LOS ANGELES (CNS) - Uber and Lyft will keep operating in San Diego and across California -- for now -- with a state appeals court Thursday putting on hold a ruling requiring the ride-hailing companies to classify their drivers as employees instead of independent contractors.The decision by the state's 1st District Court of Appeal averted threats by Uber and Lyft to shut down all California operations at midnight. Uber officials said earlier this week they would likely shut down, and Lyft issued a statement earlier Thursday saying its operations would be halting at midnight.In a blog post on Thursday morning, Lyft stated: “At 11:59PM PT today our rideshare operations in California will be suspended. This is not something we wanted to do, as we know millions of Californians depend on Lyft for daily, essential trips.”Lyft added: “This change would also necessitate an overhaul of the entire business model -- it’s not a switch that can be flipped overnight.”The dispute traces its roots to the state's passage of Assembly Bill 5, which effectively required the companies to classify their drivers as employees, a move supporters said would guarantee their wages and assure them of other benefits and workplace protections.The companies, however, said the move would require a complete overhaul of their operations and would actually hurt drivers -- forcing them to work set schedules instead of giving them the flexibility to work only when they wanted. The companies also said the move would result in many drivers losing their jobs unless they could work standard hours, and would likely also harm overall service for riders.California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco argued in court that Uber and Lyft have misclassified their drivers as independent contractors, preventing them from receiving "the compensation and benefits they have earned through the dignity of their labor" such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.On Aug. 10, San Francisco-based Judge Ethan P. Schulman ruled against the companies, but he stayed his decision for 10 days to give them time to appeal. They did so, resulting in Thursday's last-minute ruling putting Schulman's ruling on hold.The court, however, warned the companies to continue preparing for the possible switch to employee drivers, saying each company must submit a sworn statement by Sept. 4 "confirming that it has developed implementation plans." The companies must also affirm they are prepared to actually implement those plans and switch to the employee system within 30 days if they ultimately lose their appeal and a company-sponsored measure on the November ballot fails.That ballot measure, Proposition 22, would allow ride-hailing drivers to work as independent contractors.The court scheduled oral arguments in the appeal for Oct. 13.Lyft contends that four out of five drivers prefer working as independent contractors so they can have more flexibility. 3056

LOS ANGELES (AP) — Members of the Trump administration visited Los Angeles Tuesday to get a firsthand look at the city's sprawling homeless encampments and efforts to control them, while President Donald Trump directed his staff to develop policy options to address the national crisis of people living on the streets.The visit by a delegation from several federal agencies came about two months after the Republican president called the homelessness crisis in Los Angeles, San Francisco and other big cities disgraceful and faulted the "liberal establishment" for the problem.In July, Democratic Mayor Eric Garcetti issued a public invitation for the Republican president to walk the streets with him and see the suffering and squalid conditions. The mayor released a letter to Trump on Tuesday saying he looked forward to working together, but tensions between the White House and officials in heavily Democratic California were also on vivid display.Gov. Gavin Newsom has sparred with the White House routinely, and his office released a statement Tuesday saying the state was ready to discuss serious proposals but Trump "could start by ending his plans to cut food stamps, gut health care for low-income people and scare immigrant families from accessing government services."San Francisco Mayor London Breed said in a statement that the city would welcome assistance from the federal government to build more housing "but simply cracking down on homelessness without providing the housing that people need is not a real solution."Garcetti, too, said he was ready to talk but wrote that "the federal government has woefully underfunded our housing safety net, contributing to homelessness" and slashed funding for new housing."We must put politics aside," he wrote.And at an event Monday in Beverly Hills, sponsored by the website Politico, Garcetti's chief of state and federal affairs, Breelyn Pete, said the city looked forward to explaining its homeless strategy to administration officials but added, "They're just not thoughtful, and quite frankly not smart enough, to know what we're doing."Trump would make an unlikely pairing with the Los Angeles mayor, who comes from a heavily Democratic state recognized as the center of the so-called Trump resistance. Filthy, drug-infested encampments line downtown streets, and homeless people often sprawl on the lawn of City Hall, with tents nearby. The mayor says 36,000 people in the city are homeless on any given night.Figures released in June showed a 16% jump in Los Angeles' homeless population over the last year. The jump came after the mayor helped convince voters in 2016 to borrow .2 billion to construct housing for the homeless.The mayor's office said the federal group visited several homelessness projects, including a recently opened shelter.On Tuesday, Sacramento County and the city of Sacramento joined the fight to overturn a federal court ruling barring municipalities from prosecuting homeless people for sleeping on the streets if there are no available shelter beds, The Sacramento Bee reported .The Trump administration provided no specifics on what its national homeless policy would entail.Taylor Griffin, a spokeswoman for House Speaker Nancy Pelosi, said, "Homelessness is a challenge to the conscience of our nation and a growing humanitarian crisis for communities across our country. LOS ANGELES (CNS) - A storm system swollen with moisture from an atmospheric river will bring rain to Southern California Tuesday afternoon through Wednesday, prompting the National Weather Service to issue a flash flood watch for all burn areas in Los Angeles, Ventura and Santa Barbara counties. Across Ventura and Los Angeles counties, the heaviest rainfall is expected late Tuesday and Wednesday morning, affecting the Thomas, Hill, Woolsey, Stone, South, Creek and La Tuna burn scars, according to the NWS. Peak rainfall rates are expected to range between a half-inch and 0.80 inches per hour. There is the potential for isolated thunderstorms, which could produce higher hourly rates, forecasters said. The flash flood watch will be in effect from 6 p.m. Tuesday until 11 a.m. Wednesday. RELATED: Check the 10News Pinpoint Doppler Live radar``Shallow mud and debris flows will be likely, especially in the first-year burn areas, with the potential for more significant and damaging debris flows. In addition, roadway flooding is likely, especially in low-lying areas, along with rock and mudslides on canyon roads and below steep terrain,'' according to the NWS. Los Angeles County officials warned residents in the Woolsey Fire burn area -- where even small amounts of rain may cause significant mud and debris flows -- to prepare for the possibility of evacuations, road closures and power outages. Residents were urged to identify two exit routes, make plans for pets and family members with special needs and pack an emergency kit with extra medication, important documents and warm clothing. Additional sheriff's deputies, firefighters and public works personnel will be on patrol in the area through Thursday morning, according to the county. The rain will turn to showers by Wednesday evening, then showery conditions will persist through Friday, according to the NWS. Dry weather is expected Saturday, and showers are possible Sunday through Monday. Rainfall totals across eastern Ventura and L.A. counties should be generally 0.75 to 1.5 inches in coastal and valley areas, and 1.5 to 3 inches in the foothills and mountains. Through Friday, rainfall for Orange County is expected to range from one-half to three-quarters of an inch near the coast to 1.5 to 2.5 inches in the mountains, with local amounts to around 3.5 inches. RELATED: California drought conditions nearly eliminated thanks to recent stormsIn the San Gabriel Mountains, a wind advisory denoting an expectation of 35-mph winds will be in force from 8 p.m. Tuesday to noon Wednesday amid south winds of 20-30 mph gusting at as much as 60 mph. ``Gusty winds will make driving difficult, especially for drivers of high-profile vehicles,'' warned the NWS. ``When driving, use extra caution. Be prepared for sudden gusty cross-winds.'' Snow levels will be high through Wednesday -- generally above 7,500 feet, then drop.
