San Diego (KGTV) - The remains of a Marine who was killed in a helicopter crash were brought back to San Diego Saturday night in a military procession.The body of 33-year-old Gunnery Sgt. Derik Holley was flown to Lindbergh Field then driven to Greenwood Mortuary.He was killed on April 3rd during a training exercise near El Centro when his helicopter crashed.Lance Cpl. Taylor J. Conrad, 1st Lt. Samuel D. Phillips and Capt. Samuel A. Schultz were also killed.A memorial service has been scheduled on Tuesday at MCAS Miramar. 535

SAN DIEGO (KGTV) - The trial for a former San Diego County sheriff's deputy accused of sexual misconduct while wearing his uniform began Monday in Vista.More than a dozen women claim Deputy Richard Fischer made unwanted advances."I think he's a bad guy," a San Marcos woman, who filed ,000,000 claim against the County, said.She said in August of 2017 two sheriff's deputies knocked on her door in the middle of the night for a welfare check. There was no problem and they left but she said Fischer returned alone an hour later, saying he needed to use her restroom; then told her she was cute and hugged her, several times."I was stunned shocked, it was very fast and confusing...I felt very vulnerable, intimidated, felt weak. I felt little." She said, next to tears. "It's just a mess! Everything is a mess! This is hard to do. He shouldn't have come back to my house and I don't ... Everything's a mess!"Similar instances were described by other women. In October of 2017, near the entryway of a 64-year-old woman's condo, Fischer took her report for a domestic violence incident and then made his move."His hands went all the way down to her butt and he squeezed both of her buttocks... he took her hand and pulled it down to his groin area," Lawyer Dan Gilleon said. He represents several women who filed claims against Fischer.Gilleon made a theme apparent, "he knows that she's alone, and she's vulnerable, and she's scared." Another victim called him a predator.Some women who came forward claim Fischer became more brazen, forcing sexual acts.Wednesday a plea deal fell through. The deal would mean Fischer would plead guilty to four felony charges -- down from more than 12 felonies -- and serve no more than five years in prison.10News learned that Fischer would also have to register as a sex offender for life under the plea deal.Fischer faces more than 25 years in prison if convicted of all charges. SAN DIEGO (KGTV) — The Rolling Stones are postponing its 15-city North American tour due to the coronavirus outbreak.The band's "No Filter Tour" was set to kick off in San Diego on May 8 at SDCCU Stadium and visit cities including St. Louis, Austin, Louisville, Cleveland, and Atlanta.“We’re hugely disappointed to have to postpone the tour. We are sorry to all the fans who were looking forward to it as much as we were, but the health and safety of everyone has to take priority. We will all get through this together — and we’ll see you very soon,” The Rolling Stones wrote in a joint statement.The tour's promoter, AEG, has advised ticket holders to keep their original tickets and wait for more information on rescheduled shows. 741

  

SAN DIEGO (KGTV) - The pool for inmate fire crews is shrinking after a bill lessening crimes went into effect in California, according to Cal Fire Public Information Officer Issac Sanchez.A record breaking wet winter led to a superbloom of epic proportions across San Diego County. New growth that will dry out and turn to tinder this summer, according to fire officials."We are poised daily, year round now to fight wildfire," Cal Fire Director Thom Porter said.Cal Fire relying on every resource to lend a hand if necessary.Our sister station in Redding reported last year one particular kind of crew is running low. Easy to see in their orange fire gear, volunteer inmate crews help firefigthers by completing tasks like digging fire breaks.Last year they had a "brown out" where they had to deactivate a crew to keep the others adequately staffed. "From what I understand it is absolutely an impact," Sanchez said referring to AB 109. The law, passed in 2011 lessened crimes for convicts ultimately letting out hundreds.According to our sister station, the humber of inmates at fire camps dropped from 2013 by 11%. That's 451 inmates.Leaving the CDCR with more work, "to identify and kinda steer eligible candidates into the program," Sanchez said.He said inmates must meet certain criteria like working well with others, being non-violent offenders, and meeting physical requirements."We still have enough folks to staff the crews, it's just a matter of identifying them at this point," Sanchez said.In San Diego County we have four inmate fire camps, in Fallbrook, Warner Springs, Julian and Boulevard. 1616

  

SAN DIEGO (KGTV) — There is new frustration for San Diegans trying to cutback their spending amid coronavirus restrictions.Some companies are refusing to freeze automatic renewals despite being closed. That's leading to resentment as workers across the county face layoffs, furloughs and reduced hours. Amanda Sullivan, a mental health professional, says she's still being billed a month for her 24 Hour Fitness membership, despite the gym shuttered. 24 Hour Fitness promises instead to add the lost time to the end of her membership. "It feels like robbery," she said. "We're taking your money, you can't do anything about it, we're telling you this is what we're offering, we'll just tack on time at the end."Sullivan said her emails to 24 Hour Fitness have gone largely ignored, or she's received boilerplate responses. Meanwhile, 24 Hour Fitness has shuttered its call center. In a statement, the gym stood by its decision, noting it also made available its subscription app that includes exercise instruction."24 Hour Fitness is focused on the continued health and safety of our club members, team members and guests. With that in mind, we have made some difficult decisions to ensure our ability to provide services to our club members and sustain our business over the long term," the statement said.The coronavirus shutdowns have prompted a variety of responses from membership-based businesses.While 24 hour is billing as normal, other gyms, like CorePower, OrangeTheory and Chuze have frozen fees. LA Fitness will only keep billing if a club reopens in the San Diego market by April 1.The San Diego Zoo and SeaWorld say they will extend annual passes to make up for the lost time. Spokespeople for both parks say additional questions should be directed to customer service. Consumer attorney Frederick Schenk, of CaseyGerry, says each subscription contract is different but he says it's always worth a phone call to ask for a refund. "I'm finding that vendors are working with their customers to come to terms with this horrible dilemma," Schenk said. "We're all facing it, and we have to face it together. So if a vendor thinks that it's going to take advantage of its members it will find in the not-too-distant future it will have lost that member and many others."Michael Weiner, a consumer attorney with Slate Law Group, said it is difficult to analyze situations without seeing individual contracts, but in general a consumer would appear to be on strong legal footing if he or she is being billed for something they aren't getting. Weiner suggested reaching out to corporate, and posting on social media if things don't change. "If they were still rebuffed, there are multiple avenues to take, from hiring counsel to speak to the company on their behalf, to filing a complaint with the Consumer Financial Protection Bureau and the local San Diego Chamber of Commerce," Weiner said.
