TAMPA, Fla. — Three generations of one Tampa Bay family say they wound up in oncoming traffic after a blowout involving a newer tire.Steve Nelson says he purchased four new tires last November, but they had just 300 miles on them when he hit the road with his son and grandson in June. The trio left Tampa for a cross country camping trip to Yosemite in California — an adventure that took a scary turn on the drive back home.Steve said he lost control of the truck after the front driver's side tire blew out on I-40 near Gallup New Mexico. “We wound up in the oncoming lane dodging semi-trucks,” he said. That Dodge dealer replaced the rear tires and wrote on the invoice that those tires had broken cords. Steve made a call for action after he says Mavis, the shop where he bought the tires, denied his claim for a refund. ABC Action News asked Chris Brazzeal, the owner of Brazzeal Tire in Tampa, to examine the original tires that came off the pickup. Chris showed us bubbling and rubber separation on two of the tires. “That is a clear indication the tire is now coming apart,” said Brazzeal. We contacted both Mavis and the tire manufacturer Vee Rubber. “Mavis is committed to providing safe and high-quality services to our customers. We have been in contact with the customer regarding this issue and have reached out to the tire manufacturer on his behalf to facilitate a resolution,” the company wrote.After we got involved a representative from Vee Rubber flew to Tampa, examined the tires and admitted one of them was defective. CHICAGO, Ill. – For the last few years, a refugee resettlement program in Chicago has been teaching women to be part of a social enterprise and improve their skill set. But as the Trump administration makes drastic cuts to the number of refugees accepted into the U.S., resettlement programs like this are bearing the brunt. With knitting needles in hand and sewing machines at the ready, women from all over the world, like Humaira, gather to learn from one another and create. “My name is Humaira. I’m from Afghanistan,” she said with a smile. Humaira is part of Loom, a group of refugee women artisans who congregate each week to create handmade functional crafts. Many have fled war and violence to resettle in the U.S. Loom Chicago Coordinator Rebecca Hamlin-Green says programs like this provide an opportunity for these women that might not otherwise be available. “Refugees in general face a lot of obstacles but women in particular do simply because they may be coming from a culture that doesn't emphasize employment or higher education or many of the skills and privileges that we enjoy,” she said. The program is administered by the Catholic Charities Refugee Resettlement Program in Chicago. Organizers say 70 percent of each sale price goes back to the women. “And then 30 percent goes back into the program so we can purchase their materials and provide the studio space,” explained Hamlin-Green. For many like Humaira, it’s not only a chance to make some extra money but to socialize and find community amongst other women – though they may not share the same language. “I like to make jewelry. I like to make crochet. And also knitting,” she said. But as of next year, the state department is capping the number of refugees allowed into the U.S. to 18,000, the lowest number since the refugee program was established in 1980. That’s an 80 percent cut from the 110,000 cap during the last year of the Obama administration. October became the first month on record in 30 years that not a single refugee was resettled in the U.S. And because federal dollars are tied directly to the number of arrivals, fewer refugees means fewer federal dollars for programs like Loom. Catholic Charities program director and former refugee Elmida Kulovic says they are feeling the pinch. “Basically, our program’s budgets are cut. So, for example in September this program lost four full-time positions,” said Kulovic. A Wilson County, Tennessee, woman is facing a lawsuit after she posted a negative review on Yelp about a middle Tennessee doctor in November. Kelly Beavers is accused of defamation and libel, and false light for a post she made about Dr. Kaveer Nandigam of Nandigam Neurology in Murfreesboro. Her Yelp review, which remained on the website three weeks after she originally posted it, said, "This "Dr's" behavior today was totally unprofessional and unethical to put it mildly. I will be reporting him to the State of TN Medical Review Board and be filing a formal complaint. How this guy is in business is beyond me. Since when did they start allowing Doctors, to throw a complete temper tantrum in front of Patients and slam things when they get upset? He does not belong in the medical field at all." On November 27, the attorney for Nandigam Neurology filed a ,000 lawsuit against Beavers and her friend's son who posted a negative review on Google as well and has since been accused of conspiracy. Beavers said he wrote the review after he overheard her conversation. The lawsuit said the review "contained false, disparaging, and misleading statements." The lawsuit also suggested that the second defendant "was specifically recruited" by Beavers to post false and misleading statements. The plaintiff is also demanding Beavers to remove the post and for the court to issue an injunction to prohibit any further statements against Nandigam Neurology. As of this week, Nandigram Neurology only has Beavers' review and another post that gave the business five stars. Meanwhile, the company has 4.3 out 5 stars from the 21 reviews on Google. "Just in shock, I can't believe it," Beavers said. "They just don't want any negative reviews and they don't want people to talk about or give a bad review." Beavers said she has no regrets leaving the review on Yelp despite the legal action against her. She claimed she posted the review after what she called a disrespectful and shocking experience. After being referred to Nandigam Neurology, Beavers brought her 67-year-old father for dizziness and memory loss, which may have been early signs of dementia. There have been prior interactions with the staff but never with the doctor until the last visit. Beavers says the interaction seemed fine at first, but that said the doctor then threw a temper tantrum and slammed his clipboard when he realized she was recording the appointment on her