he is one of hundreds of sexual abuse victims in a new lawsuit against the Boy Scouts of America.Matt, who only wanted to use his first name, joined the Boy Scouts when he was around 13 years old. He really loved the outdoor activities.“We had a lot of great trips… a lot of good camp outs,” Matt said. Roughly a year after he joined, things changed.“We had an assistant Scoutmaster that started to join us on trips,” Matt said. “He just started spending more time with kids and a lot of these bad things started to happen.”The new lawsuit alleging sexual abuse was filed on behalf of one former scout in Pennsylvania. The total number of alleged victims in this latest wave of accusations is more than 850, according to attorney Andrew Van Arsdale. Matt is one of them.“Our oldest [alleged victim] is in his late 80s. Our youngest is 14-years-old,” Van Arsdale said. Van Arsdale is one of the lawyers involved in the group “Abused in Scouting.” The group came together after hearing the Boy Scouts were potentially filing for bankruptcy. They began a campaign telling victims that they no longer have to be in hiding. “It’s time to come forward. It’s the right time now and the response was overwhelming,” Van Arsdale said. He said he is “100 percent” expecting more people to come forward. For Matt, time has not healed all wounds of what he said the assistant Scoutmaster did to him.“He had come at me on multiple times. I think the first time, I was able to get him away from me,” Matt said. He was able to get away the first time, but not every time. He specifically remembers a camping trip in Camp Pendleton.“I woke up and he had gotten his hands on my genitals and massaging me… I woke up and pushed him off,” Matt said. “I think I just really kind of put it at the back of my head and just tried to forget about it.” But he didn’t forget and he said other kids in his troop were also abused by this man. In a statement, the Boy Scouts of America said that they “believe victims” and that the organization has “taken significant steps over many years to ensure that we respond aggressively and effectively to reports of sexual abuse.” The full statement can be read here. For some, it’s too little too late. “They knew it was a problem for a long time,” Van Arsdale said.“Anytime you got kids with adults having access to kids, you better make sure those adults are reliable, good people. And I don’t know that the scouts are doing that now. I would hope they are, but I know back in the day they weren’t,” Matt said. Matt said he quit because of that assistant Scoutmaster. So far there are eight former scouts in San Diego that are part of these latest allegations against the organization, according to Van Arsdale. 2798

SAN DIEGO (KGTV) - A mountain biker wants to warn people about visiting the Tecolote Canyon Nature Trail. He tells 10News he had a disturbing encounter there with a man carrying a knife. Mike Hayes was feet from a trail entrance in Tecolote Canyon off Mt Acadia Boulevard when he was approached by a strange man on Sunday. Hayes says he was walking his bike near the man - a transient in his 20s, dressed in camouflage - when the man suddenly came forward and asked if Hayes was stalking him.  When Hayes said no, the man got agitated and had a look with "Charles Manson eyes." "Next thing you know, he has a knife in his hand and an angry look," said Hayes. "And he says 'If you follow me, I'm going to cut you.'"Hayes says he backed away slowly, got on his bike and rode off, while the man walked his bike away.     875
