SAN FRANCISCO (AP) — A California state appeals court has thrown out the sole conviction against an immigrant who fatally shot a woman on the San Francisco waterfront in 2015.The 1st District Court of Appeal on Friday overturned a gun conviction against Jose Inez Garcia-Zarate because the judge failed to instruct the jury on one of his defenses.Garcia-Zarate was acquitted of murder in the killing of Kate Steinle, who was on a pier with her father when she was shot in the back in July 2015.The case of Garcia-Zarate, who was in the country illegally and had been deported five times, touched off a fierce immigration debate.He said he unwittingly picked up the gun wrapped in a T-shirt and it fired accidentally.Garcia-Zarate is in custody and facing federal gun charges. 783

SAN DIEGO, California — With recreational marijuana now legal in California, doctors are warning parents to be extra vigilant when checking their kids' candy on Halloween. They worry that the kids may confuse edibles for candy."There's going to be candy all over the house," says Dr. James Elia from Sharp Grossmont Hospital. "If there are edibles that are in the household and are forgotten to put away, kids may be able to get into them as well."State law allows edibles but has strict guidelines for how much THC can be in them. A package can't contain more than 100 milligrams, and each piece can't have more than 10.Marijuana vendors say new rules also make it harder for the edibles to be confused for candy."You cannot use the word candy and animals cannot be in the shape of certain animals and images that might be attractive to children," says Kyle Dukes from Torrey Holistics. He also noted that state law doesn't allow the edibles to be in any shape the State Bureau of Cannabis Control deems "attractive to children." Specifically, they can't be shaped like fruit, animals or lollipops.Packaging for marijuana-infused food must also be child resistant and clearly labeled.Dr. Elia recommends keeping edibles locked away, similar to the way people treat medicine they don't want kids to get. He says the side effects of THC on children could be devastating."They could experience alteration of mental status, sometimes hallucinations, severe anxiety, severe paranoia," he says. "With children, it's also noted shortness of breath."Elia also says parents should be extra vigilant when checking their kids' trick-or-treat candy, to make sure an edible didn't wind up in their collection."We all have to be concerned about this," he says. SAN DIEGO (KGTV)- This Christmas local chefs and volunteers gave the gift of gourmet meals for those in need. It was a two day process. “Just Call Us” Volunteers prepared the food, from scratch, before serving it to the homeless. The volunteers made enough to feed over 400 people. Early this afternoon, the chefs and volunteers delivered the food to three different shelters. The largest being the Alpha Project tent, in Downtown. “We all appreciate it. They all deserve a good meal,” says a staff member with the Alpha Project. Over a dozen volunteers donated their time at the Alpha Project. More volunteers visited Rachel’s Women’s Shelter and San Diego Center for Children. All of the items are donated from Specialty Produce, Cupcakes Squared and Sprouts Farmers Market. Just Call Us Volunteers gives back to those in need year around. They encourage everyone to come spread a little cheer throughout the year. 925

SAN DIEGO (KGTV)-  Tens of thousands of people in San Diego are on a waiting list for rental assistance.According to the San Diego Housing Commission, the Section 8 voucher program is currently helping about 15,000 families.With the need so great, Team 10 wanted to know if everyone getting help qualifies for a voucher.RELATED: Making It in San Diego: Region needs 143,000 affordable homesUsing information from the San Diego Housing Commission, 10News compared 2017 data on family size and income limits to the maximum annual income limits allowed at the time. The comparison showed more than 20 cases where income was more than what was allowed at the time.Representatives with the housing commission said it is possible for people to be above the limit.  "We also have less than a quarter of one percent of our families who may exceed the 80 percent gross income, and that's a natural progression,” said Azucena Valladolid, Senior Vice President, Rental Assistance and Workforce Development. “Over the course of the time on our program, they may have increased their earnings.”RELATED: San Diego City Council passes affordable housing ordinanceValladolid explained that federal regulations require the San Diego Housing Commission to provide rental assistance to those families for an additional six months before they transition them off of the program.She said someone working for the housing commission determines whether or not someone qualifies for the voucher program. SAN DIEGO (KGTV) -- Dozens of civilian police officers working on San Diego County military bases continue to worry about how they will pay back thousands of dollars the federal government says they owe after a payroll glitch resulted in them being overpaid. Michael Neil, a retired Brigadier General and attorney who also served as commander at Camp Pendleton, says if the officers were indeed paid what they were initially offered they had no reason to suspect anything was wrong. "To me, it's an offer and acceptance and I have a real difficult time seeing the federal government being entitled to get any of the money back," he said. According to the Department of Defense Finance and Accounting services, the Navy mistakenly paid the officers the rate for San Diego  "city" instead of "county". The error began in 2008 but wasn't caught until 2016.Last year, thousands of National Guard soldiers who mistakenly received bonuses and other payments had their debts forgiven. Neil thinks these officers have a stronger case.  In the meantime, Neil also thinks the officers should reach out to lawmakers.Congressman Darrell Issa's office sent this statement to 10News.  1223
