SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. Each business said it has had to undergo significant closures due to the pandemic, despite abiding by public health orders and implementing safety measures to remain in compliance with the orders. 1708

SAN DIEGO (CNS) - An 18-year-old man accused of fatally shooting his live-in girlfriend at their apartment in San Diego's Mountain View neighborhood pleaded not guilty Thursday to a murder charge.Jorge Manuel Sanchez allegedly gunned down 19-year-old Emily Cortez inside an apartment at a residential complex in the 4500 block of Imperial Avenue shortly before 4:30 p.m. July 15.San Diego police Lt. SAN DIEGO (CNS) - Authorities today identified a 19-year-old woman who was fatally shot following a parking lot fight in the Bonita area. Sheriff's deputies responded at 7:40 p.m. Saturday to a report of shooting at an apartment complex in the 5100 block of Cedarwood Road, according to Lt. Thomas Seiver of the Sheriff's Homicide Unit.The initial investigation revealed a fight took place between several women in the parking lot before the victim, identified as Janessa Delvalle, was fatally shot, Seiver said. When deputies arrived, they found people giving her CPR.She was transported to a local hospital, where she was pronounced dead. SAN DIEGO (CNS) - A San Diego man who sexually assaulted three women, some of whom were unconscious during the acts, was sentenced Friday to six years in state prison and ordered to register as a sex offender for life.Juan Carlos Cordero, 37, pleaded guilty in September to three felony sexual assault counts stemming from allegations that he assaulted women he met on dating sites or in person between 2015 and 2019.Cordero pleaded guilty to penetration of an unconscious victim by a foreign object, forcible sodomy and sodomy of an unconscious victim, with each count corresponding to women identified only as Jane Does 1 through 3.RELATED: San Diego women face their accused rapist at preliminary hearingSome of the victims alleged they may have been drugged by the defendant and testified during a preliminary hearing last year that while with Cordero, they blacked out and woke up in his bed, with little to no recollection of the previous night.Many testified that they discovered they'd suffered injuries that led them to believe they had been sexually assaulted.Some women testified they felt drugged the following morning but had no memory of how that may have occurred, while others testified that Cordero forced alcohol or drugs on them.RELATED: Sex assault suspect may have more victims, San Diego Police sayIn addition to the three victims Cordero pleaded guilty to assaulting, testimony also came from several other women alleging he committed similar acts on them, as state law allows testimony from alleged victims of defendants charged with sexual offenses in order to establish a pattern of behavior.Cordero was arrested in March 2019.Following his arrest and the District Attorney's Office filing of felony charges, San Diego police put a call out for any potential victims, stating that Cordero had been known to identify himself as "J.C." to young women in the area. 1895

SAN DIEGO (CNS) - A wrongful death lawsuit was filed Monday on behalf of the family of a 24-year-old woman who died last fall at the Las Colinas Detention Facility in Santee.Elisa Serna died Nov. 11, 2019, a few days after she was booked into the county jail.Earlier this year, the sheriff's department said Serna died from complications of drug abuse, with a contributing factor of early intrauterine pregnancy.The lawsuit filed in San Diego federal court alleges jail staff were aware of Serna's substance abuse and subsequent withdrawal symptoms, but did not provide her with treatment. Though Serna was fainting, had low blood pressure, was vomiting regularly and displaying odd and incoherent behavior, jail staff "ignored the obvious signs of medical distress" and "failed to provide proper medication as Elisa's condition was worsening," the complaint alleges.Sheriff's officials could not immediately be reached for comment on the suit, which names San Diego County and Sheriff Bill Gore as defendants.Plaintiffs in the suit include Serna's parents, Michael and Paloma Serna; her husband, Brandon Honeycutt, and a minor child referred to as S.H.The sheriff's department has come under fire recently over a spate of deaths among county jail inmates, which were referenced within the complaint.The lawsuit cited news reports indicating the county had the highest jail mortality rate among the state's largest counties, and said prior deaths from inmates suffering from withdrawal symptoms should have made jail staff aware of the potentially fatal consequences of those symptoms.The suit also alleges staff are inadequately trained and in-custody deaths at county jails are not being properly investigated."Even though inmates are dying or suffering catastrophic injuries at an alarming rate at San Diego County jails, the medical and correctional staff whose actions or inactions cause the deaths are not investigated; not informed of their failures; not given further training or remedial instruction; and are not monitored or closely supervised after these adverse events," the lawsuit alleges. 2111
