SAN DIEGO (KGTV) -- The state agency that protects California consumers by licensing and regulating the state’s construction industry received more than 30 complaints about a San Diego County-based business.A Team 10 investigation discovered some customers who said they signed a contract with American Pride Enterprises, paid thousands of dollars up front and were left with little or nothing. The Contractors State License Board revoked American Pride Enterprises' license for non-compliance with an arbitration award in July of 2018.An outdoor cover to block the sun was the final piece in what had been a total backyard transformation for the Zimmerman family.“We were just looking to put a patio cover over our east-facing patio,” said Jim Zimmerman.Zimmerman said in 2017 he hired American Pride Enterprises and its owner Stephen Hage to do the work.He said there were no red flags. The company was licensed, bonded and at the time there were no real complaints online.“We paid just under ,200,” Zimmerman said. “That was to cover materials, and he was supposed to come back in three weeks and complete the job. That was the last time we ever saw Stephen Hage.”Zimmerman told Team 10 Hage initially offered to pay the money back, but instead of getting a check Zimmerman got excuse after excuse about why the money hadn’t arrived.Eventually, Zimmerman said the evasion tactics were too much and he sued Hage in smalls claims court.Zimmerman says he got some of his money back.A Team 10 investigation discovered Zimmerman isn't alone.Team 10 was in court when several people who claim Hage swindled them reached an agreement with his bonding company, getting some of their money back.James Francois said he paid Hage more than ,000 for a patio.“He never showed up, never delivered any material, never did an hour of work,” Francois told 10News.Court documents show more than 20 names listed on the lawsuit filed by the bonding company, which seeks reimbursement from Hage.A spokesperson for AmTrust told us, “This is a claim filed under a contractor’s license bond issued to our principal, American Pride Enterprises, by Wesco. Due to the claims we have received exceeding the aggregate ,000 bond limit, we filed an interpleader (a way for a holder of property to initiate a suit between two or more claimants to the property) to pursue funds that would be distributed to the named consumers, assuming the principal does not resolve the claims that have been presented.” Court documents show Hage filed for bankruptcy in July, and list his estimated liability around 0,000. In bankruptcy people trying to get money can’t access the assets until the bankruptcy is resolved.Team 10 tried to track down Hage, but no one answered the door at his listed address.The Contractors State License Board told Team 10 through a spokesperson: 2964
SAN DIEGO (KGTV) -- There are more concerns about vacation rentals in the Bankers Hill area, following action taken by the City Attorney’s office to shut down what they called a COVID party Airbnb on 2nd Avenue.The civil enforcement action cited concerns over gatherings during coronavirus-related restrictions and numerous other violations, from lack of permits to not obtaining proper tax licenses. According to the complaint the homeowner David Contreras Curiel, did not pay required taxes or fees to operate a vacation rental. It also alleges Curiel illegally made numerous renovations to the home.“From packing a party house during a pandemic to illegally renovating an entire property, the conduct of the defendants in this case is egregious and unacceptable,” City Attorney Mara Elliott said in a news release Friday.On Monday, ABC 10News spoke to a neighbor who lives next to another Airbnb rental on 3rd Avenue. Records show the rental is also owned by David Curiel. The home is listed as The Alfred Mansion on Airbnb’s website.“It’s disruptive every weekend,” one neighbor told ABC 10News. He did not want to be identified, but he said the parties picked up at The Alfred Mansion a few months ago.“Two weekends ago, there was a wedding there with at least 40 people. Nobody had a mask on,” the neighbor said. He added that he has made several complaints to police and the City of San Diego, but nothing had been done. He also had not heard anything from Airbnb regarding his concerns.Curiel did not return requests for comment. Early Monday afternoon, ABC 10News contacted Alex Mendez, the person who helps manage the property and deal with guests.On Monday evening, Mendez called the allegations against the Airbnb properties “unwarranted.”Regarding the city action taken against The Ashley, Mendez said that he and the owner were willing to work with the city. When he asked to reschedule a meeting with code enforcement a couple months ago due to Curiel’s travels, Mendez said the city was not willing to be flexible.Instead of a code enforcement officer calling him back, someone from the City Attorney’s office contacted him, Mendez said.He and Curiel were both caught off guard by the city’s allegations.