SAN DIEGO (KGTV) -- A former professional skateboarder convicted of raping and murdering a woman in Carlsbad nearly three decades ago is suitable for parole, a hearing panel at Donovan Correctional Facility determined Tuesday.The Board of Parole Hearings panel determined Mark “Gator” Rogowski is not an unreasonable risk to the community, setting him up for release despite objections from the victim’s father and the San Diego County District Attorney’s Office over a crime that stunned the region in the 1990s.“We think the decision did not take into account the grave public safety concerns posed by this inmate. We think he still poses a threat, especially to women,” said Supervising Deputy District Attorney Richard Sachs. “When someone does something as horrible as this, it shocks the conscience that they would be granted parole,” he added.A world champion skateboarder in the 1980s, Rogowski was convicted of beating Jessica Bergsten with a metal rod into semi-consciousness, raping her, wrapping her in a surfboard bag, and strangling her to death in a fit of rage that spanned three or more hours. Rogowski later buried her body in the desert.Bergsten was a friend of Rogowski's ex-girlfriend. He said he took out his rage from the break-up on Bergsten, a college student and part-time model, in a case of "misplaced revenge."“The pain never goes away,” the victim’s father Stephen Bergsten told the panel. “This inmate received a life sentence, but he imposed a death sentence upon Jessica and our family.”Commissioner Brian Roberts said the panel took several factors into consideration, including Rogowski’s remorse for the crime, lack of significant criminal history, good behavior in custody, and rehabilitation programs he has completed during his 27 years in prison.Roberts said the panel also put significant weight on a new law that gives added leniency to “youthful offenders” who commit crimes before the age of 26. The law, which took effect in 2018, is based on studies showing the impulse control architecture in the brain is not fully developed in most people until about age 25.“I’m disgusted with what I did. I think about it every day,” Rogowski told the board. “I took everything from that poor family. They have every right to be angry with me. I want to make it go away but I can’t.”The Board of Parole Hearings has 120 days to finalize the decision. After that, the case will go before the governor for review.“Unfortunately, justice wasn’t served today, but the governor will have a chance to look at this case and we hope he will,” Deputy DA Sachs said.Commissioner Roberts ordered Rogowski to live temporarily in transitional housing upon release. SAN DIEGO (CNS) - Violent crime in San Diego County rose in the first half of the year for the fifth consecutive year, according to a report released Tuesday by the San Diego Association of Governments. The report by SANDAG's Criminal Justice Research Division found that the mid-year number of violent crimes in the county was 5,545, up from 5,510 last year; 5,421 in 2017; 5,361 in 2016; and 5,330 in 2015. The five-year increase amounts to a 4% bump in violent crime. Reports of property crime went the opposite direction, falling from 30,447 in 2015 to 27,236 in 2019, an 11% decrease. The mid-year numbers of violent and property crimes in 2019 are vastly different from 2009, when the city received 6,256 violent crime reports and 35,204 property crime reports. Violent crime reports dropped 11.4% in that span, mainly because robbery reports fell from 1,931 to 1,411, according to the SANDAG report. Despite the overall drop in robbery reports, this year's number increased 5% compared to the same six-month period last year. Arson reports saw the largest drop from last year to this year -- falling 28% from 190 to 136 -- while homicides dropped from 40 to 38. Reported property crimes fell 22.6% from 2009 to 2019 and residential burglaries saw the biggest decrease in that time, dropping 53.9% from 4,460 to 2,054. Larceny over 0 was the only category to increase from 2009 to 2019, rising from 7,578 to 8,527. Reports of rape fell to 539 after reaching 604 at the midway point of 2018. However, numbers since 2015 may be somewhat deceiving, as California law enforcement broadened the definition of rape in 2015 to include ``male victims, sodomy, penetration with any body part or object, and no longer requires force,'' according to SANDAG Division Director of Criminal Justice Dr. Cynthia Burke. As a result, some crimes that would have been classified as aggravated assaults are now considered rapes and some crimes that would not have been considered violent crimes are now captured in these statistics, Burke said. Violent crimes include homicide, rape, robbery and aggravated assault. Property crimes include burglary, larceny and motor vehicle theft. According to the report, San Diego law enforcement has received an average of 31 reports of violent crime and 150 reports of property crime per day during 2019's first half. 2353

SAN DIEGO (KGTV) -- Security is tight at San Diego's mosques following an arson attack at a mosque in Escondido early Sunday morning. Someone set fire to the Islamic Center of Escondido on West Sixth Avenue around 3 a.m, but a handful of worshippers was inside, and the group put out the fire before it caused any significant damage. When police arrived, they found a message in graffiti referencing the recent shootings at mosques in New Zealand. Monday afternoon, two San Diego Police Department patrol cars sat in the parking lot of the Islamic Center of San Diego. Directors say worshipers are nervous. "They accept the faith of what happened, others are very, you know, worried as well. It's a mixed mood," said Khelil Ouznali, vice chair of the board of directors. The center already has surveillance cameras all over the property and guards on duty, but now the directors are considering hiring armed guards. "We are looking into improving security, you know, we are looking into different options based on the feedback from our community," said Ouznali. On the campus of San Diego State University Monday, dozens of students rallied against hate. They marched through the student union chanting, "No hate at state, Muslims are here to stay, no hate at state, Muslims are here to stay!" Faduma Mohamed is a member of the Muslim Student Association. "It just goes to show there's a lot of hate against us, but although some people can attempt to destroy Muslims, Islam itself the religion, cannot be destroyed," said Mohamed. The group posted pictures of the lives lost in the shooting rampages at the mosques in New Zealand and the attack at a Jewish Synagogue in Pittsburgh. "It doesn't matter what race, religion or color you are, every human life matters and we share a common denominator of a soul and spirit and that they should take part in respecting these people whose lives were lost," said Mohamed. 1926

SAN DIEGO (KGTV) — A 4.9-magnitude earthquake and several smaller shakeups recorded in Imperial County on Wednesday were reportedly felt in San Diego County.The swarm of earthquakes was centered around the Westmorland area. While many of the smaller quakes were recorded between 2.5- and 3.7-magnitude, about 80 earthquakes measuring at least 2.5-magnitude were recorded between 4 p.m. and 7:15 p.m.The largest earthquake as of 5:45 p.m. registered at 4.9-magnitude, according to the agency's latest earthquakes map.Seismologist Dr. Lucy Jones tweeted that Wednesday's series of earthquakes was one of the largest swarms Imperial Valley has seen, adding that the area is historically active in swarms."The swarm happening now south of the Salton Sea, near Westmoreland is over 30 km south of the end of the San Andreas," Jones tweeted. "It is in the Brawley seismic zone, a common source of swarms. So far largest is M4.4. Too far from the San Andreas to change the probability of a quake on it." 1004

SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102
