SAN DIEGO (KGTV) - The local protester who appeared in a controversial video getting taken away in an unmarked San Diego Police van is now speaking out, as police conduct an internal investigation.“No one should feel fear from the people that are supposed to serve and protect us,” Shayla Piccini told 10News on Monday as she shared the story of her arrest from last Thursday on Park Boulevard.The video shows a protester being taken away in an unmarked van as one officer warns her family around her not to follow them or he will shoot.“You see both of her legs kind of go up in the air because she's going [into the van] head first. That’s way too much force needed for this 20-year-old lady here,” said attorney Dante Pride.“That whole ride, I was asking several questions like, ‘Who are you? Where are you taking me?’ I was getting stares and no answers,” said Piccini.Piccini said she spent the day at a protest in Downtown San Diego. After several hours, the group was walking back to their car when she saw several police motorcycles driving past them. At that moment, she held up her cardboard sign.San Diego police say detectives witnessed her step off the sidewalk and swing the sign at a passing motorcycle officer, which she denied.In the foreground of the video, you can see men in what look to be marked police vests. But the people who handcuffed and detained Piccini in an unmarked van, are in plain clothes.One man wearing military-style tactical gear can be heard in the video saying, "You follow us, you will get shot. You understand me?"Piccini's cousin Brandi Matthews said she thought he was talking to her. “When he said the words, ‘I'll shoot you,’ I automatically just dropped to my knees to demonstrate that I'm not trying to hurt anybody...I just want to know where they're taking my cousin,” she added.According to San Diego Police, the statement about shooting those attempting to follow was made by a SWAT officer who had a pepper ball device. SDPD also told 10News that his comment was a valid announcement of use of force.Police said due to the large crowd still in the area, and the detectives felt the need to leave immediately.Piccini spent the night in jail on suspicion of assault on an officer. SAN DIEGO (KGTV) -- The battle between rideshare companies and drivers' unions is on the ballot in the form of Proposition 22. It's a way for companies like Uber and Lyft to push back against California's Assembly Bill 5, which classifies drivers as employees with benefits instead of independent contractors.The gig companies are fighting the state in court, so they haven't been following those rules since the law went into effect on Jan. 1. Now, the fate of drivers will be in the hands of California voters on Nov. 3.The Yes on 22 campaign is backed by Uber, Lyft, and Doordash.It would classify drivers as independent contractors.Drivers could work towards a stipend to help purchase their own health insurance.They would also get some hourly pay, but only during what's called "engaged time." Yes on 22 says engaged time starts from the moment a driver accepts a ride until they drop the passenger off. It does not include time drivers spend waiting for their next passenger."If you were to compensate for all the time the driver spent on an app, you'd have to force them to accept every ride that comes across which would eliminate their flexibility to choose when they want to work and how long they want to work," said Vetter.Driver Al Porche says that's exactly why he's voting yes."Times are great right now," said Porche. "I've been driving all this year. I switched over from transporting people to delivering food and meals or groceries."According to the New York Times, rideshare companies have spent more than 0 million promoting the campaign, making it the costliest in state history.A "No" vote on Prop 22 would continue the current ruling under AB 5, reclassifying drivers as employees with a swath of rights and protections.Tonje Ettesvoll is against Prop 22, warning it's deceptive if you don't look closely."When you look at all these ads on TV and social media, that is Uber and Lyft's voice, said Ettesvoll. "That is not the driver's voice."She's been driving full-time for four years in San Diego and says it's only gotten worse."They have cut my rate many, many times to the point where I'm driving from 40 hours a week to 60 with the same pay."Nicole Moore with Rideshare Drivers United says about 40% of the job is waiting for your next ride -- time Prop 22 wouldn't pay up for in terms of pay or benefit because it's not considered engaged time."This is work. Just because you're a cashier in a store and you don't have somebody checking out doesn't mean you're not paid," said Moore. "It is definitely helping the billionaires and the people who are running these companies but it is not helping the drivers."The Yes on 22 campaign says if the proposition doesn't pass rides will be harder to find and prices will go up. SAN DIEGO (KGTV) -- The California Highway Patrol is investigating after a body was found on Interstate 5 near Camp Pendleton Thursday afternoon.According to CHP, the body of a 51-year-old man was found on the exit ramp from I-5 north to Christianitos Road.Once officers arrived, they found the San Clemente man out of view in the brush next to the road.The San Diego County Medical Examiner responded to the scene and is trying to determine the cause of death. SAN DIEGO (KGTV) - The mountain lion euthanized by California Department of Fish and Wildlife wardens is the same animal responsible for attacking a boy at Los Pe?asquitos Canyon Preserve, CDFW announced Friday. The 4-year-old boy was among 11 people hiking the North San Diego County trail Memorial Day when the 80-pound female mountain lion attacked him. Wardens who went to the scene found the animal’s tracks and encountered it moments later. The mountain lion appeared to have little fear of humans: an abnormal behavior, CDFW said. RELATED: Boy attacked by mountain lion in San Diego's Los Pe?asquitos Canyon“The wildlife officers immediately killed the animal to ensure public safety and to collect forensic evidence to potentially match the mountain lion to the victim,” said CDFW officials in a news release. City park officials closed the trail for the public’s safety. DNA analysis from the boy and samples from the animal confirmed the euthanized mountain lion was responsible for injuring the boy.
