VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

Mitt Romney of Utah and Chuck Grassley of Iowa for clues to whether they will support any effort to approve a Supreme Court justice before November's election. President Donald Trump and Majority Leader Mitch McConnell are moving quickly to set up a nominee, confirmation hearings and a vote to replace the late Justice Ruth Bader Ginsburg. Democrats oppose a Trump appointment so close to an election. Trump's Democratic rival, Joe Biden, is urging other Republican senators to join Lisa Murkowski of Alaska and Susan Collins of Maine in opposing a confirmation vote before the race is decided.In an interview on Monday, Trump said he thought that both Murkowski and Collins would be "badly hurt" for choosing not to vote for a Supreme Court justice nominee.The Republican caucus currently holds a 53-47 voting edge in the Senate. With Murkowski and Collins promising not to confirm, the GOP can only afford to lose two more Senate votes and still confirm a Supreme Court justice. WASATCH COUNTY, Utah — A man has been arrested and charged after police say he threw his wife into the Provo River in Utah on Sunday.According to an arrest report, 61-year-old Douglas Harold Green and his wife were at the Provo River Resort, located just downriver from Deer Creek State Park in Wasatch County, when they began arguing over dinner arrangements.Police say Green became angry and threatened to drown her in the river. He then dragged her to the bank of the Provo River and forced her in, the probable cause statement says.Witnesses said they tried to help her, but Green yelled at them to stay away.Police said the woman had a bruise on each arm, which she said were from Green dragging her. It was not made clear if she sustained further injuries, how long she was in the river or how she got out.Green was arrested and held without bail after a judge in the Heber District Court ruled that releasing him "would constitute a substantial danger to an alleged victim of domestic violence."He has been charged with aggravated kidnapping, a third-degree felony, and assault, a class-B misdemeanor.This story was originally published by Spencer Burt at KSTU. 1176
