SAN DIEGO (KGTV) - The California Highway Patrol has ruled out street racing and DUI as causes of a crash on Interstate 805 in Sorrento Valley that left a man with serious injuries. Traffic came to a standstill in the northbound lanes of the freeway about 2 p.m. when a silver Mercedes SUV hit the driver of a blue Nissan. Witnesses told the CHP the Nissan suddenly stopped in a lane and the driver got out of the car. CHP says the Nissan became disabled and the driver got out of the car after pulling off to the side of the road. The Nissan’s driver was struck and thrown 135 feet before landing on the pavement. The CHP said the man had severe head injuries. A total of four cars were involved in the resulting pileup. Three people were taken to the hospital, San Diego Fire-Rescue reported, but no one aside from the Nissan's driver was seriously hurt. The other drivers stopped and cooperated with the investigation. The affected lanes of the freeway reopened about four hours after the crash.The Nissan was recently purchased, according to the CHP. SAN DIEGO (KGTV) -- The Carlsbad Police Department released body camera footage Saturday night in response to public concerns over officer misconduct during an incident involving a 27-year-old black man.The June 11 incident gained attention after cell phone video surfaced showing officers using a Taser on the man and pressing his head into the pavement in an attempt to subdue him."A video is circulating showing a police use of force incident from Thursday night. Open lines of communication between the Police Department and the community are more important now than ever," Carlsbad police said in a statement."As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies," police said.The cell phone video doesn't show the start of the incident. The witness video begins with the man on the ground surrounded by paramedics and two officers lying on top of him.The newly released six-minute body cam video starts from the moment two officers respond to the scene. According to the department's timeline of the incident, officers and paramedics responded to a call at 8:48 p.m. about a man found face down on a sidewalk at Ponto Road and Carlsbad Boulevard."Two officers arrived and found the firefighters evaluating the man, who was now standing," police said.Bodycam footage shows the man talking with paramedics, and the group appears to disperse. With the officers approaching, the paramedics step away from the man. The man tells the paramedics, "I'm not complaining about anything else."The man appears to hear something from the group of paramedics and screams out, "are you mocking me?"A paramedic tells the man, "No, I'm not mocking you at all."One officer says, "Hey, they're just here to help you, man."The man stands face to face with the paramedic telling him, "the way he said it is different from how you said it. Because I understand how the f--- you say it. But what do you mean when you say it?"According to the police timeline, "The man walked quickly toward the medics while continuing to yell profanities. Officers, fearing for the safety of the medics, interceded."The report says, "Officers reached out to the man and told him to stop."A struggle ensues and the body cameras are knocked to the ground leaving only an audio recording of the incident for about two minutes. The officers pick up the cameras and resume video recording the scene about two minutes later.The department juxtaposed three camera angles of the confrontation with the man -- two from officer body cameras, and one that was recorded by an unidentified "resident." He was not injured, but he continued to shout angrily. Officers asked him to calm down, but he refused to comply and continued shouting.At 9:03 p.m. Officers considered the man detained.A mesh bag called a spit mask was placed on the man’s head to protect the officers and paramedics from coming into contact with droplets coming from the man’s nose and mouth This bag is porous and does not restrict breathing.At this time, paramedics were able to place the man on a gurney, where he continued to yell and struggle.At 9:07 p.m. Paramedics transported the man to a local hospital where he was sedated, assessed and released.The man, 27-year-old Marcel Cox-Harshaw of San Diego, was cited and released for resisting arrest. An additional charge of drunk in public has been presented to the District Attorney's Office. The initial investigation indicates that drugs and or alcohol played a role in the incident.The investigation is still ongoing. These factors include but are not limited to:o The apparent immediacy and severity of the threat to officers or others – Mr. Harshaw charged unarmed fire personnel while yelling profanities.o The individual’s apparent ability to understand and comply with officer commands – Mr. Harshaw would not comply with officer commands.o The conduct of the individual being confronted, as reasonably perceived by the officer. Mr. Harshaw was yelling and behaving aggressively toward fire personnel.o Proximity of weapons or dangerous improvised devices. – Officers had no way of knowing what was in Mr. Harshaw’s backpack or baggy pants.o The effects of drugs or alcohol. Mr. Harshaw appeared to be under the influence of drugs and or alcohol.o Whether the person appears to be resisting, attempting to evade arrest by flight, or is attacking the officer. Mr. Harshaw was at no time compliant.The TASER device may be used in any of the following circumstances, when the circumstances perceived by the officer at the time indicate that such application is