SAN DIEGO (CNS) - A former San Diego High School teacher who sexually and physically assaulted an underage female student pleaded guilty to 11 felonies Tuesday, including lewd acts on a child and assault.Juan Carlos Herrera, 49, formerly a special needs curriculum instructor, is slated to be sentenced to 10 years in state prison next month for assaulting the unidentified victim "on almost a daily basis" between February 2018 and March of this year, when the girl was 15 and 16 years old, according to Deputy District Attorney Jessica Coto.His plea agreement includes lifetime registration as a sex offender and a strike offense for his plea to a dissuading a witness count for threatening the girl if she told anyone about what happened.RELATED: SDHS teacher accused of having sex with student represents himself in courtIn addition to the sexual assaults, Herrera threatened to cut the girl's arms and legs off if she told anyone what was going on, choked her and threw her on the ground, according to the prosecutor.The crimes occurred in his classroom, his car and at a hotel, prosecutors said.The prosecutor said the girl was a San Diego High School student, but is not a special needs student and was not one of Herrera's students."This case involves emotional manipulation by the defendant, who was verbally abusive and coercive towards the victim in this case, who was particularly vulnerable, as (Herrera) took advantage of information he knew about her background and used it to manipulate her," Coto said following his May arraignment.The investigation into Herrera began earlier this year, when the victim's mother reported finding suspicious and concerning text messages from Herrera on the girl's cellphone, SDPD Lt. SALT LAKE CITY, Utah -- A Salt Lake City K-9 officer has been charged with aggravated assault in connection with an April 24 incident.Officer Nickolas John Pearce, 39, responded to a report of domestic violence that day. Pearce is accused of commanding his K-9, Tuco, to bite Jeffery Ryans, even though Ryans was on his knees and had his hands in the air."When K-9 Tuco engaged and was biting Ryans, [Pearce] continually praised and encouraged K-9 Tuco," a probable cause statement said. "While he was being attacked by K-9 Tuco, Ryans expressed extreme emotions reflective of pain from being bitten by K-9 Tuco and plead with the officers to stop the biting. He questioned why he was being attacked when he was not resisting."Ryans suffered large lacerations and required hospitalization for his injuries. After receiving treatment for his injuries, Ryans was booked into the Salt Lake County Metro Jail on a charge of violating a protective order.In an interview with KSTU on Wednesday, Salt Lake County District Attorney Sim Gill said they looked to see if the force used was reasonable."And in this case, the conclusion of our attorneys when we reviewed the body cam video, we looked at the reports that were generated, and we could find no lawful reason to use that police dog in the fashion that it did and resulting in the injury caused on Mr. Ryans," Gill said.(Warning: the following body camera video contains graphic language and violence) 1458

SAN DIEGO (CNS) - A 47-year-old man accused of intentionally driving a pickup truck off Sunset Cliffs and into the ocean with his twin toddler daughters inside pleaded not guilty today to attempted murder, kidnapping and other charges.Robert Brians, who is also charged in the 13-count criminal complaint with child abuse, making criminal threats, child abduction and burglary, is being held without bail and is due back in court July 22 for a readiness conference.He allegedly drove into the water on the morning of June 13 with his 2- year-old daughters inside the truck. The girls were hospitalized in stable condition, according to a GoFundMe page created to raise money for their medical bills.About 4:30 a.m. that day, the toddlers' mother called 911 to report that Brians had taken their children without permission and allegedly contacted her via ``numerous calls and texts ... clearly stating she may not see (them) again,'' according to the GoFundMe.com page.He allegedly threatened to drive the vehicle off the Coronado Bay Bridge, but was later spotted by officers on Hill Street near Cornish Drive and sped off, careening over the side of a cliff and landing upside down in the water, according to police.Moments later, a canine officer also responding to the emergency, 22- year SDPD veteran Jonathan Wiese, arrived in the area. Reaching the scene of the crash and seeing Brians' pickup upside down in the water, Wiese grabbed a long leash he uses for his service dog, wrapped it around his chest, gave the other end to fellow officers and rappelled down the precipice.Wiese then swam out to the foundering truck and rescued the children and Brians. Medics took all three to hospitals for treatment of injuries that were not considered life-threatening. 1775

  

SAN DIEGO (CNS) - A 22-year-old man was fatally stabbed during a fight in the College Area, police said Thursday.The stabbing was reported shortly before 7:35 p.m. Wednesday at a home near 71st Street and Mohawk Street, about two blocks north of El Cajon Boulevard, San Diego police Lt. Matt Dobbs said.Officers responded and found a man suffering from at least one stab wound to his upper torso, Dobbs said. The victim, whose name was withheld pending family notification, was taken to a hospital, where he was pronounced dead at 8:56 p.m. Wednesday.Investigators determined the victim was hosting a gathering at the residence when some a disagreement began, prompting the him to ask people to leave, the lieutenant said. About 30 minutes later, some of the attendees returned and a fight broke out, during which the victim was stabbed.The suspects drove off in two vehicles, one described as a silver sedan and the other as a tan- or gold-colored sedan, Dobbs said.No detailed descriptions of the suspects were immediately available. 1043

  

SAN DIEGO (CNS and KGTV) - San Diego's City Council voted 6-3 Tuesday night to place restrictions on sleeping and living in vehicles on city streets and parking lots.The vehicle habitation ordinance goes into effect immediately and restricts people from living in their vehicles anywhere within 500 feet of a school or residence. It also places an overnight ban between from 9 p.m. to 6 a.m. anywhere in the city, with the exception of approved lots. According to a news release from the city, the ordinance aims to address illegal dumping, public urination and drug use on city streets and in parking lots. “We are creating a balance that provides opportunities to those in need while protecting our neighborhoods from behavior that creates unsanitary conditions and hurts quality of life,” Mayor Faulconer said. “If you want to work toward finding a permanent home, we have programs that can help. We will not allow the proliferation of ‘van life’ culture that takes advantage of San Diego’s generosity and destroys community character.”The ordinance will be enforced using criteria including sleeping, bathing, meal preparation, grooming items and containers of human waste. Councilmember Monica Montgomery, who voted against the ordinance, released a statement after the vote expressing disappointment. 1315
