NEW YORK (AP) — The U.S. Justice Department is asking to take over President Donald Trump’s defense in a defamation lawsuit from a writer who accused him of rape. Federal lawyers also asked a court Tuesday to allow a move that could put the American people on the hook for any money E. Jean Carroll might be awarded. The Justice Department lawyers argue that Trump was “acting within the scope of his office” when he denied Carroll’s allegations last year that he raped her in a New York luxury department store in the mid-1990s.She says his comments besmirched her character and harmed her career. The filing complicates, at least for the moment, Carroll’s efforts to get a DNA sample from the president as potential evidence and to have him answer questions under oath.It comes amid concerns that Attorney General William Barr has gone out of his way to intervene in other legal cases involving Trump or his allies. Barr tried to decrease the amount of prison time his office sought for Trump ally Roger Stone following a criminal trial where he was found guilty. (Stone’s sentence was later commuted by Trump.) Barr’s Justice Department has acted to dismiss its own case against former national security adviser Michael Flynn.Carroll’s lawyer, Roberta Kaplan, called the department’s argument “shocking.” 1314

NEW YORK (AP) — A tentative deal has been reached to settle multiple lawsuits brought against the television and film company co-founded by Harvey Weinstein, who has been accused of sexual misconduct by scores of women.Attorneys involved in the negotiations told a federal bankruptcy court judge during a hearing in Wilmington, Delaware, Thursday that a breakthrough in a still-unfinished mediation had put a settlement within reach. The amount of the deal wasn't revealed in court, but a person familiar with the negotiations told The Associated Press it was worth million. The person wasn't authorized to reveal details of the discussions and spoke on condition of anonymity."We now have an economic agreement in principal that is supported by the plaintiffs, the (New York attorney general's) office, the defendants and all of the insurers that, if approved, would provide significant compensation to victims, creditors and the estate and allow the parties to avoid years of costly, time consuming and uncertain litigation on all sides," Adam Harris, a lawyer for studio co-founder Bob Weinstein, told the judge. He cautioned that there was still "a lot of work here to do.""But," he added, "I personally am very optimistic."The size of the settlement was first reported by The Wall Street Journal.More than 15 lawsuits have been filed accusing Harvey Weinstein or the company of misconduct. The settlement would cover many of them, including a class action by alleged victims that accuses the film company of operating like an organized crime group to conceal widespread sexual harassment and assaults. It would also resolve a civil suit by the New York attorney general alleging that Harvey Weinstein's media company, in enabling his mistreatment of women, violated labor laws. The New York attorney general's office declined to comment on the amount of the settlement.Any settlement would need to be approved by the courts.Harvey Weinstein also faces criminal charges in New York of rape and performing a forcible sex act. His trial is scheduled to begin in September. The settlement wouldn't resolve his criminal case.Weinstein denies all allegations of nonconsensual sex.An attorney who represents unsecured creditors in the bankruptcy of the Weinstein film studio, Robert Feinstein, told U.S. Bankruptcy Court Judge Mary Walrath that mediation talks that had broken down a few months ago had recently been restarted.A global settlement of the class action lawsuit and all other legal action against the Weinstein Co. seemed to become possible only in the past few days, he said, though he cautioned that many details remained to be resolved."I think we are poised to get there. I can't assure the court that we will," he said.Harris said the settlement was complex due to the number of claims, and insurance companies, involved."We're dealing with potential claims here that go back . more than 25 years," he said, adding that the nature of the allegations had also made for "a highly charged environment, with very strong feelings on all sides."___Associated Press writer Randall Chase in Dover, Delaware, contributed to this report. 3151

NEW YORK CITY — From Times Square to Herald Square and along Fifth Avenue, stores across the city are boarding up window displays in preparation for possible chaos surrounding the presidential election. The sight of boarded-up windows has some New Yorkers feeling tense and anxious about the Democratic process.Incidents in the New York area over the weekend served as a preview of potential unrest on Election Day or the days following.Tensions flared between protesters and police in Chelsea on Sunday, resulting in 11 people arrested, the NYPD said. A Black Lives Matter group had gathered waiting for a caravan of President Donald Trump supporters that never showed.Meanwhile, hundreds of vehicles draped with flags and banners in support of Trump snarled traffic around the New York metropolitan area Sunday.According to The Associated Press, a large caravan of Trump supporters traveled through Rockland and Westchester counties and Queens, in some cases stopping traffic without further incident. In addition, videos posted online showed hundreds of vehicles at a standstill around noon in the northbound express lanes of the Garden State Parkway near Lakewood, New Jersey. Police say the incident caused a 5-mile backup.A separate caravan is being investigated by the FBI in San Antonio, Texas after swarming a Joe Biden campaign bus and allegedly trying to run staffers off the road ahead of a rally.Trump, in a Sunday tweet, called the supporters in that caravan "patriots" who "did nothing wrong."The Associated Press reports that more than two million people in New York state have already cast in-person ballots during the state's early voting period.Additionally, over a million New York voters have already returned absentee ballots, election officials said. This story was originally published by Anthony DiLorenzo on WPIX in New York City. 1861