reasonably necessary to control a person:o The subject is violent or is physically resisting. Mr. Harshaw was physically resistant and behaved aggressively toward fire personnel.o The subject has demonstrated, by words or action, an intention to be violent or to physically resist, and reasonably appears to present the potential to harm officers, him/herself or others. – Mr. Harshaw charged fire personnel, while yelling profanities and he was not compliant with officer commands.Supervisory notification shall be made as soon as practicable following the application of force. SAN DIEGO (KGTV) - The family of a man who was hit and killed by an Amtrak train Tuesday night is grieving and hoping he doesn't die in vain.Wentian He, 79, was walking across the train tracks toward the bus stop when he was hit and killed by an Amtrak train, according to his daughter Lilian Zheng. Zheng said her parents were on their way home from shopping.Wednesday, her mother was sobbing, saying she didn't want to live by herself.Zheng said her parents were married 54 years and she saw her dad as a healthy man, young and strong."He really enjoy[ed] learning the streets, the culture, how to behave in this foreign country. He worked really really hard," she said he was part of the Communist Army in China and it took him a while to get 'un-brainwashed'.Her parents emigrated to the U.S. in 2007 and she says they've been enjoying retirement, "They always together go out, they like to go to the senior center, because they can meet new people, they go to the flea market, or small shops so they can find unique stuff."Those trips, now cherished memories.Zheng hopes change can be made at the Washington Street station to protect people like her father. "The two tracks are so close they can cross, there is no [barrier] when Amtrak came, there should be a second gate," suggesting another barrier between the two sets of tracks."I feel life is so fragile, you know he's such a strong father and we've been depending on him," Zheng said tearfully, now they're leaning on each other.Zheng has a sister and niece in China. SAN DIEGO (KGTV) -- The FBI is asking for the public’s help identifying the man who reportedly robbed a San Diego bank. According to the agency, the man robbed a U.S. Bank located inside a Vons grocery store at 665 Saturn Boulevard. The suspect reportedly approached the teller and made a verbal demand for cash, telling the employee he had a gun. The man made off with an unspecified amount of cash. Pictures show the man wearing a hooded Padres sweatshirt and mirrored sunglasses. He is described as a white or possibly Middle Eastern man in his late 20s or early 30s. SAN DIEGO (KGTV) — The helicopter pilot who died when his aircraft crashed in Central California while fighting a wildfire on Wednesday was a former ABC 10News pilot.Michael John Fournier, 52, of Rancho Cucamonga, died when his Bell UH-1H helicopter crashed during a water-dropping mission about 10 miles south of Coalinga, Calif. Fournier was the only person on board, according to the Fresno County Sheriff’s Office (FSO).Investigators were called out to the scene at about 11 a.m., but were not able to make it to the crash site until about 8 p.m. due to the rugged terrain and intense conditions. Once they reached the site, FSO said crews draped an American flag over Fournier's body and carried his body out of the site."One, he was on the front lines helping in an emergency. Two, we did not know if he was former military or law enforcement. We felt it was just the appropriate thing to do," FSO wrote on Facebook.Fournier leaves behind a wife and two daughters. A GoFundMe has been posted here to assist his family with expenses.Fournier was working with Fillmore-based Guardian Helicopters at the time of the crash, according to the Associated Press. Recently, he had flown as part of repair work for Southern California Edison. In the mid to late 1990s, Fournier was a contracted backup pilot for ABC 10News in San Diego for about two years, said Kyle Anastasio. He’s known Fournier for nearly 28 years. He says Fournier was trying to break into the flying industry when they met.Anastasio was the primary Sky10 pilot and taught Fournier how to fly the news chopper.“He was a good pilot,” Anastasio said. “That’s why it’s so devastating.”Anastasio says Fournier went on to have a great career in flying.“He took this whole flying helicopters thing to the moon with all the companies he went to, flew utility work and medevac. He was very well known in the industry,” Anastasio said.He said Fournier loved two things in life: his family and flying.“Mike was a rock-solid individual, a lot of people are missing him right now,” Anastasio said.Timothy Gaughen, a former ABC 10News photojournalist, said working beside Fournier was one of the high points in his career."Fast, efficient, fun, it was always great. It was always enjoyable," Gaughen said. "There's certain people you remember from your career. I still remember it as if it was yesterday ... Just a pleasant, pleasant personality."Gaughen said when it was time to get in the air, Fournier was an absolute professional."He was just a down to Earth person ... but when it was time to get the shot, boom, we were a two-man team," Gaughen said.San Diego is no stranger to wildfires and Fournier worked his share of capturing images from above while at ABC 10News, Gaughen says. He adds that Fournier was a safety-conscious man who loved what he did. "There's something in helicopter pilots, they live and breathe being in the air. He died doing what he loved.
