ENCINITAS, Calif. (KGTV) - A North County woman says she was scammed at a gas station by a performance 'worthy of an Oscar.'"We pull in and my husbands about to pump in the gas," said Alice. An ordinary trip to fill up turned eventful last month at the Shell gas station on Santa Fe Drive. "I see a man pull up in a black SUV, brand new and shiny," said Alice. Alice says a man in his 30s got out of the GMC Yukon and approached them."He was in head-to-toe designer clothes," said Alice. In the backseat was a well-dressed woman and a little girl."He says, 'Excuse me, Sir. I'm here vacationing from Dubai with my family and my wallet was stolen,'" said Alice. The man asked for some money for gas and then took out a ring."Here, take my ring. It's worth 0. I have money and plenty of jewelry at home. I just need money for gas and food," said Alice.Alice told the man to keep the ring and then had her husband put in on a pump with their credit card."I believed their story ... I put myself in their shoes. I would be devastated, and I would want someone to help me," said Alice.Days later, she learned from her cousin in Los Angeles those strangers were scammers. "I was the 4th person she knew of personally that this happened to. I was duped," said Alice."Then this past Wednesday, Alice was back at the gas station and filling up, when she saw something familiar," said Alice.It was another new GMC Yukon. Inside was a different family. She saw them talking with a young man, before pulling out a ring. "I ran over put my hand in front of the guy and said, 'You should be ashamed of yourself. This is a scam!" said Alice. She learned the family had a similar story about vacationing from Dubai. The SUV sped off, leaving behind a woman hoping others don't fall victim."It makes me angry. It's the giving season and they take advantage of that. They're actors. They played their part perfectly. They're going to get an Oscars, and I handed them the award," said Alice.Alice believes both vehicles had out-of-state license plates. She says she contacted the sheriff's department but was told this incident would likely be defined as panhandling, which isn't a crime. 2184

ESCONDIDO, Calif. (KGTV) — California Gov. Gavin Newsom says the state is activating the federal medical station at Palomar Medical Center in Escondido, while ICU bed capacity is strained in several regions.It wasn't immediately clear when the medical station could begin accepting patients."We are bringing a fifth alternative care site out of warm status, we're standing up that site, an FMS site, down in San Diego," Newsom said during an online press conference on Wednesday.RELATED: Hospital staffing concerns as COVID-19 hospitalizations increase in San Diego CountyPalomar Health preparing for increase in San Diego County COVID-19 hospitalizations as cases surge in CaliforniaDuring a Wednesday press conference, Chris Van Gorder, CEO of Scripps Health, said that San Diego County is not all that far from running short of ICU beds and staffing is a significant issue."The reality is, we're facing a significant situation here with our capacity and it's made worse because back in the summer, the spring and summer, it was a regional situation and not a national situation. So back then, we could get traveling nurses, we could get registry nurses, we could hire more nurses locally," Van Gorder said. "Today, this is a national situation and we cannot recruit travelers, we cannot recruit registry nurses, and unfortunately, a number of our healthcare providers are also getting sick."Van Gorder said the county has 24 staffed ICU beds left, out of about 670 available. He added that as hospitals get full and resources are strained, the type of care for anyone needing hospital care will change to crisis care.The top two floors of the Escondido hospital have been set up to serve as an FMS site. The site includes 202 beds that can be used for patients that don't require ICU care. The site could take in patients from other county hospitals that become overwhelmed, Dr. Omar Khawaja, the Chief Medical Officer for Palomar Health, told ABC 10News a few weeks ago."It could be beds that we would offload some of the less sick patients from other systems into there so they can handle the sicker patients; we don’t have a solid plan for it yet," he said.California's cumulative ICU bed capacity hit 1.1% on Wednesday, with the Southern California region at 0%. Three other regions were also under the state's regional stay-at-home orders activated after a region dips under 15% ICU capacity.San Diego County reported 348 coronavirus ICU cases on Wednesday and an additional 2,598 COVID-19 cases.Van Gorder said the county and hospitals project that hospitalizations will continue to grow and peak on Jan. 10, 2021, with about 1,827 patients, and ICU cases will peak on Jan. 11, with about 483 patients."Today, the governor announced the federal medical station at Palomar Medical Center is going to be activated. It's a developing situation. We'll share more information as we get it. But we're doing everything that we can to address the impact of the transmission of COVID, but each and every one of us now need to do everything we can to impact the situation our hospitals face," county Supervisor Nathan Fletcher said during Wednesday's press conference. 3175

