SAN DIEGO (KGTV) — San Diego District Attorney Summer Stephan is objecting to the early release of a man convicted of driving off the Coronado Bridge and crashing in Chicano Park, killing four people.Richard Anthony Sepolio, 27, was convicted of four counts of vehicular manslaughter while intoxicated and one count of DUI causing injury in the crash on Oct. 15, 2016. He was sentenced to nine years and eight months in prison. He is set to be released early after serving two years and 10 months of his sentence. Monday, the CDCR notified victims in the case of the release, citing prison credits for good behavior and the state's policy on release amid COVID-19. Stephan wrote a letter to Gov. Gavin Newsom and the California Department of Corrections and Rehabilitation (CDCR), calling the release a "miscarriage of justice.""This very early release is unconscionable," Stephan wrote. "CDCR’s decision is re-victimizing the family and friends of the four people killed and seven injured who have been devastated by their loss and continue to deal with the financial, emotional, mental and physical trauma caused by the defendant. This inmate continues to deny and minimize the crime by refusing to admit he was speeding and denying being impaired while arguing with his girlfriend on the phone, which resulted in the devastating crash."The crash killed Annamarie Contreras, 50, and Cruz Contreras, 52, of Chandler, Ariz.; and Hacienda Heights residents Andre Banks, 49, and Francine Jimenez, 46. Seven other people were also seriously injured.Sepolio was traveling between 81 and 87 miles per hour when he lost control and plunged over the bridge, landing in the park below where a motorcycle rally had attracted nearly 1,000 people, according to Stephan. Sepolio had testified that another vehicle would not let him over into the left-hand lane, so he sped up twice to pass before the crash occurred. 1912

SAN DIEGO (KGTV) — San Diego County will plan their own guidance around trick-or-treating and celebrating Halloween next month while staying safe during the pandemic.County Public Health Officer Dr. Wilma Wooten said the county will develop guidance surrounding how to safely celebrate the holiday while adhering to public health orders. Wooten added that they will also take cues from the Centers for Disease Control and Prevention and the agency's guidance as well.Wooten said the county plans to have those recommendations by the end of the month."During the cloud of the pandemic, we have to get joy where we can. So we will be awaiting CDC guidelines but we'll be coming up with a process, a protocol," said Wooten. "For example, a drive-thru Halloween event to allow children to don their Halloween costumes and we plan to probably have that codified by the end of this month.RELATED: Los Angeles County backs off trick-or-treating ban, but advises strongly against it"But right now, there is no discrete plan."Tuesday, Los Angeles County issued guidelines that banned trick-or-treating and trunk-or-treat, in which children take candy from parked cars, under the county health order. "We don't think it's an appropriate activity during a pandemic. ... You know, there's no guarantee when you go trick-or-treating that your child goes up to a house where the person who opens the door is wearing a face covering. And when you don't know the people opening the door, there's no guarantee they're not sick and that the candy they're passing out that they've touched may not be safe for you to want your child to be sharing."Wednesday, San Diego County reported 247 new coronavirus cases, bringing the region's total to 41,324. The county also has 22 community outbreaks in the last seven days.What's unclear is how California's new color-coded tier system to affect how any holiday guidance is established. Last month, the state issued a new tier system that divided counties into four tiers. San Diego is currently in the second tier, red or "substantial," reserved for counties with four to seven cases per 100,000 and 5% to 8% testing positivity. Wednesday, the county reported that one of those metrics, case rate, neared 7 cases while positivity sat at 4.2%. SAN DIEGO (KGTV) -- San Diego Police have released video footage after officers shot and killed a murder suspect following a standoff on May 29.The 32-year-old suspect who was shot and killed was accused of shooting and killing another man at a City Heights apartment complex.The video shows officer stationed outside the apartment complex. Watch the full video below:According to police, gunfire was reported at the complex on the 3800 block of Euclid Avenue around 3:30 p.m.Officers later found a 62-year-old Hispanic man with at least one gunshot wound. The man was treated before being pronounced dead.Officers were then directed to a nearby complex where the suspect was believed to be hiding while a SWAT team arrived.RELATED: San Diego police officers shoot, kill murder suspect following standoff in City Heights"The suspect walked half way down the stairs towards the officers' positions and challenged them to come get him before retreating back into his apartment," police said.The man then descended back down the stairs towards officers."When the suspect had descended half way down the stairs, he extended a pistol in the direction of the officers. Three officers fired their weapons at the suspect, striking him several times," a San Diego Police Department statement said. "Specially trained STAR medics deployed with the SWAT team to provide aid, but the suspect was pronounced deceased at the scene. A firearm and a knife were recovered."Earlier in the week, the suspect’s mother reportedly contacted police after he threatened her with a firearm.Police say the women told investigators her son wanted to be involved in a shooting with police and to commit “suicide by cop.” 1700

SAN DIEGO (KGTV) -- San Diego Police are investigating after a man died in custody after reportedly breaking down a fence and walking into someone’s home Tuesday afternoon. Police were called to the 2900 block of Hornet Way around 3:30 p.m. Tuesday afternoon after receiving a call from someone saying a man, later identified as Buddie Thomas Nichols, 40, had entered his home through a rear door. According to police, the man broke down a fence and walked into the home through an open back door. Two of the residents were upstairs while their 9-year-old daughter was asleep downstairs, according to police. Police say one of the residents came downstairs when he heard commotion and confronted Nichols, punching him twice in the face and rendering him unconscious. Police say the suspect woke up and ran out of the house displaying bizarre behavior after the resident kicked him. Witnesses told police they believed the man was on drugs. When police arrived and tried to take the Nichols into custody, officers say he resisted, forcing them to use physical force to get him into handcuffs. After paramedics arrived, police say Nichols became unresponsive and later died after being taken to the hospital. 1215

SAN DIEGO (KGTV) -- San Diego immigration advocates say they are feeling a sense of hope after the election of Joe Biden and Kamala Harris. "I was definitely hopeful that, once again, we’ll have a process of consulting with an administration that wants to do something in regards to immigration versus what I would describe as an iron fist against anyone who’s coming into the country," says Pedro Rios, the director of the American Friends Service Committee.President-elect Biden has already shared some of his immigration related plans once he takes office. Biden has vowed to reinstate the Deferred Action for Childhood Arrivals (DACA) for children brought to the U.S. by their parents. The former vice president has also said he plans to halt funding for the border wall and reverse the Migrant Protection Protocols, allowing asylum seekers to wait in the United States, instead of Mexico, until their asylum case is heard. During the last presidential debate, Biden also promised a pathway to citizenship during his first 100 days in office. Rios says the passing of that plan would depend on who controls the senate come January.