“We, by no means, have a party house. The house rules are very strict,” Mendez said.Mendez said he has been willing to work with any neighbors who have had issues with the Airbnb properties. “We’re very responsible,” he said, adding that it is also not fair for “neighbors to complain any time there’s any little noise and mischaracterize it.”A spokesperson for the City Attorney’s office could not say whether or not the property on 3rd Avenue was being investigated, but told ABC 10News that the case against The Ashley could affect the other rentals owned by Curiel.“If granted, our injunctive relief would apply to any properties within the county owned by Mr. Curiel that have one or more of the same-type violations that are listed in our complaint,” a spokesperson said.Airbnb has not responded to this latest allegation, but previously told ABC 10News that hosts are not allowed to authorize parties where current public health orders prohibit gatherings, like in San Diego County. 3217
SAN DIEGO (KGTV) - Thousands of San Diego children returned to classes for the 2018-2019 school year Monday.For the San Diego Unified School District, one of the priorities is pushing a bond measure on the November ballot which earmarks funding for school safety and repairs.“What we've learned since Parkland, since Sandy Hook... we have to take those lessons and put them into action,” said Superintendent Cindy Martin.RELATED: 10News?Back to School SectionAt .5 billion, the bond measure is the largest in the district’s history. SAN DIEGO (KGTV) - There’s now a bombshell update about the standoff from earlier this summer at a condo complex near SDSU.Two officers were shot and dozens of neighbors were terrorized. 10News Investigative Reporter Jennifer Kastner has confirmed that officers wanted to search the suspect’s home for weapons days before the shooting.However, the Office of the San Diego County District Attorney did not attempt to get a search warrant. It was a horrifying night that ended with one person dead and two San Diego Police officers wounded by gunfire. Suspect Joseph Darwish died in the massive standoff.He had numerous hand guns and rifles, according to police. In the days after the shooting, 10News was tipped off by a law enforcement source that the FBI’s Joint Terrorism Task Force had wanted to search Darwish's home because they thought he had a weapon and was buying parts to make more weapons.Darwish wasn't supposed to own any weapons because of his criminal history. Our source says the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For the past 7 weeks, 10News has been trying to confirm this with the DA’s Office.After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked law enforcement expert and former police officer Kevin LaChapelle what "legally deficient" means. “It means that the District Attorney's Office felt that there was insufficient evidence or insufficient information that a judge would not grant a search warrant,” he explained.10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office will not answer that question, stating it's "exempt from disclosure".LaChapelle said this may have been a lesson learned the hard way, for the DA’s Office. He explained that the DA’s Office may reevaluate when it’s appropriate to seek a warrant. “It may help them start saying [a warrant] didn't meet [certain] criteria but it met this.It didn't meet a [level] 10 but it was at like a 7 and gosh, maybe [the DA’s Office needs] to start looking at this more so we can prevent these kinds of things,” he added. The FBI declined to comment about Monday’s story. San Diego Police have taken the lead on investigating the shootout. As of Monday morning, a lieutenant with the Homicide division said the investigation is still open and active and will probably take another couple of months to finish. 2913
SAN DIEGO (KGTV) — The suspect of a Spring Valley murder nearly seven years has been arrested in New York.Waverly James, 49, was arrested in New York for the Dec. 6, 2012, murder of 52-year-old Stanford Roy Johnson, according to the San Diego Sheriff's Department.Deputies say they were called to a home in the 9000 block of Lemon St. on Dec. 6, 2012, for a welfare check. Deputies found the rear door open and discovered Johnson dead from multiple stab wounds.James was identified as a suspect and arrested on a warrant in New York. He will be extradited to San Diego and booked for murder. 599
