SAN DIEGO (KGTV) - A Delta passenger mauled by an emotional support dog has filed a lawsuit against the airline and the dog's owner, a Marine combat veteran.In June 2017, Marlin Jackson boarded a San Diego-bound flight in Atlanta headed for a work conference. Soon after, fellow passengers watched in horror as a brutal dog attack played out in front of them.Jackson sat in a window seat. In the middle seat was a Marine veteran was with an emotional support dog, a chocolate lab pointer mix, in his lap. The lawsuit states the dog was briefly restrained, before pinning Jackson against the window and mauling Jackson again, resulting in 28 stitches and permanent loss of sensation in his face. He bled so profusely that "an entire row of seats had to be removed."The incident sparked national headlines, and tighter policies for emotional support and service animals. For example, Delta now requires proof of training, adding rules for the types and ages of the animals, as well the duration of flights that allow emotional support animals.Delta declined to comment citing pending litigation. SAN DIEGO (KGTV and ABC) - Fishermen had a close encounter with killer whales off the San Diego coast that was caught on camera. The group was on a 21-foot boat looking for yellowtail when they came across the orcas. "Out of nowhere, one of them popped up right next to the boat 3 or 4 feet away from me…landed, splashed me, and splashed the whole side of the boat. I screamed,” witness Nathan Benge told Good Morning America. One of the killer whales had a playful interaction, performing a belly roll beneath the surface of the boat’s wake, GMA reported. SAN DIEGO (KGTV) - A former Border Patrol agent was sentenced Wednesday for trying to smuggle drugs across the U.S.-Mexico border while on duty in 2016.Noe Lopez, 37, of Chula Vista, was sentenced to 70 months in prison for attempting to smuggle methamphetamine and cocaine in exchange for cash. He pled guilty to the charges in June 2017.Investigators say the former Border Patrol agent agreed to pick up backpacks containing the drugs from the north side of the border while on duty. Undercover DEA agents used substances resembling drugs in the backpack drops.RELATED: Border Patrol agent arrested in North San Diego County on drug , weapons chargesIn a conversation with an undercover agent, Lopez discussed the area known as "Goat Canyon" as a preferred location, according to investigators, saying "Honestly, the thing is that there aren’t—there aren’t any cameras. SAN DIEGO (KGTV) - A former gang member who turned his life around in stunning fashion just got accepted to four different universities, including UC Berkeley and UC San Diego. 10News first met Apollo in 2010, as he and several others went to court to get off a gang injunction list for an Oceanside street gang.  An injunction prevents gang members from doing activities in certain areas, like associating with each other.  At that time, Apollo told us he had been out of the gang for several years after four years inside as a teenager."What hurt the most is hurting my mother... You want to amount to something, so (when i decided to get out) I'm trying to do this for her," said Apollo.Apollo was removed from the list about a year later, which is a rare feat. Among the requirements: written explanations, background checks, and approval from prosecutors and a judge.Since then, he has gone on to Palomar College, earned awards at speech and debate competitions, and at the age of 30, he just got accepted to four schools, including UC Berkeley and UCSD.  He's leaning towards Berkeley, though he isn't sure he can pay for it.  He's hoping to have a career in communications or social welfare so that he can help his community."Sometimes I can't believe it and sometimes I feel I should be doing more.  You want to leave something for them to look at, to hopefully inspire them to do more and succeed," said Apollo. 1473

SAN DIEGO (KGTV) -- A burst of winter weather is set to move into San Diego County’s mountains early Monday morning, lasting throughout the day. According to the National Weather Service, a cold trough will drop to the southwest Monday, triggering showers along and west of the mountains. The freezing level will fall quickly late in the day, resulting in the possibility of icy conditions on roadways.