ESCONDIDO, Calif. — The Golden State Killer arrest is shining the spotlight on a controversial DNA search known as Familial DNA.    In the summer of 2013, communities in southern California were gripped by fear amid a string of unspeakable crimes.An unknown culprit dubbed "The Creeper" entered five homes in Escondido and one in San Marcos, cutting screens, cutting the clothes of little girls and molesting them while they slept.The suspect left DNA at several scenes, but a search turned up no matches. Ultimately, the case went cold until detectives applied to the State Department of Justice for a DNA familial search.In 2015, the mystery DNA profile was linked to somebody already in the system, a close relative of the suspect."They were able to determine through a familial search who the suspect likely was," said Deputy District Attorney Ryan Saunders.That suspect was Gilbert Chavarria, who recently pleaded guilty to a host of charges. He was sentenced to 100 years to life in prison."Police did an excellent job gathering the evidence, but the leads were exhausted. Without the familial searches, we'd still be on our hands waiting," said Saunders.Amid concerns from privacy advocates, California Governor Jerry Brown in 2008 enacted a policy that familial DNA would be used only as a last resort.It's been rarely used. but did provide the break in several serial killer cases, including the Los Angeles-area Grim Sleeper case and in the Golden State Killer case. In the latter, the mystery DNA was linked to a familial profile from an ancestry website.Some law enforcement experts say the recent cases could lead to a lot more requests for the DNA search. Familial DNA also provided the break in the infamous BTK serial killer case in Kansas. 1854

  

ENCINITAS, Calif. -- No dancing allowed. Sounds a little like the movie, “Footloose” right? Well, it’s real — and it’s the law in the city of Encinitas, California.“We got in trouble for people dancing here,” said Brie Cardosa, owner of Mr. Peabody’s Bar and Grill. The restaurant was fined ,000 for allowing their patrons to dance while listening to live music.Cardonas' restaurant has been providing food and live music for more than a decade. She said they have never had any run-ins with the law until they recent fine from the Alcohol Beverage Control.“We didn’t realize we were doing anything wrong,” Cardosa said.The fine stemmed from a city law that makes it illegal to dance in Encinitas during evening hours.Encinitas Councilman Tony Kranz believes his predecessors created the law in 1986 to prevent several dance clubs from being built in the city, or to dissuade people from behaving lewdly at alcohol-serving establishments.“I think it’s just the result of cities trying to limit their liability," he said. "And make it an enjoyable experience for everybody that comes out."The crackdown took place after the city received an overwhelming number of complaints from a number of area bars. Many Peabody’s fans have taken a stand by signing an online petition to let them keep dancing.You can find the petition here. Cardosa said dancing to music is a natural reaction, and found it hard to force her patrons to remain still. “We just don’t want to get in trouble if we’re dancing, or if someone starts moving around,” Cardosa said. “We don’t want to tell them that they can’t dance. It’s such a difficult type thing to explain to someone.”Kranz agrees. “I’ve been there before. and I’ve seen some dancing. I might have even swayed to the music a couple of times there,” he said. “The (Alcohol Beverage Control) interprets their rules that if you sway to the music, you could be in violation of the rules. That is not what city council is interested in having happen.”Encinitas City staff have started work on a revision to the current, and outdated law. In the meantime, Cardosa is hoping the petition persuades the council to let them stay as is. Her other options are to turn in a “deemed approved ordinance” application to temporarily be approved or to submit the “entertainment establishment permit,” also known as the “cabaret permit.” This would allow Mr. Peabody’s to have “dancers“ inside their venue.But that doesn't really align either. “We don’t want to be a dance club. We don’t want to be a dance venue,” Cardosa said. “I hope to have the support of the city behind us, and just you know, move on.”Cardosa said she will continue to host live music at the restaurant several nights a week, without dancing. She is working with city staff to find the best way to legally run her business while making her patrons happy. 2912

  

FALLBROOK, Calif. (KGTV) -- A tortoise is recovering after falling 10 feet from a wall Sunday, cracking its shell.The tortoise was found by a good Samaritan after falling from a 10-foot wall while being chased by a dog, according to the County News Center.The 70-pound tortoise was taken to a veterinary hospital where animal services were called.Officials say that’s when they learned it would cost several thousand dollars to fix the 35 to 40-year-old tortoise.“We have a donor-driven Spirit fund that we can use for severe medical cases such as this one,” said County Animal Services Director Dan DeSousa. “This tortoise will get the extensive, aggressive care and long-term observation that he needs to regain his health and hopefully live to a great, old age.”The tortoise underwent surgery Tuesday, where veterinarians put screws into the shell then used ties on the screws to hold the broken pieces together.Veterinarians then used the same paste material that dentures are made from to seal the cracks.For more information or to donate to the Spirit fund, click here. 1098
