SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. SAN DIEGO (CNS) - Lab-confirmed flu cases increased countywide last week for the second consecutive week, county health officials announced Wednesday.The county Health and Human Services Agency confirmed 74 flu cases, an increase of 22 cases over the revised 52 confirmed the previous week. The county confirmed 30 cases during the week of Oct. 20-26.County health officials have confirmed 475 flu cases to date since tracking for the 2019-2020 flu season began July 1. SAN DIEGO (CNS) - Health officials in San Diego County reported 269 new COVID-19 infections Sunday, bringing the total to 54,583 since mid-February, and two new deaths, bringing the overall fatality total to 870.The two deaths were men reported to have died earlier this month. They ranged in age from late 60s to early 70s, according to the San Diego County Health and Human Services Agency.Of the 10,819 new tests reported, 2% returned positive. The 14-day rolling average percentage of positive cases is 2.7%. The 7-day daily average of tests is 11,127.Two new community outbreaks were confirmed, one in a health-care setting and the other in a restaurant. In the past seven days -- Oct. 18 through Oct. 24 -- 26 community outbreaks were confirmed.A community outbreak is defined as three or more COVID-19 cases in a setting and in people of different households over the past 14 days.Of all cases, 3,850 -- or 7.1% -- have required hospitalization. And 889 -- or 1.6% -- of all cases and 23.1% of hospitalized cases had to be admitted to an intensive care unit.Meanwhile, all students at San Diego State University remained under a stay-at-home advisory announced Thursday. The advisory began at 6 p.m. Friday and will run through Nov. 2 at 6 a.m. University officials said the move was made to discourage students from participating in Halloween events where physical distancing cannot be done. SAN DIEGO (CNS) - An Italian restaurant in Encinitas agreed to pay ,800 to settle a pregnancy discrimination lawsuit filed by a former employee who alleged her hours were substantially cut, and she was ultimately fired, after she told her employer she was expecting, the U.S. Equal Employment Opportunity Commission announced Tuesday.After informing the owner in 2015 that she was expecting, the server was told that she "should stay home since she was pregnant, that her pregnancy had caused coverage problems, and that (the owner) would offer a position with less pay for more work so that she would not come back from her pregnancy leave," according to the complaint filed against Maurizio Trattoria Italiana LLC.She was fired in the summer of 2015, while less experienced servers were hired, according to the complaint.RELATED: Lawsuit aims to stop California's AB 5 from taking effect"Women should not be penalized for having children," said Christopher Green, director of the EEOC's San Diego office.
