The Department of Education on Friday proposed new rules for dealing with sexual harassment and assault on college campuses that would bolster the rights of those accused of wrongdoing.The proposed rules, which now face a public comment period of 60 days before they are enshrined, seek to narrow the definition of sexual misconduct on campuses at a time of national reckoning about sexual abuse."Every survivor of sexual violence must be taken seriously, and every student accused of sexual misconduct must know that guilt is not predetermined," Education Secretary Betsy DeVos said in a statement. "We can, and must, condemn sexual violence and punish those who perpetrate it, while ensuring a fair grievance process. Those are not mutually exclusive ideas. They are the very essence of how Americans understand justice to function."The new rules would "adopt a clear definition of sexual harassment actionable under Title IX," which prohibits discrimination based on sex for schools and programs that receive federal funding, including protection from sexual harassment.One stipulation would narrow the definition of sexual harassment to mean "unwelcome conduct on the basis of sex that is so severe, pervasive and objectively offensive that it denies a person access to the school's education program or activity." The new policy would be a departure from the Obama administration's broader definition of sexual harassment as "unwelcome conduct of a sexual nature."The new rules also place an emphasis on "presumption of innocence" and would allow those accused the option of cross-examining their accusers.The department's announcement on Friday was certain to be met with outrage from victim advocacy groups. Sexual abuse has been the subject of tremendous attention in the #MeToo era, and allegations of abuse have led to high-profile resignations in entertainment, media and political circles, and were a central factor in last month's confirmation of Supreme Court Justice Brett Kavanaugh.Last year, DeVos announced the department was rescinding Obama-era guidance that pressed colleges to take accusations of sexual misconduct more seriously and provided guidelines for investigations and hearings. DeVos argued the older guidance denied proper due process to individuals who had been accused."The truth is that the system established by the prior administration has failed too many students. The family of a Rochester, New York man killed during an encounter with police earlier this year, says officers' use of force led to his death as he suffered a mental health crisis.Following the release of the arrest video by Prude's family on Wednesday, protesters called for the city council to pass legislation that would forbid police officers from responding to mental health crises.On March 23, police encountered Daniel Prude in a Rochester street, naked, bleeding and unarmed. According to ABC News, he had been brought to the hospital earlier that evening after experiencing suicidal thoughts and had been subsequently released.Prude initially complied, and officers placed him in handcuffs.With the coronavirus pandemic in its infancy, officers then chose to place a spit hood over Prude's head. The hood appears to agitate Prude, and he asked officers to remove it.Moments later, Prude attempted to stand up, and officers wrestled him back to the ground.Video shows officers pressing Prude's face into the pavement for two minutes.It was then that police realized that Prude had stopped responding. Officers administered CPR, and he was rushed to the hospital.On March 30, Prude died when he was taken off life support."I tell this particular officer that comes to my door (prior to the incident), don't you kill my damn brother," Prude's brother Joe said on Wednesday. "Not even 15 minutes later, he comes back and tells me my brother is dead. You put a bag over his head — what did you put a bag over his head for?"An autopsy from the Monroe County Medical Examiner found that Prude died from complications of asphyxia from physical restraint. He also may have had PCP in his system.The Rochester Police Chief said he ordered criminal and internal investigations following the incident. The case was sent to the New York Attorney General's office, as required by state law when investigating in-custody deaths.None of the officers involved in the incident have been suspended. Protesters in Rochester Wednesday night called for the removal of the officers from the department."A naked and defenseless man lynched and we need to think about that in this moment," activist Stanley Martin said. The Cincinnati-area airport took a child’s beloved stuffed animal for an impromptu tour, reaching many on social media, before uniting the toy Dalmatian with its family in Florida. Staff at the Cincinnati/Northern Kentucky International Airport were sending the toy back to Florida on Friday. Spokesperson Mindy Kershner says the airport’s Facebook posts about the missing plaything reached 1 million people. Airport employees found the toy left behind in the terminal and snapped photos of the lost traveler outfitted in a mask at the airport’s restaurants, on the runway and with a K9 team. 600

The Columbus Dispatch reported it obtained a copy of a police incident report where Courtney Smith, the ex-wife of now fired Ohio State football assistant coach Zach Smith, claimed that Ohio State lawyers told her not to press charges.The police report was obtained from an anonymous source and not directly from the Powell, Ohio Police Department. The Dispatch said that Powell Police Chief Gary Vest did not dispute the authenticity of the report. The report, which was dated Oct. 26, 2015, Officer Ben Boruchowitz of the Powell Police wrote, "The victim states that last year, the suspect choked her until she could not breathe. The victim states that the suspect tells her all the time that he will kill her.”In the report, according to the Dispatch, Courtney Smith told Boruchowitz that OSU lawyers were "convincing her to drop the charge because it would embarrass OSU if she proceeded with the prosecution.”After the Dispatch's report came out, Courtney Smith told ESPN that she had not seen a copy of the incident report, but that the claim that OSU lawyers told her to drop the charges was not accurate. OSU officials told the Dispatch it was unaware of the allegation and would investigate. Ohio State head football coach Urban Meyer, who was aware of the 2015 incident, did not fire Zach Smith until last month when he was made aware that Courtney Smith had filed a protection order against Zach Smith. Meyer claimed that because charges were not filed against Zach Smith, he was not obligated to notify Ohio State.After a three-week investigation, Meyer was suspended for three games for mishandling Zach Smith's employment with Ohio State.
