SAN DIEGO (KGTV) - Sharp Grossmont Hospital secretly video recorded 1,800 patients using hidden cameras at the women's health center in El Cajon, according to a lawsuit filed late Friday afternoon. The recordings took place between July 17, 2012 and June 30, 2013 inside three Labor and Delivery operating rooms at the facility located at 5555 Grossmont Center Dr. in El Cajon, the plaintiffs claim.Among the video recordings captured by hidden cameras: Caesarean births, hysterectomies, sterilizations, dilatation and curettage to resolve miscarriages, and other procedures, according to court documents.Women were also recorded undressing, the lawsuit says.According to court documents, the hospital claims the recordings were part of an investigation "into whether an employee was stealing the anesthesia drug propofol from drug carts in the operating rooms."The suit states that the motion-activated cameras were installed on drug carts in each of the three operating rooms at the women's health center, but the cameras continued to record after motion stopped. READ: Phony doctor suspect charged for Sharp Grossmont hospital visitsBecause of the angle and placement of the devices, the suit says "patients' faces were recorded, and the patients were identifiable."“At times, Defendants’ patients had their most sensitive genital areas visible,” the lawsuit states. Multiple users, including non-medical personnel and strangers, had access to the recordings on desktop computers, the lawsuit claims, and that Sharp “did not log or track who accessed the recordings, why, or when."“There are images contained within the multitude of images of women undergoing operations of a very personal, private nature, unconscious and in states of exposure depending on the operation being performed,” the lawsuit cites an unnamed Sharp executive as saying.“Plaintiffs suffered harm including, but not limited to, suffering, anguish, fright, horror, nervousness, grief, anxiety, worry, shock, humiliation, embarrassment, shame, mortification, hurt feelings, disappointment, depression and feelings of powerlessness,” the lawsuit claims.Plaintiffs believe Sharp destroyed “at least half” of the recordings but cannot confirm the files are not otherwise recoverable. Computers used for storage were replaced or refreshed, but Sharp did not ensure proper deletion of recordings, according to the lawsuit.READ: La Mesa police investigate man's suspicious death at Sharp Grossmont HospitalSharp HealthCare and Sharp Grossmont Hospital are named in the lawsuit, along with the possibility of more defendants in the future once their names and capacities are known.10News reached out to officials at Sharp HealthCare and they confirmed that between July 2012 and June 2013, "Sharp Grossmont Hospital installed and operated one hidden camera on the anesthesia cart located in each of three operating rooms in the Women’s Center.""The purpose of the three cameras was to ensure patient safety by determining the cause of drugs missing from the carts," Sharp HealthCare officials told 10News."A initial lawsuit alleging privacy violations and other claims stemming from the video recording was filed against Sharp HealthCare and Sharp Grossmont Hospital in 2016. The case remains active and Sharp is not in a position to comment further about the matter," Sharp HealthCare officials told 10News."Sharp HealthCare and Sharp Grossmont Hospital continue to take extensive measures to protect the privacy of its patients," Sharp HealthCare officials said. The complaint for damages includes a demand for jury trial on charges of invasion of privacy, negligence, unlawful recording of confidential information, negligent infliction of emotional distress, and breach of fiduciary privacy.STATEMENT FROM SHARP GROSSMONT HOSPITAL 3809

SAN DIEGO (KGTV) -- Some places of worship around San Diego County appear to be planning to continue holding services on their property despite the state’s order regarding indoor operations. On Monday, Gov. Gavin Newsom announced pandemic-related restrictions for certain businesses and activities, and places of worship were included on California’s list.Via a Wednesday evening livestream, Kearny Mesa-based Awaken Church broadcasted their service in which there were people in attendance. On their website, Awaken Church promoted in-person women’s prayer meetings held at each of their campuses.ABC 10News asked church leaders to clarify the meeting, and an Awaken pastor said they were holding a prayer protest. At the church’s Balboa Avenue campus, a disclaimer is posted on doors that reads, in part: “By entering this building where COVID-19 virus may possibly exist, despite efforts and attempts at utilizing and employing CDC Public Health Guidelines, you take full responsibility for the decision to attend our services and activities.”A viewer brought a Facebook post by Lighthouse Baptist Church to ABC 10News’ attention. In the post, the Lemon Grove church says, in part: “We are aware of the current mandates of our Governor and County. But, by God’s grace will continue with their current schedule of live worship services on the property.”It’s unclear whether those services will be inside or outside.ABC 10News reached out to both churches for further comment, but neither have returned calls as of late Thursday morning.A woman who asked not to be identified told ABC 10News that her church also invited her back. She said she believes the places of worship that stay open are doing more harm than good.“They want things to be back to normal, everyone does. But they aren’t being realistic about it. I think they need to wait this out and be patient and slow the spread and it will be safer for parishioners, and the community and U.S. at large,” the woman said.As far as the enforcement of the state’s order, if the place of worship falls under San Diego County jurisdiction, it will be up to the sheriff’s department. If it’s within the city, it will be up to the police agency in that city to enforce. 2227

SAN DIEGO (KGTV) — Santas are taking a big hit in 2020 for two big reasons: the pandemic and politics.During a typical December, Santas in San Diego would pop up at events, fundraisers, malls, parties and more. FORBS is the Fraternal Order of Real Bearded Santas, and the group meets and trains year-round to prepare the best Santas for the holiday season. This year, even these pros can’t find work. There are two big reasons for this. The first is one that is impacting most industries right now: the pandemic. Events and parties are canceled, and malls are hurting. At a mall, Santa usually would go through a line of kids, put them on his lap, and ask them what they want for Christmas this year. Now, if Santa is able to meet and greet, face masks and Plexiglas stand in between Saint Nick and the children.RELATED: Out-of-state mall Santas? St. Nicks warn of AB-5 impacts in CaliforniaThe second reason Santas are struggling to find work is Assembly Bill 5. AB 5 was publicized as a bill that would help independent contractors like rideshare drivers, but it also impacts mall Santas. Mall Santas traditionally are hired as independent contractors through third-party bookers or employment agencies. Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego) and passed this year, those workers are reclassified as employees with insurance and other benefits.FORBS members fear companies won’t want to hire Santas as employees.“What’s that mean? It just means Santa is an employee instead of an independent contractor. Santas will be getting a paycheck with holdings taken out of it,” said one Santa. This means Santas who train year-round for this month have to adapt. Some are turning to virtual meet and greets to make ends meet.“Virtual is definitely for me the savior of the year,” said a Santa who recently got booked up with back-to-back virtual greetings. He said he usually makes about ,000 per holiday season, but will be lucky to break ,000 this year, even with the uptick in virtual bookings.Another Santa said he usually works at a mall, but that gig was canceled this year so he’s working as much as he can at Seaport Village, which does have in-person Santa photo opportunities. He said he usually makes around ,000 per season, but will be happy if he breaks ,000 this year. Despite the pay drop, both Santas say they’re thankful to be able to spread a little bit of Christmas joy, and look forward to 2021 when hopefully at least one of their issues will be resolved."Things could be worse. We make the best of what we’ve got."The schedule for Seaport Village in-person photos can be found here. Bookings for a virtual Santa visit though The Santa Experience can be found here. 2737
