SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) - 10News was there as an emotional burglary victim was reunited with her stolen Pekachu puppy.Ashley Morales was overcome with emotion as young Lorenz Lugg placed her 4-month-old puppy back in her arms. "I can't believe it. I never thought I would get him back," said Morales.On Monday, a distraught Morales sat down with 10news after a Sunday morning burglary at her Spring Valley condo on Madrid Way. As her children slept inside, a neighbor's surveillance cameras captured several suspects as they walked in and out of the condo. Missing from the home: a television, jewelry, and Snuffles the Pekachu."I just want my dog back," said Morales, as she pleaded for her puppy's return. What she didn't know was that her puppy was at Payd 2 Fade barber shop in the College Area. Shop owner Roc Lugg says early Monday afternoon, a man resembling the suspect in the video came in with a story."He had the dog, but was homeless and living out of his vehicle. Couldn't afford to take care of the dog anymore," said Lugg. When Lugg saw how well the dog was interacting with his own dog, he decided to purchase the puppy to give him a better home. He paid 0. Later that day, his wife got a big shock as she was watching 10news. She realized their new puppy was actually someone else's. Their young son led the charge to reunite puppy and owner."I was desperate to find them and give it back to them. He needed to be home," said Lorenz Lugg.The family called 10news and we called Morales. ="I'm glad humanity is still thriving ... I'm over the moon. I got my baby back. SAN DIEGO (KGTV) -- A 26-year-old was hospitalized late Saturday night after being struck by an SUV while riding his motorcycle.Police say the man was crossing an intersection at 5th Avenue and Ash Street around 9:41 when 82-year-old Herbert Green ran a red light and hit the 26-year-old.The rider flew off the bike when police say he hit a parked car with his head. He was taken to the hospital with life-threatening injuries. Officers were able to catch up to and arrest Green several blocks away from the scene of the crash. 545

SAN DIEGO (KGTV) — A 58-year-old man severely injured after an assault at a home in Clairemont in early April died Monday. According to police, 58-year-old Randy Taing died of his injuries in the evening of April 8. San Diego Police said the incident occurred in the 4100 block of Ashford St. before 12 p.m. The man reportedly called his wife sometime around 11:45 a.m., though his wife said the phone was silent.She asked her son to call, who got through to his dad. That's when the man told his son something along the lines of a possible break-in, police say.The man's son called 9-1-1 and rushed home to find his father with upper body injuries. The man was taken to a nearby hospital with life-threatening injuries, police said. Police said there were no signs of forced entry, but a safe had been taken. Neighbors of the family-owned business a mile away from their home, Rose Donuts, said the safe probably contained cash from the business. A family friend said the father, who he called Randy, was asleep at home during the robbery because he was filling in for his nephew at work. He said he was baking donuts at 2 a.m. while his nephew was on vacation.Customers who work in the area say the family is beloved. "They have two boys and sometimes they even babysit the grand kids while they’re working...
