SAN DIEGO (KGTV) -- Two local strip clubs ordered to close down amid a surge of COVID-19 cases and deaths across California are allowed to remain open, a judge ruled Wednesday. The court order also appears to offer protection to restaurants prompting the county to suspend enforcement of the state's COVID-19 public safety policy on barring indoor-outdoor dining.In the nine-page ruling, San Diego County Superior Court Judge Joel R. Wohlfeil issued a preliminary injunction prohibiting the cease-and-desist order from being enforced on strip clubs and "San Diego County businesses with restaurant service" from operating.The order, effective immediately, still requires businesses to adhere to COVID safety protocols.Eateries had been ordered to close indoor operations in November when the county fell into the state's purple tier restrictions, then were restricted to takeout and delivery service only earlier this month. Until then, the county will cease pursuing the shutdown of restaurants and strip clubs."Until we have clarity, we have suspended enforcement activities against restaurants and live entertainment establishments," Workman wrote in a statement. "With record numbers of new infections, deaths, and ICUs at capacity, we want to remind everyone to do your part. Please don’t gather, socially distance, wear a face covering, and wash your hands."Wohlfeil cited the lack of evidence from the County that proves the two live adult entertainment venues would increase the risk of exposure to patrons or that the establishments have impacted ICU bed capacity throughout Southern California, “much less in San Diego County.”“Accordingly, the Court finds that Plaintiffs have been devoid of COVID, have done nothing to contribute to the spread of COVID, and have honored their representations to Dr. Joel Day and the County,” said Wohlfeil, according to court records.Wohlfeil also said that the harm of denying the injunction would be greater to the strip clubs more than the harm to the County.Wednesday’s ruling is effective pending the trial in the case brought by Midway Ventures and F-12, the owners of Pacers Showgirls and Cheetahs Gentleman's Club against the County of San Diego and state in October over COVID-19 restrictions that forced them to close. Such indoor operations violate the terms of the Regional Stay at Home Order, which permits restaurants, such as those run by MIDWAY AND F-12, to operate for take-out and delivery services only," the letter said.Last week, Supervisor Nathan Fletcher said that the majority of the board doesn't view strip clubs as essential and "felt that was consistent with common sense.""I’m guessing most folks aren’t going there with all the members of their household, so you have multiple households interacting together in a high-risk setting and so we ordered them closed," Fletcher said. 4068

SAN DIEGO (KGTV) - U.S. Coast Guard rescued 13 Mexican nationals from the waters off the coast of La Jolla Saturday.The rescue, located near the Children's Pool, was reported just before 8 a.m., according to the Coast Guard. The 13 individuals, one woman and 12 men, were rescued from a panga boat and brought to shore.Border Patrol officials took the individuals into custody and officials believe they were trying to enter the country illegally.RELATED: One person hurt, possible drug packages found after boat washes ashore in CarlsbadPanga boat attempts to illegally have seen a sharp increased since 2010, according to Border Patrol, as land borders have tightened.Just last month, one person was found injured around several packages of marijuana washed ashore in Carlsbad. SAN DIEGO (KGTV) — Two teenage boys from Arizona were hailed as heroes after diving off Sunset Cliffs to save the lives of two people who were drowning on Friday evening. It was a happy ending scene, captured by local photographer, Jim Grant on Friday evening as lifeguards hoisted up a young girl off Sunset Cliffs."It just could have been a tragic event," Grant said on Saturday.He says the photo he took would have been a somber one if two teenage boys did not dive in to save the girls before lifeguards got there. Meet 15-year-old Jake Watson and 16-year-old Zachary Haugen."We've been best friends since third grade," Haugen said.The two boys from Arizona were vacationing in San Diego for the July 4th weekend."We said, 'Alright, let's go explore around,' and we heard about this place called Sunset Cliffs," Watson said.They say they were soaking in the beautiful sunset Friday evening. But when the boys looked down, they saw two ladies in trouble. A six-grade girl and a family friend were splashing around near the reef. Haugen, a licensed lifeguard for the City of Phoenix, knew exactly what was going on."I'm like, 'Oh my gosh, they're drowning.' So that's when I just knew I had to go in." Haugen recalled.They say the girl was climbing on top of the young woman's head, just to breathe. Haugen first pulled the girl off the woman, but the high surf put his own life at risk."I looked up at Jake," Haugen said. "He's like, 'Do you need help?' And I'm just shaking my head, and that's when he was able to jump in and go after them."At that point, Watson, an avid fisherman and swimmer, dove in to lift the girl."I put her on my back and pressed up, and just kind of rolled her off my shoulder, onto the landing," Watson said.They then pulled the injured young woman up. All this happened in under five minutes before San Diego Lifeguards took over."We were like, 'What just happened?' It just felt surreal," Watson said.Surreal that their summer vacation turned into a life-saving episode, these modest boys will never forget."We just happen to be at the right place at the right time at Sunset Cliffs," Haugen said. 2240

SAN DIEGO (KGTV) - Someone sliced through the window of an Ocean Beach resident's vehicle but thankfully couldn't get it to start.Now he's worried about who they might hit next. "So we look out for each other so the idea that someone would come overnight steps from where I sleep, steps from where my kids sleep, you know and try to steal your car, it's angering," David Levine said.An anger that probably won't go away until Levine gets the window on his jeep fixed. "I put tape over it already but there are two big slices here and then a slice here," Levine said.Someone sliced into his 1999 Jeep Wrangler, but Levine knows it could've been much worse."There's bent metal. It looks like they tried to take a screwdriver to turn it over," Levine said. "So I got lucky." Levine is lucky because he still has his Jeep. His neighbor doesn't.  904
