SAN DIEGO (KGTV) -- The brother-in-law of a woman killed in a murder-suicide in Paradise Hills spoke to 10News about her relationship with the father of her young sons.On the morning of Nov. 16, 29-year-old Sabrina Rosario and her four sons were shot by the boys' father in a home on Flintridge Drive, according to San Diego police.Rosario and three of her sons died, and the boys' father -- identified as 31-year-old Jose Valdivia -- shot himself to death after killing the family members.As of Sunday afternoon, Rosario's 9-year-old son, Ezequiel, was in an induced coma at Rady Children's Hospital.RELATED: Parents, 3 children killed in Paradise Hills murder-suicideKarl Albright, Rosario's brother-in-law, told 10News, "No one thinks it's going to happen until it's happened."Albright said he has so many questions about what led Valdivia to gun down his wife and children. According to Albright, Valdivia's infidelity broke Rosario's heart a year ago, and she decided to end things."She had made her mind up that it's over, and he didn't want to accept that," Albright said. "He wanted it back. And he tried to, the love way, and then he tried the fear way, and he tried every way in between to try to break through, but she stood her ground."Albright said Valdivia's threatening texts and stalker behavior escalated six months ago when he bragged about purchasing a gun.Albright explained Valdivia would tell Rosario, "I'm going to come over and kill myself in front of you guys. I'm going to kill you guys, then kill myself."Rosario told him that he sounded like the boy who cried wolf, according to Albright.A records search shows two cases of domestic violence in 2019. On Nov. 15, police said Rosario spent the whole day at court obtaining a restraining order against her husband.When he called that night, she told him she had no other choice. He never called back.Albright said she told him that their problems would be solved, and her children would be safe."Even what they were living in, and what she was going through in the house, she had an umbrella over the kids, and it never fazed them," Albright said.Instead, the next morning, police said the children's father came into the granny flat on Flintridge Drive and shot his wife and four children in the head before shooting himself.Rosario and 3-year-old Enzi died at the home. Five-year-old Zuriel, 9-year-old Ezequiel, and 11-year-old Zeth were rushed to the hospital. SAN DIEGO (KGTV) — The County of San Diego is providing free COVID-19 testing to all school employees returning to in-person learning, a recommendation by the California Department of Public Health.There are more than 80,000 school employees across the county. “This is everybody from bus drivers, to food service workers, to teachers, to administrators,” said Music Watson, the Chief of Staff for the San Diego County Office of Education, or SDCOE.While most schools are sticking with distance learning, for now, some are preparing to return to in-person learning starting in September.The school employees that do return will be tested for COVID-19 often.“The recommendation is that in any given two month period, you’ve tested 100% of school employees, with about half being tested in any given month,” said Watson. “People who are doing distance learning and teaching in a distance format and not coming into contact with students and school staff, they’re not going to have to be tested.”The county is partnering with SDCOE to develop more testing sites specifically for school employees by late September.Testing is currently available at the more than 20 county coordinated sites at no cost to school staff.If positive tests are discovered, classrooms, schools, and districts may need to shut down for two weeks.“If 5% of a classroom tests positive, that classroom would close, and they would self-isolate. If 5% of a school tests positive, the school would close for two weeks, and if 25% of district tests positive, the entire district would close for that two week self-isolation period,” said Watson. “In a classroom, 5% is basically one student or teacher, that’s why it’s so important to have a testing protocol in place.”If a classroom or school does have to shut down, students will continue learning for the two weeks.“That doesn’t mean all of a sudden it’s 14-days of no learning, it means transitioning to virtual which might be online or packet work depending on the particulars of that situation,” said Watson.It’s not currently recommended that asymptomatic children get tested for COVID-19, but if a parent or guardian wants their child tested, they should discuss it with their pediatrician. 2222

SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) - The man who jumped on stage during a Taylor Swift concert and assaulted a security guard was charged Monday with a deadly beating in the Midway area, police said. Christian Ewing, 29, was charged for the death of 57-year-old Gregory Freeman, according to SDPD Homicide Lt. Anthony Dupree. Officers got a 911 call about an assault near the Interstate 5 overpass at 3900 Rosecrans St. the evening of Dec. 5. A witness said a victim was on the ground and another man was hitting him with an object, investigators reported. He died three days later of his injuries. The suspect fled the scene, police said.Ewing was arrested on Dec. 21 for a parole violation and rebooked Monday on suspicion of murder. In 2015, Ewing jumped on stage at Petco Park as Taylor Swift was performing. Swift’s personal security guard, David Durkin, told Ewing he was not allowed to be in the area. During a struggle, Ewing seriously injured Durkin. Prosecutors previously said Ewing had several arrests in multiple states, an active warrant for a theft-related offense out of Florida, and a felony conviction for transporting drugs from out-of-state.
