SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102

SAN DIEGO (KGTV) -- Families worried about paying back rent due to the pandemic are getting more time.Tuesday, the San Diego City Council voted 5-4 to extendthe rent repayment period for commercial and residential renters to December 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would haveextended the repayment period for the eviction moratorium to March 31, 2021.Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergencyeviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused "substantial loss of income," according to city staff.Renters are also required to follow the rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.During the meeting, the council heard from landlords and realtors who say renters are taking advantage of the situation."The blanket moratorium has given criminals a free pass at the full expense of landlords, this is not a one size fits all," said property manager Claudia Cooper.Other callers said it would be a disaster to evict families just as children are starting school from home."Folks will be evicted and this pandemic won't be over anytime soon as the presentation mentioned, a lot of children are going to be learning from home and to be evicted right as school starts is just going to exacerbate the effect this pandemic has had on our kids," said one caller.Many callers said evictions must be prevented to avoid adding to the homeless problem."Many people have been out of work and eviction could mean death," said another caller.The moratorium on evictions expires September 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through December 30."We are all in it together," Gomez said before discussion of themotion. "The economy is not fully restored. This is not an ideal policy, butit's a necessity for what we are dealing with."Gomez represents District 9, which encompasses Southcrest, CityHeights, Rolando and the College area. It has also been one of the mostimpacted areas during the pandemic.According to a member of Gomez' staff, which gave the presentationon the topic, the city had started 15,659 rental relief applications usingfederal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday,not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent."It's a cruel hoax," she said. Bry said that by not paying rent ontime, tenants could be destroying their credit and leaving themselves withmountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, manyurging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright.About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.Councilmembers Chris Cate and Scott Sherman were opposed to theextension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year. SAN DIEGO (KGTV) -- A family from Chula Vista is desperately looking for their 9-year-old loved one. Erik Ochoa was swept away by the current in Rosarito on Easter Sunday. Ochoa lives in Tijuana with his father. His sisters, Zusel and Hilary live in Chula Vista. The boy was with two other children walking along the beach in Rosarito when they were swept away. One boy made it out of the current and ran to get an adult nearby. The third child washed ashore, lifeless, 25-minutes after going missing. Erik hasn't been seen since. The sisters have been looking for their brother since they heard about what happened. They've been going from Imperial Beach all the way down to Border Field State Park.The Mexican Navy is actively searching on the Mexican side. The U.S. Coast Guard broadcast a message to boaters telling them to be on the lookout. Erik was last seen wearing green shorts and a striped shirt. The family tells 10News the Mexican Navy will search until Sunday.  1008

SAN DIEGO (KGTV) — A brush fire in the Japatul Valley area exploded in size in about an hour on Saturday, forcing nearby residents to evacuate.The Valley Fire ignited off Spirit Trail and Japatul Road, just southeast of Alpine, just before 2:50 p.m., according to Cleveland National Forest. The fire had scorched about 1,500 acres and was 0% contained as of 5:50 p.m.Fire officials said the dangerous rate of spread was pushing the fire southwest toward Lawson Valley. According to Cal Fire Cpt. Kendal Bortisser says the intense heat and rugged topography of the area are also posing a challenge for crews.
