LEBANON, Indiana — A 4-year-old girl was hospitalized in critical condition after she was accidentally shot Thursday by her younger brother, police say.According to the Lebanon Police Department, the shooting happened at the children’s grandparent’s house in the 300 block of N. Park Street shortly after 10 a.m.The 4-year-old was shot in the head by her younger brother, believed to be 2 years old, police say.The 4-year-old was taken to Riley Hospital in critical condition, police say. Investigators from the Lebanon Police Department and representatives from the Department of Family and Child Services are investigating the incident. 646

LA MESA, Calif. (KGTV) — Hundreds of protesters gathered at La Mesa City Hall on Saturday to demand justice for women of color, as police issued an order banning certain items in areas around the La Mesa Civic Center.The "We Demand Justice For Our Women Of Color" event called for justice for Breonna Taylor, killed by Louisville police officers in March, and Vanessa Guillen, a soldier at Fort Hood, in Texas, who was killed by another soldier in April, according to a flyer for the event.About 300 demonstrators gathered for the event, according to La Mesa Police. Police said many were gathered in a parking lot at Date Ave. and Allison Ave. near City Hall, before marching southbound from the location. A large group also gathered at the VFW lot at 8118 University Ave. and several groups were reportedly in the area on foot and in vehicles, police added.An ABC 10News photographer captured video showing a separate group of demonstrators with American and "Trump 2020" flags gathering as well. Police said many members of the group identified themselves as part of the “Defend East County” group.Police said that there were several physical altercations between the two groups as one group marched past the VFW. At least one arrest was made: Ryan McAdams, 35, of Jamul, was arrested on charges of battery and possession of pepper spray, as well as a probation violation, according to LMPD.City Councilwoman Dr. Akilah Weber told ABC 10News that she witnessed one scuffle, but saw protesters stop it before it became worse."Some of the members from the protest group jumped in between that one protester and the group of counter-protesters that were going back and forth and reminded the protester that's not what they were there for," Weber said. "They were not there to cause any harm to any residents to any businesses. Not really to disrupt anything but to just get the message out."There was also a minor altercation at the corner of Baltimore Dr. and University Ave., but it was broken up without further incident.LMPD says Chief Walt Vasquez met with organizers for both groups and notified them that officers are there to facilitate a safe event and asked for their cooperation to do so. A heavy law enforcement presence kept both groups separated throughout the day."I would like to thank the organizers of all of the groups in attendance tonight for their efforts to ensure a successful event for all involved. I wholeheartedly support the citizens’ right to peacefully exercise their first amendment rights, and the men and women of the La Mesa Police Department are here to support that. I would also like to thank the numerous law enforcement partners from around the county, as well as Heartland Fire, for assisting us tonight," Vasquez said in a release after the protest.At 10:30 p.m., police said that most of the demonstrators had left the area. No major injuries were reported.Ahead of the event, LMPD issued a Temporary Area Restriction (TAR) prohibiting certain items near the La Mesa Civic Center area. The items were banned from the area surrounded by University Ave., Spring St., and Allison Ave. The city said anyone violating this order would be prosecuted.The police department said that it had, "made numerous attempts to communicate with organizers of the protest and march so we can work together to ensure a safe environment where their voices can be heard. Unfortunately, all attempts to contact the organizers have been unsuccessful."The order comes more than a month after the city experienced rioting in areas of La Mesa after a peaceful protest outside the city's police department turned violent. 3645

  

LA MESA, Calif. (KGTV) — The La Mesa community has continued to show its strength and resilience. But as we head into the weekend, the city's 7 p.m. curfew continues and some fear there could be more violent riots.Colorful murals now cover La Mesa businesses, destroyed by rioters and looters last weekend. For Kenny Siler, Friday is a big win. "It means the world to be able to come in here," Siler said.He drove his legally blind friends to the Vons grocery store on the first day it reopened. "If there's a good sale, [I get] a whole bunch of Gatorade, and if there's a good chunk of meat I can smoke," he laughed. He's one of the hundreds of La Mesans supporting local businesses as soon as they can. Some shop, some clean, some donate.Next to Vons, California Coast Credit Union still has not reopened. "Both ATM's and inside, everything has been just butchered," the credit union's Sr. VP of Communications, Rene McKee said.They were victims of the riots, but they are also stepping up to help. Friday, the credit union donated ,000 to the La Mesa Business Disaster Recovery Fund. The online Gofundme account continues to grow every hour, far past the original goal of ,000."It's helping to bolster the spirits of the residents here in La Mesa and these small businesses," McKee said. While glimmers of hope begin to flicker, La Mesans still face the reality that what happened last weekend, could happen again. One hundred national guard troops continue to provide added security and prevent property damage, with 100 more on standby in case the situation worsens. For Siler, who is a proud military veteran, he hopes this weekend will bring peace and order. "I support my constitution," Siler said. "Protest. But don't do what you've done," he pointed at the boarded-up walls.The money donated to the La Mesa Business Disaster Recovery Fund will be collected on June 25, 2020. Any La Mesa businesses affected by the riots can contact the East County Chamber of Commerce to apply for support funds. 2019

  

Lawyers for CNN and the Trump administration are awaiting an initial ruling on the network's federal lawsuit over press access to the White House.And they're going to have to wait a little while longer.Judge Timothy J. Kelly heard nearly two hours of oral arguments about CNN's request for a temporary restraining order and preliminary injunction on Wednesday. Then he said court would reconvene Thursday at 3 p.m.But on Thursday afternoon, he rescheduled the next hearing for Friday at 10 a.m.If Kelly grants CNN's requests on Friday, CNN chief White House correspondent Jim Acosta would get his press pass back for a short period of time. If it's denied, Acosta's pass will remain suspended.Either way, this is just round one. By filing for a temporary restraining order, CNN is seeking what's known as "emergency relief." CNN is arguing that Acosta's First Amendment rights are being violated every day he is banned from White House grounds.CNN is also asking for "permanent relief," meaning a declaration from the judge that Trump's revocation of Acosta's press pass was unconstitutional. This legal conclusion could protect other reporters from retaliation by the administration.But the judge will not be ruling on that yet. Kelly is only expected to weigh in on the temporary status of Acosta's press pass.Further hearings are likely to take place in the next few weeks, according to CNN's lawyers.The lawsuit alleges violations of the First and Fifth Amendments.Kelly, a Trump appointee, has been on the federal bench just more than a year now. He was very inquisitive at Wednesday's hearing, asking tough questions of both sides, drilling particularly deep into some of CNN's arguments.A Justice Department lawyer, James Burnham, argued that the Trump White House has the legal right to kick out any reporter at any time for any reason.Burnham, who's been tasked with defending President Trump and several White House aides from CNN and Jim Acosta's lawsuit, was responding to a hypothetical from Kelly. Burnham said that it would be perfectly legal for the White House to revoke a journalist's press pass if it didn't agree with their reporting. "As a matter of law... yes," he said.Burnham's comment in court made the stakes of CNN v. Trump crystal clear.Attorney Theodore Boutrous, representing CNN in court, called Trump's move to revoke Acosta's hard pass "the definition of arbitrariness and capriciousness.""What are the standards?" Boutrous asked. "Rudeness is not a standard. If it were, no one could have gone to the press conference."Boutrous also commented that Trump is "the most aggressive, dare I say rude, person in the room" at press conferences.Burnham said CNN had made an "odd First Amendment injury" claim and suggested that Acosta could do his job "just as effectively" watching the president's appearances piped into a studio on CNN. In response, Boutrous said the DOJ had a "fundamental misconception of journalism." 2971
