VISTA (CNS) - An Oceanside man convicted of abusing his neighbors' dogs, including gouging out the eye of a Siberian Husky, was sentenced to nearly 10 years in custody Friday.Jurors last summer found 37-year-old David C. The dog has never been found and is presumed dead.Police found a small amount of blood in Herbert's car and on a baseball bat he owned.Herbert, who represented himself at trial, testified that Lala jumped in his car and he was about to take her to a shelter when she jumped out and ran off. 1580

(KGTV) --  A California Highway patrol car assisting with construction was hit by a tire just after 8:30 p.m. Wednesday night. The incident, caused when a Chevy Silverado lost a spare tire, happened on the westbound 78 near the Sycamore Avenue, according to CHP. Several people swerved to avoid the tire as it entered the highway, causing at least three crashes. Lanes were closed for a little more than one hour. No CHP officers were injured, but the patrol car was towed from the scene. VISTA (CNS) - An Oceanside man who allegedly fatally struck a pedestrian in a crosswalk while fleeing from another crash was charged Friday with murder, among other charges.Wesley Stuart, 27, was also charged with gross vehicular manslaughter while intoxicated, hit-and-run and drunken driving, and faces 15 years to life in state prison if convicted of all charges stemming from the Tuesday night death of 65-year-old Tran Thanhminh of Oceanside.Police said the initial crash was reported shortly after 10:15 p.m. Tuesday at Douglas Drive and Mission Avenue.RELATED: 65-year-old man killed, driver arrested in Oceanside hit-and-runInvestigators believe Stuart was driving a 2011 Chevrolet Silverado pickup and was speeding eastbound on Mission, ran a red light and collided with a Ford F-150 pickup that was northbound on Douglas, Oceanside police Sgt. Rick Davis said.After the crash, the Chevy driver backed up and headed east on Mission, where he struck Thanhminh in a crosswalk, dragging him about 150 feet down the street, the sergeant said.Thanhminh, who died at the scene, was with his wife at the time, though she was not struck, authorities said.The couple had just closed their restaurant for the day and were walking home when he was hit, according to the San Diego County Medical Examiner's Office, which stated that his wife had already crossed the street when she heard the crash, but did not see her husband when she turned to look into the street.Stuart allegedly continued on Mission before getting out of the pickup at Rancho Del Oro and fleeing on foot with a passenger, Davis said.Officers searched the area with the help of a police helicopter and apprehended the two outside Stuart's home, Oceanside police spokesman Tom Bussey said.Stuart was arrested. The passenger was detained and later released, Davis said.After pleading not guilty to all charges, Stuart will return to court Jan. 2 for a readiness conference. 1947

  

VISTA (CNS) - A man who fired a BB gun at an Oceanside business that had put up a sign supporting the Black Lives Matter movement pleaded guilty today to charges of violating civil rights by damaging property and vandalism.Steve Soto, 23, of Carlsbad, is slated to be sentenced Sept. 28 to one year in county jail stemming from the June 4 shooting that shattered a window at Bliss Tea & Treats.Oceanside police Sgt. John McKean said Soto drove by the business, then fired a BB gun out the window of his vehicle.The business had a sign in the window at the time that read: "Black owned, we stand with you," McKean said.The sergeant said surveillance video helped detectives identify the vehicle used in the crime, leading to Soto's arrest on July 15.He also pleaded guilty to an assault charge related to a May 28 incident involving a male victim and a misdemeanor vandalism count related to an unspecified July 4 incident.He was facing a hate crime allegation stemming from the Bliss Tea & Treats shooting and other misdemeanor charges of discharging a BB gun in a grossly negligent manner stemming from unspecified incidents occurring in June and July, but those counts were dismissed as part of the plea agreement. 1232
