(KGTV) - After a woman died in a jet ski crash in the Agua Hedionda Lagoon in Carlsbad on Sunday, Stephen and Aimee Cochrane were confronted with a painful memory.“I just cannot believe that this would have happened. It’s just wrong,” said Aimee.Her indignation was amplified by the fact that she and her husband were involved in a crash in the same lagoon in July of 2016.They had decided to rent a jet ski on their anniversary, something they had never done before.“We wanted to do something different,” recalled Stephen.But when they got to California Watersports at the Agua Hedionda Lagoon, they had second thoughts.“It was wild. It was mayhem out there,” said Stephen, describing the busy activity on the water.Despite their hesitations, they decided to go for it. But before they had even completed one lap around the buoys, they said they were t-boned by another rider.“We both flew off the jet ski,” remembers Aimee.Stephen said he momentarily blacked out. Aimee remembers swimming over to him and seeing him face down in the water.He was eventually pulled onto a boat and taken into an ambulance. He said he ended up with three broken ribs and a fractured sternum.Aimee suffered some cuts and bruises on her legs, but no broken bones.Stephen said he had to take three weeks off of work and pay ,000 in out of pocket medical expenses. He says he still has pain in his chest from the injury.After the crash, they said they had no contact with the owners of the rental company. They said they were unaware if the company had made any changes to prevent future crashes.10News spoke to an employee at California Waterspouts who said they would not be providing any statements. An email to the company’s manager also went unanswered.Carlsbad Police say they are still investigating the fatal collision from Sunday. 1846

CARLSBAD (CNS) -- A state appellate court panel reversed the molestation conviction Friday for a former Carlsbad military boarding school administrator who was tried twice on allegations that he molested a cadet at the Army and Navy Academy.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison for the conviction.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial.The panel ruled Friday that Barton's trial may very well have concluded differently had the juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged.The convictions came in Barton's second trial.In his first trial, almost two years before , a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on those charges. 1908

CARLSBAD, California — A California says it lost thousands in a bank scam that started with a notice about fraudulent debit charges.Krystal, who did not want to share her last name, lives in Carlsbad with her husband and their dog, Otis. Her husband is in the Marines and was recently in dive school in Florida. During that time, he received a call from what they thought was a USAA representative.USAA is a financial institution that serves primarily military families.“They told him there were fraudulent charges on his debit card and if they weren’t from him, that they’ll cancel the card and give him a new one and it will be sent to him,” Krystal said.She said it was from a USAA phone number.“They sent him a code through via text and had him repeat it,” Krystal said. “You could tell it was from USAA because there are previous text messages from USAA from other times they sent us the code,” Krystal said.Krystal said the caller said they needed to give her husband a new pin number and asked for the current one. In hindsight, it was a red flag, but at the time, he was busy evacuating from Hurricane Michael. The call sounded legitimate, even using the same song USAA uses when her husband was put on hold.“They had his debit card number. They mentioned me as a second account holder,” Krystal said.Before they knew it, their checking account was drained of more than ,800.“[I was] very angry, very heartbroken. Panicking,” Krystal said.Stephen Cobb with cybersecurity firm ESET said technology to make phone numbers look like a different one is increasingly used by crooks."A phone today is just a computer endpoint on a network and as such, its identity can be spoofed,” Cobb said.Krystal’s fraud claim was first denied by USAA, but she kept calling the bank, determined to get answers.“I finally got a hold of somebody in the financial crime department. She was very apologetic [and] said this isn’t the first time she’s heard of this today,” Krystal said.Krystal said she found her debit card was used in multiple transactions on the East Coast. The scammer has not been found.She was finally able to get a refund but has since switched banks. Now if she gets a call from a financial institution, she asks for a call back number to make sure it is real.“It makes me really angry and really sick. I feel really sick to my stomach about it. It makes me think of people that are veterans. What if their money was taken away?” Krystal said.On its website, USAA said this cybercriminal activity is on the rise. CAMP PENDLETON, Calif. (KGTV) - Marines and Sailors are finding and rendering WWII bombs safe in the Republic of Palau.Back in September of 1944, the U.S. attacked Peleliu, an island in the Pacific Ocean. It was Japan's second line of defense in WWII and a hop away from the Philippines."There was a lot of casualties in the Battle of Peleliu, which is one of the islands here in Palau," First Class Navy Diver Alexander Grun said.About 1,500 U.S. and 11,000 Japanese soldiers died in that battle, but the war is still taking casualties today."One of the Palauans was telling me they were building a house and they accidentally hit one [a bomb] while they were building their house," Grun said.Dozens of bombs were left on the islands only to be discovered decades later, often by accident.The U.S. hand picked about 100 Marines and Sailors, many from Camp Pendleton and 3rd Marine Aircraft Wing in San Diego, for Task Force Koa Moana, which translates to Ocean Warrior.One of the missions of the task force is to find and render those bombs safe."We have robots that are able to search the beach for us now." Grun said they search as deep as 40 feet in the ocean for these bombs.They arrived July 21 and, according to Grun, found six bombs on the beach."We were able to recover three of them, but three were mines, Japanese mines, that we didn't want to mess with. They were too big," Grun said.The team flagged the bombs' location and will come back on future missions with more equipment to recover them. Grun said when they find a bomb, they deactivate it or, "if it's going to detonate, we make sure everyone's away and do a hard pull. If it detonates, it detonates, if not, they go through a whole procedure and render it safe."They hope to protect Palauans and get home safe to their families."I want to say hello to my family out in San Diego in El Cajon," 1st. Lt. Joseph Sporleder, Communications Officer said. He has a brand new baby and wants to tell his wife and children he loves them.Sporleder said the island is rich with history and it has been incredible seeing old tanks, railway embedded in coral and other remnants of the war.Grun also had a message to his family in Santee, "I love you guys and I'll be home soon."According to the Marines' website, the task force will leave Palau in September. 2324