cell phone, which is something she has done with other doctor visits. "Sometimes we all have things we forget, so that's why I record every doctor's visit. I want to make sure that I'm doing everything right," she explained. "He literally snapped and demanded my phone." Since Tennessee is a one-party consent state, she could record on her phone without the need for permission. Nevertheless, she claims she deleted the recording after he demanded her to. Later that day, an office employee called her to get her version of the story and deemed it was likely a miscommunication. The employee said phones were not allowed in the office, and the situation could have been mitigated if there was a prior notice to record. Beavers believed she should have been taken aside to address any concerns. Ken Paulson of the Free Speech Center, a nonpartisan educational institution that teaches how the First Amendment works in society, said there always needs to be a conscious effort to differentiate between stating an opinion or fact on platforms like Yelp. Words like unethical, dishonest or lying have the potential to damage a reputation or business if believed widely. "Don't state things you cannot back up. It's okay to say you didn't like this pizza or the anchovies were terrible because that's opinion, but you can't say they can't make this pizza without washing their hands. It's a difference in expressing an opinion and damaging a business or person," Paulson said. In reality, lawsuits like what Beavers is facing could be disputed in court and avoid the judicial process under the newly enacted Tennessee Public Participation Act otherwise known as an Anti-SLAPP (Strategic Lawsuit Against Public Participation) legislation. The act hopes to prevent filing lawsuits as a form of intimidation and protect First Amendment rights, and has slowed down what was a common type of lawsuit in the past. "It allows you when you're sued to go to a judge and say, 'This is nonsense, they're just angry, I didn't cause any damage, will you dismiss this?'" Paulson explained. "They have to prove in the long run that you damaged them and spoke untruths." A judge is there to weed out cases that have no merit but if it is not dismissed, will still have to go through the judicial process. Speech Defense and Anti-SLAPP Lawyer Daniel Horwitz expressed his approval for the legislation when it was passed. He said an overwhelming majority of defamation and other speech-based lawsuits are not filed because a person has suffered an actual legal injury. Horwitz claims the purpose is to punish people for lawfully exercising their right to speak freely about a topic that the suing plaintiff wants to censor. “Tennessee’s new anti-SLAPP statute was specifically designed to punish abusive litigants who file baseless claims against people for exercising their First Amendment rights. The Yelp review is not even conceivably tortious, and the defendants should not give in to a bogus lawsuit like this one. Instead, they should fight back, get the plaintiff sanctioned, and make the plaintiff pay their attorney’s fees under the newly enacted Tennessee Public Participation Act," Horwitz said in a statement to NewsChannel 5.Beavers said she plans to a hire a lawyer and fight the lawsuit. Food is a basic necessity, but getting access to that food, doesn’t always come easy. “I have been using SNAP off and on for about 13 years,” SNAP recipient Andrea said. Andrea is on food stamps. SNAP – the government’s “Supplemental Nutrition Assistance Program” – is the country’s largest nutrition assistance program. “I did not have any family to support me, I had lost my job, and I had a child with a lot of health needs. So I was in a place of needing to provide food for my family,” Andrea said. At one point in her life, Andrea says she was budgeting a week for groceries. It wasn’t enough to support her whole family. “I had this moment where I just kind of sat on the kitchen floor and realized that I could allow myself to go hungry, but I couldn’t let my kids. And it had reached the point that I was afraid that was going to happen,” Andrea said. So, she applied for SNAP once again. Andrea is one of nearly 40 million Americans currently using the program.“It provides individuals and families who have lower income with access to food benefits on a monthly basis. It’s transferred on an electronic benefit card, that can be used just like a debit card at a grocery store,” said Karla Maraccini, the Division Director of Food and Energy Assistance Programs at Colorado Department of Human Services. The Colorado Department of Human Services is preparing for a change to the SNAP program, expected to go into effect April first. “A proposed rule was finalized regarding requirements for able-bodied adults without dependents. These are adults that are age 18 to 49 who do not have a dependent child in their care under the age of 18,” said Katherine Smith, the Division Director of the Employment of Benefits Division. Under current rules, able-bodied adults can only receive three months of SNAP benefits in a three-year period if they work less than 20 hours a week. However, there has been an exception to that rule. “Based on unemployment rates and other economic factors, states have been able to get waivers so that those able-bodied adults without dependents did not have to meet those work requirements,” Smith said. The administration’s change will make it more difficult to get approval for that waiver. The Agriculture Department estimates it would cut benefits for roughly 688,000 SNAP recipients, which in turn would save the federal government around .5 billion over five years.On Twitter, Secretary of Agriculture Sonny Perdue explained why he thinks the country will benefit from the change. He tweeted “the USDA’s rule lays the groundwork for the expectation that work capable Americans re-enter the workforce, where there are currently more job openings than people to fill them.” Secretary Perdue says the program was intended to provide assistance through difficult times, not as a way of life. Andrea argues the situation is isn’t so simple. “If you aren’t eating enough, then you can’t be healthy enough to even work,” Andrea said. She says SNAP is already a work-support tool that ensures families access to nutritious foods so they can focus their energy on supporting their family.
