SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) - A new report says San Diego Unified School District is losing nearly million a year due to the exploding number of charter schools.School districts receive funding per student. The report by the organization, In the Public Interest, found SDUSD loses nearly ,913 a year per charter school student, largely due to costs that cannot be reduced when a student goes to a charter school. SDUSD is the second-largest district in California.There are about 120 charter schools in San Diego County. Roughly 50 of those schools are in the SDUSD. Elva Barajas’ son attends a local charter school.“I liked what they were offering for the students. There were smaller classrooms… less than 25 kids in the classroom. It was more individualized for the students,” Barajas said.Miriam Rodriguez’s daughters go to traditional schools within SDUSD.“At the end of the day, the schools are in my community,” Rodriguez said.The report, called "Breaking Point: The Cost of Charter Schools to Public School District," analyzed three California school districts including San Diego.Superintendent Cindy Marten and SDUSD trustee Richard Barrera argued that local districts need more control over school charter decisions. Barrera said district leaders need to ask critical questions, including fiscal impact. Currently, he said they are not allowed to do so.“What is it bringing to the table, what is it adding to the mix of schools… but also, what is it taking away?” Barrera said.Michelle Anderson, Regional Manager for the California Charter Schools Association, said districts already have enough oversight. “This is really a misrepresentation of issues that came through from a report that was paid for by special interests. SAN DIEGO (KGTV) — A jury returned several guilty verdicts Friday against a La Jolla restaurant owner accused of raping eight women who he either drugged or knew were too intoxicated to consent to sex.Jurors found 61-year-old Daniel Dorado guilty of 20 counts in connection with alleged rapes that happened in 2009, 2014, 2015, 2017, and 2018. Some of the counts Doroado was found guilty of include two counts of rape of an unconscious person; two counts of rape of an intoxicated person; two counts of assault with intent to commit rape, sodomy oral copulation or sexual penetration of an unconscious or intoxicated person; two counts of sexual penetration of an unconscious person with an unknown object; and two counts of sexual penetration of an intoxicated person with an unknown object.Dorado had faced 35 felony counts. The jury acquitted him on three counts, deadlocked on six counts, and have not yet reached verdicts on six remaining counts. SAN DIEGO (KGTV) – A man was arrested in connection with the shooting death of a woman in a Mountain View apartment, San Diego police announced Thursday.SDPD officials said officers responded to reports of a shooting inside an apartment unit in the 4500 block of Imperial Avenue at around 4:30 p.m. Wednesday.Officers arrived and found a woman, later identified as Emily Cortez, with a gunshot wound in her upper torso. She was located on an upstairs walkway of the apartment complex, SDPD officials said.According to police, a man was providing medical aid as officers and emergency medical crews arrived at the scene.Despite life-saving efforts, Cortez, 19, was declared dead at the scene.During their investigation, SDPD Homicide Unit detectives identified the suspected gunman as 18-year-old Jorge Manuel Sanchez and arrested him in connection with Cortez’s death.SDPD officials said Cortez and Sanchez lived in the apartment where the incident occurred, and the suspect and victim were in a relationship.No other information was released.Anyone with information regarding the incident is urged to call the SDPD Homicide Unit at 619-531-2293 or Crime Stoppers at 888-580-8477. 1188

SAN DIEGO (KGTV) -- A man suffered serious injuries after a scooter crash on the Mission Beach boardwalk late Tuesday afternoon. According to police, the crash happened around 4:30 p.m. near Ocean Front Walk and San Luis Obispo Place. Authorities say a 55-year-old man on a bicycle and a 27-year-old man on a scooter collided on the boardwalk."His bike was upside and he was just laying there," said Nicole Ryujin, who saw the aftermath. "He wasn’t moving and at first I was like, 'is this guy okay?'" Police say the 55-year-old was taken to the hospital with serious injuries, but not life threatening. According to police, the 27-year-old didn't suffer any injuries. Investigators say the scooter rider was headed north on the boardwalk, and the biker was headed south, when they collided. At this time, it's unclear exactly what led to the crash. Traffic investigators questioned the scooter rider on scene. Investigators say there is no criminal investigation at this time. 987
