SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. We are grateful for the Court's comprehensive enforcement of environmental law and look forward to review of an alternative in an EIR that will allow this historic building to survive as part of a successful new project. SAN DIEGO (KGTV) -- A Point Loma woman said a man took photos of her chest as she was walking into the Ralphs grocery store on Rosecrans Boulevard on Tuesday morning. It was around 9 a.m. when Julie Buerckley noticed a man standing by the entrance and as she got closer she says he began snapping photos on his phone.  "He was taking pictures of me but it wasn't of my whole body, it was just of my chest," said Buerckley.Buerckley told 10News she ran inside to tell someone, but by the time employees came out the man was long gone. She said there's no telling how long he'd been there or who else he'd taken pictures of. "I'm worried about kids getting pictures taken when their parents aren't paying attention and stuff," Buerckley said. "That's what I'm worried about."She described the man as being tall, and wearing a red shirt, blue jeans and white shoes.  906

SAN DIEGO (KGTV) - A patient at a North Park dental office got upset after she got hit with surprise fee.Two Thursdays ago, Linda Morrow - donning a mask and gloves - went to Pristine Dental Group for a root canal and bone grafting. After the procedure, Morrow, who doesn't have dental insurance, paid cash for the bill. It was in line with the estimate."The total bill was 0. I didn't have change, so I gave them 0 because I only had bills," said Morrow.Morrow says when no one in the office could make change, the receptionist spoke up."She commented, 'Oh, PPE.'" said Morrow.Morrow says her new bill was for 0 dollars, including a charge for personal protective equipment used by the dental staff."That shut my mouth. I was stunned," said Morrow.Confused, Morrow paid the full amount and left."My concept was that it was definitely an afterthought. If I had exactly 0 or my debit card, I would not have had to pay the charge," said Morrow.Morrow posted details of the charge of the Nextdoor app. Quickly, several neighbors responded that they also have paid similar charges at their dentist offices, ranging from to . SAN DIEGO (KGTV) — A man was arrested Thursday after attacking police with railroad spikes and rocks in a Barrio Logan train yard, police said.San Diego Police were called to the BNSF Railway Yard along Harbor Drive around 10 a.m. to reports of a trespasser. Officers arrived to find a man who had armed himself with a stick and railroad spikes, police said.The suspect reportedly threw the spike at officers and fled under a rail car, refusing to come out. The man also threatened to kill a police K-9 on scene, SDPD added.Police created "decision making space" and tried to talk the suspect into surrendering. After those efforts failed, officers used shotgun beanbags, pepper balls, and eventually a K-9 officer to get the man to surrender. He was pulled from under the railcar and taken to a nearby hospital for treatment of injuries, including dog bites, police confirmed.No officers were injured during the event. 927
