SAN DIEGO (KGTV) - Raw emotion filled a San Diego courtroom Tuesday as the friends and family members of those killed and injured in a crash faced the drunk driver responsible at her sentencing. Thirteen people flew in from San Francisco to speak during victim impact statements. The most powerful words came from Giao Pham's life partner, John Lawhead. Pham was killed in the March 23rd crash."We were together for eleven years, until your actions that night took my partner, my world, my everything. You still don't have any remorse in your heart, you're a very shallow, person aren't you!?" At one point, the defendant, Alondra Marquez, interrupted, saying "You don't know me," Lawhead shouted back, " I don't care to know you, the only reason I know you is because you murdered my partner!" Marquez, 22, rear-ended a Lyft car on Highway 163 in Balboa Park, killing Pham and leaving his friend, Andy Lynn with a traumatic brain injury. Prosecutors said Marquez had a blood alcohol level more than three times the legal limit and was driving more than 100 miles an hour. In a bizarre coincidence, Marquez and the two victims were at the same Hillcrest bar the night of the crash. While Pham and Lynn chose to hire a Lyft, Marquez chose to drive, even though several people offered to give her a ride. "You had five chances not to drive your car, you chose to drive, at your fastest speed of 109 miles an hour, but that wasn't fast enough or good enough for you," shouted Lawhead Pham and Lynn were visiting from San Francisco for a wedding. The impact sent the car flying into a ravine. The Lyft driver suffered minor injuries. " The last place that I seen him go in the ground is where I find comfort, this is what I see when I go to see him now, do you understand your actions now?!" Marquez showed no emotion and read from a prepared statement. She said she doesn't remember anything about the night. "Physically, it's my fault, but spiritually and emotionally, I don't know where I was, but I wasn't there," she said from behind the glass. Lawhead told her she is the first person he truly hates. " I never thought I could truly hate someone. I hate your heart. I hate your soul. I hate your being, your spirit, I hate all of you." Marquez said she isn't a bad person. " Just know that I am not a bad or evil girl, my brain is processing this. It's a hard pill to swallow." Marquez asked for forgiveness. "I'm real sorry. I can't do nothing about it, but I'm locked up if that makes you guys feel better."She pleaded guilty and faces a maximum sentence of 13 years, four months in prison when the judge announces her sentence next week. 2794

SAN DIEGO (KGTV) – San Diego City Councilmember Jennifer Campbell on Tuesday is expected to formally announce enforcement plans to help with concerns over crowd control in Ocean Beach.Campbell, who represents District 2, said in a news release, “Our office continues to field calls regarding increased crowds gathering at Veteran’s Plaza in Ocean Beach on Wednesday evenings. While I appreciate the San Diego Police Department’s increased presence last week, it’s clear more comprehensive action needs to be taken to keep San Diegans safe.”Residents in the area say large gatherings have been consistently happening despite San Diego County public health orders restricting mass gatherings.According to OB residents, big crowds assemble Wednesday nights at Veteran’s Plaza, and many attendees are seen not wearing masks or practicing social distancing.Ocean Beach Town Council President Mark Winkie told ABC 10News in a previous interview that residents “want people to understand this is our community. You’re welcome to be here, but you need to adhere to social distancing rules and respect our community.”Winkie has met with City of San Diego officials about the gatherings in OB. He said the city was looking to shut down Veteran’s Plaza to help with enforcement.On Tuesday morning, ABC 10News spotted city crews placing plastic netting at the park.While he said the town council is not happy the park is closing, Winkie said a closure would allow needed renovations at the park to be done.The OB Town Council has also been pushing for more education to remind people about following the rules.Winkie said he’s been told health officials will be at Veterans Plaza on Wednesday nights to spread the word about county health guidelines. 1746

SAN DIEGO (KGTV) — San Diego County reported 634 new coronavirus cases on Friday, the highest number of new cases reported over one day thus far.The new cases were out of 9,224 tests reported to the county on Friday — a 7% positive result — and bring the region's COVID-19 case total to 22,489 cases.County health leaders also reported seven more deaths due to the virus on Friday. The victims died between July 7 and July 15 and include three women and four men, whose ages ranged from early 50s to mid-90s. All had existing chronic conditions. The county's death toll is now at 472 deaths.Two new community setting outbreaks were also reported, both traced to restaurants, the county says. The county does not name the businesses that community outbreaks are traced to, officials have previously said. In the past week, there have been 13 community outbreaks — nearly double the county's trigger of seven outbreaks in seven days.RELATED: Gov. Officials say the county's target rate is under 8%.But the county says it's still falling short on its case rate (154.3) and case investigation (24%) triggers. San Diego's case rate trigger is greater than 100 cases per 100,000 people over 14 days, while the trigger for investigations is 70% or less within 24 hours of notification over seven days.The county is also still well above the state's case rate threshold of no more than 100 cases per 100,000 people, or more than 25 cases per 100,000 people and higher than 8% positivity.The new numbers come as California announces that counties that are on the state's watch list for 14 consecutive days will not be allowed to reopen for in-person school in the fall. SAN DIEGO (KGTV) -- San Diego Police Monday identified a shooting victim found in Sherman Heights following a crash.According to police, 25-year-old Jose Alberto Ortiz died after officers found him with gunshot wounds on October 22 near 27th Street and K Street.Police responded to the area after receiving reports of a crash. After responding, police say they found a dark sedan that collided with a parked vehicle.“Upon contacting the driver, they saw that he had sustained trauma that was not consistent with a traffic collision and suspected the male had been shot,” police said.The man was taken to the hospital where he later died.
