(KGTV) -- A strong warning from the mother of a La Jolla teenager injured in a deadly car crash on the way to Coachella.10News spoke with Eva Cerciello at the hospital where her daughter is recovering. Doctors have taken out her feeding tube and she is now awake.Sadly, her cousin was killed in the crash while the driver walked away with minor injuries. Cerciello says she’s been relying on prayers and positive thinking for strength.As more San Diegans head to Indio for weekend two of the Coachella music festival,Cerciello has a harsh warning that they shouldn’t put themselves in danger.She nearly lost her daughter last week. “She's like a miracle,” Cerciello said. Manuela Cerciello-Rahbari, 16, suffered severe brain damage when the BMW she was in with her cousin and a friend who was driving veered off the road.They slammed into two trees on I-10, 40 miles away from the festival. “Their main goal was to be there at 7 a.m.,” Cerciello said.They left around 3 a.m., but never made it. “The driver fell asleep while driving. They were both asleep, my niece and my daughter,” she said.Cerciello says she even called to warn them. “If you're tired, you need to stop. You don't keep on going,” she said. “You can’t challenge your body.”Their car was part of a caravan with friends and Cerciello feels peer pressure played a deadly role. “I know the kids were texting ‘speed up, speed up’ because we have all the messages.” Now, she's passing along her own message to other parents and their children.“Parents, they think ‘Don't drink. Don't drive. Don't do drugs…and everything will be fine.’ No, not everything will be fine,” Cerciello said.To be clear.. no drugs or alcohol were involved the crash, but she just wants people to see the reality of poor-decision making-- and says be smart.“You will never have the same life again. Never. Never. Because even if physically you are ok, psychologically you will never be the same.”While Cerciello knows her daughter's future is unclear... “I need to be strong. If I'm not strong, who's gonna be strong?”She doesn't want anyone else to experience her pain. "[If] I can help even one person, I’m good with that.” It’s is an eerily familiar situation for Cerciello.Four and half years ago, her son, Carlo, was also in a major accident and suffered brain damage.He is still in physical therapy today.In the meantime, the family has set up a GoFundMe page to help pay for medical expenses as well as research for brain injuries. (KGTV) — A federal judge has denied Stone Brewing's request for a preliminary injunction in its lawsuit against MillerCoors over its Keystone Light product cans.Stone's motion to dismiss MillerCoors' counterclaims were also denied. The injunction would have prevented MillerCoors from using the rebranded cans during trial, according to IP and craft beer attorney Brendan Palfrey. More court documents can be read on Palfrey's Twitter page.Stone Brewing filed the suit against MillerCoors in February 2018, after the beer maker rebranded its Keystone Light products to feature "Stone" on a separate line in bold fashion.RELATED: San Diego's Stone Brewing sues MillerCoors over Keystone cans: 'We will not stand for this'While Stone lost out on the injunction, the judge did say Stone's trademark infringement case is “moderately strong." The judge added that the court agreed with Stone, "especially considering the marks incontestability, [Stone] is entitled to the strong protection afforded to suggestive marks."The case will likely now move to trial.Following the ruling, Stone's cofounder Greg Koch issued a statement, saying the court confirmed their case against MillerCoors.“This is a very big deal. The Court’s order confirms what we knew: that MillerCoors should be ashamed of what they have been doing. All along this has been a clear-cut infringement case, and now we can focus our resources on proving the significant damages done to the good name of Stone Brewing," Koch said.Stone CEO Dominic Engels added, "We are pleased that the Court recognized the validity of Stone’s infringement claims. MillerCoors has made hundreds of millions of dollars from rebranding Keystone in a way that infringes on our trademark. (KGTV and KESQ) - The Santee attorney who was rescued after a fall in Joshua Tree National Park is speaking about the experience.Paul Hanks drove to the park to hike on his 54th birthday last week. He had intended to spend half a day ‘bouldering’ before returning home.Hanks’ plans took a painful turn when he slipped and fell about 20 feet, injuring his leg.“It happened. I slipped and it was just, having not slipped in 45 years, it was instant and total shock,” Hanks said.RELATED: Family details how hiker stayed alive in Joshua TreeHanks crawled for miles, yelling for help. Eventually he settled under a Joshua Tree for the night, hoping he could throw some loose dirt on himself for warmth. Hanks quickly ran out of food and supplies.“By the very first night, I was drinking my own urine. I had drank all of the water in my bottle and was refilling my bottle with my own urine.”Hanks said the decision saved his life. He later found rainwater to drink and ate a cactus.“It gave me some physical energy and it gave me some hope and it made me believe this is giving me the 24 hours I'm looking for,” said Hanks.On Hanks’ fifth day in the park, search and rescue teams found him.“These three angels appeared out of nowhere and I was... I was shocked,” Hanks said. “I just couldn't believe it. I didn't want to say I had given up. Multiple times I had written myself off as dead. That I was never going to see another human being again and they showed up.”The rescue team gave Hanks Gatorade and took him to safety. Hanks is being treated at Desert Regional Medical Center in Palm Springs. Family members say he’ll have several surgeries for fractures on his leg, heel, forehead and pelvis. Hanks is expected to make a full recovery. 1750
