SAN DIEGO (CNS) - Despite an adjusted daily COVID-19 case rate of 7 per 100,000 population, San Diego County was again able to avoid being pushed into the most restrictive purple tier of California's four-tier reopening system.High rates of testing helped the county stay in the red tier, county officials said. The data are reported on a one-week delay.While the testing positivity percentage for the region also increased from 3% to 3.3%, it still remains low enough for this metric to remain in the orange tier. If a county reports statistics meeting metrics in a higher tier for two consecutive weeks, it will move into that more restrictive tier for a minimum of three weeks.The state's health equity metric, which looks at the testing positivity for areas with the lowest healthy conditions, dropped from 5.7 to 5.5% and remained in the red tier. This metric does not move counties backward to more restrictive tiers, but is required to advance.County public health officials reported 265 new COVID-19 infections and four deaths related to the illness Tuesday, raising the region's total case count to 53,000 and the death toll to 857.Four men died between Oct. 11 and Oct. 18, and their ages ranged from mid-50s to early 80s. All had underlying medical conditions.Of the 9,110 tests reported Tuesday, 3% returned positive, bringing the 14-day rolling average percentage of positive cases to 2.8%, far below the state-set target of less than 8%.Of the total COVID-19 cases in the county, 3,788 or 7.1% have been hospitalized, with 876 -- or 1.7% -- spending at least some time in an intensive care unit.Five new community outbreaks were reported Tuesday, two in businesses, one in a restaurant/bar setting, one in a K-12 school setting and one in a faith-based institution. SAN DIEGO (CNS) - A man who was a 17-year-old gang member when he killed a San Diego police officer in 1978 has been granted parole, but District Attorney Summer Stephan said today that she is hopeful Gov. Gavin Newsom will reverse the decision. Jesus Cecena, 59, was convicted of killing Officer Archie Buggs, 30, who was shot four times after he stopped a car driven by Cecena in the Skyline neighborhood.Cecena fired five times at Buggs, then paused, walked toward the fallen officer and fired a final bullet into his head at point-blank range. The officer died in the street, his hand still on his service revolver.Cecena was granted parole Wednesday during a video-conferenced hearing at Valley State Prison in Chowchilla. He was previously granted parole in 2014, 2015 and 2017, but each time the decisions were reversed.Cecena's latest parole hearing -- his 18th -- included a discussion of his criminal record, psychiatric factors, parole plans, and statements by representatives of the victim's family.``We are deeply disappointed that the killer of one of San Diego's finest officers was granted parole,'' Stephan said. ``This crime impacted the entire San Diego community and caused great pain for the family of Officer Archie Buggs.`` This fallen officer was so respected by the law enforcement community that a substation was named after him,'' she said. ``We are hopeful that Governor Newsom will review this parole grant and reverse it once again to keep this killer incarcerated.''In 1979, Cecena was sentenced to life in prison without the possibility of parole, but the sentence was reduced to a seven-year-to-life term in 1982 due to him being underage at the time of the shooting. 1708

SAN DIEGO (CNS) - More than 28,000 defaulted bills were sent out to San Diego County taxpayers this week, but the county's treasurer announced Tuesday that his office is offering penalty relief."We know many of the late bills are due to COVID-19, and we want our taxpayers to know there could be relief," Treasurer-Tax Collector Dan McAllister said. "They may qualify to have their penalties waived if they file for a COVID-19 cancellation request. Our customers must provide documentation as evidence to show how the pandemic impacted their ability to pay their second installment by April 10."The 28,623 defaulted bills McAllister's office sent out went to property taxpayers who failed to pay all their 2019-20 property taxes."We're sending 6,195 more defaulted bills than we sent last year," he said. "We expected to see an increase in tax defaults due to COVID-19's impact on the San Diego economy and workforce."The defaulted bills total over 7 million; last year, million in defaulted taxes was due.The deadline to pay the 2019-20 annual tax bill was June 30. Beginning July 1, late bills will incur a 1.5% penalty each month -- 18% each year -- until they are paid. SAN DIEGO (CNS) - Ex-Poway Unified School District Superintendent John Collins pleaded guilty Wednesday to a misdemeanor financial disclosure charge and was immediately sentenced to five years probation in a plea deal in a case in which he was accused of misappropriating more than 5,000 in public funds.The Poway Unified School District and Collins also reached a settlement in a civil lawsuit related to the allegations, which is expected to be finalized Wednesday night. That settlement involves Collins paying the district 5,000 over a period of time, according to Judge Frederic Link."This is basically a win-win for a lot of people," Link said.Collins is required to abide by the terms of the civil settlement and follow the law as part of his probation, or face the risk of once again facing the criminal charges.After several days of testimony at a preliminary hearing -- a proceeding held to determine if there is enough evidence to proceed to trial -- Collins pleaded guilty to a misdemeanor charge relating to his failure to declare outside income to the Poway school board. SAN DIEGO (CNS) -- A man accused of intentionally driving a pickup truck off Sunset Cliffs and into the ocean with his twin toddler daughters inside is slated to be arraigned Monday.Robert Brians, 47, is charged with 13 counts, including attempted murder, kidnapping, child abuse, child abduction, criminal threats and burglary for allegedly driving into the water on the morning of June 13 with his 2-year- old daughters inside the truck.
