SAN DIEGO (KGTV) - Pint-sized protesters lined the sidewalks outside of Cardiff Elementary School, holding signs reading "BUILD OUR SCHOOL!"The District began construction in June, tearing down old buildings to make room for new ones. The project is being paid for by a million voter-approved bond from 2016.Principal Julie Parker says the school is over 100 years old and that the buildings they tore down were 60-70 years old and outdated. Right now, students are in temporary accommodations. "These are our eight portables, these portables are about ten years over their lifespan now, as you can see they're rusted out."Parker says rainwater leaked into three of the portable classrooms during recent storms. She says the temporary accommodations were only supposed to last a year, but a new lawsuit is now halting the construction progress. "We're continuing to pursue legal avenues in order to make construction continue again because it is obviously detrimental to students who attend school here," said Parker.A group called Save the Park and Build the School filed the lawsuit.Cardiff resident Eleanor Musick is the group's director."We're only asking the District to follow the law, and who more than a public agency should we be able to expect to follow the law? And they gambled. They gambled with our taxpayer money, they gambled with the kids, they tore down all those buildings when they didn't have all the approvals, and they still don't have the approvals," said Musick. Save the Park believes the District had an inadequate environmental impact report, which a judge agreed with. They also allege the school district's plan goes beyond what was initially approved in the bond measure.The group also opposes the construction of a multipurpose building on District-owned land, which is open to the public after hours. The land has federal protections, and Musick says the District only received a conditional approval from the National Park Service to move forward. But the District says it is subject to two straightforward conditions that are in the process of being completed. They add that the California Department of Parks and Recreation Office of Grants and Local Services approval recommends that the National Park Service approve the grant boundary adjustment for the project. Principal Parker says putting the multipurpose room on that land, and separating it from the school, is essential because the building will sometimes need to be accessed by the public for non-school-related functions. Parents say they're frustrated by the lawsuit and don't want to see their kids stuck in temporary accommodations while the legal process plays out. "There's no covered eating area so when it rains their backpacks get wet, they have to eat in their classroom. They have very limited play area. They have no common room to gather in. But we all knew this was the small price, and the expectation was that students would be back in classrooms next year," said Annessa Baird, a Cardiff parent of two.Many parents believe Save the Park's agenda is questionable and that they actually want to protect their ocean views.Musick says that's false and that her view was worse before construction. "One of the first things I tried to argue and plead with the District was don't cut down all the trees. There were some beautiful 75-year-old Torrey pines on that property, and they blocked my ocean view. And they're all cut down now," said Musick.She also says claims that their group is made up of only a handful of people is false and that dozens have contributed to the effort. The District says it's disappointed with the judge's ruling and that it will add to mounting legal fees and project costs.The District intends to ask the Court to reconsider its decision. 3788

SAN DIEGO (KGTV) -- Police Wednesday identified the Border Patrol agents and suspect they say knocked an agent off his ATV before being shot.Agents Micah Owens and Brandon Brandt reportedly shot the suspect, Francisco Javier Gutierrez-Alvarado, during the incident.Alvarado was taken to the hospital with non-life threatening injuries and no agents were seriously injured, police say.RELATED: Man shot by Border Patrol after knocking agent off ATV with rock, authorities sayDuring an initial investigation, authorities learned that a Border Patrol agent was on patrol on an ATV in the area of Spooner’s Mesa when he was hit with a rock and knocked off the vehicle by Alvarado.The suspect rode away on the ATV and was chased by several other agents before losing control and crashing into a fence.During the chase, both agents reportedly shot at Alvarado, striking him at least once. Alvarado is being charged with assaulting a federal officer. The San Diego Police Department is handling the investigation. 1019

SAN DIEGO (KGTV) -- Pro-choice demonstrations gathered outside the federal courthouse in downtown San Diego Tuesday afternoon. The rally was one of hundreds that took place across the country as part of a "Stop the Bans" national day of action. The protests are in response to a law in Alabama that only makes abortion legal when the woman's life is at risk. Several other conservative southern and midwestern states are considering similar measures to restrict access to abortions. "It's a very personal thing, and it's something everybody should have the right to do, to choose yes, I'm going to keep this child or no, I'm not," said Cynthia Knoop. Activists, elected officials, and faith-based leaders chanted, sang songs, and vowed to "not take a step back.""I can't believe we're still fighting this fight and having this discussion. I'm scared for the future generation, the younger women," said Helen Zeldes.Two middle school students also attended. "A child is a ton of responsibility and not every woman wants to, not every woman is financially stable enough to, it should not be in the hands of male senators," said Kate Alberts.The girls said what's happening has been the topic of conversation at their school."Those people who want to have abortions, they can't physically, mentally, take care of a child at ages 16,17, if they've been raped, incest, whatever it is, and it just makes me so sad cause these men are deciding these laws and they don't truly care about the baby once it's born, but when it's a cell," said Marina Nicolaidias.Abortion opponents see what's happening in Alabama and other states as progress. "What we have to remember is that nobody should have the right to take another person's life, and ultimately that's what this is, life begins at conception and when you do have an abortion, you're ending that life," said Marie Frederick, who works with Students for Life and other pro-life groups. Frederick said it's good that a national conversation is happening. "I think when you make a ban on abortion all across the nation; eventually, hopefully, you also need to implement resources for women, support for women I think workplaces need to be more open to women having pregnancies," said Frederick. SAN DIEGO (KGTV) – Monday, community leaders demanded reforms following the release of body camera video showing San Diego police officers shooting a robbery suspect over the weekend.Monday, SDPD said he was in the ICU with life-threatening injuries.“I'm asking for SDPD to put an aggressive plan together to ensure that [with] any officer-involved shooting that within 48 hours to 72 hours a video from the body worn camera footage is released,” said Rev. Shane Harris with the People’s Alliance for Justice.Body camera video released on Sunday by SDPD shows the moment leading up to Saturday's shooting. Police said they were patrolling Downtown when they saw Leonardo Hurtado Ibarra in a red jumpsuit and recognized he was wanted for a robbery.From a street camera, Ibarra is seen reaching in his waistband and raising his arms toward officers. Under Ibarra, body camera footage shows what police said was a gun wrapped in a bandana.“They went in guns blazing and this is not the training that they have,” said community activist Tasha Williamson on Monday. She added that the police should have called for back-up before the confrontation.“People are saying he pointed the gun at the officer and we're simply saying how is that because the officer on video show him running sideways behind the suspect to a cover which was the vehicle,” she said.“They used verbal commands. They followed what their training is and they did an exceptional job,” said former SWAT commander and lethal force instructor Ray Shay when he spoke to ABC10 News on Sunday.“It's unfortunate the gentleman was shot but you'll see that the police officer- after shooting the suspect and getting him handcuffed- immediately calls for an ambulance and here are these two young officers doing CPR to try to save the life of the man who just tried to kill them,” he added.Activists are now urging SDPD to release videos of future shootings as quickly as they did they this time and to release videos before still images.“We want a whole perspective of a situation. Not a half-perspective,” added Harris.Harris also wants the DA’s Office to form a special unit to investigative police misconduct and officer shootings. SAN DIEGO (KGTV) -- More than 24,000 people were left without power due to an unplanned outage in San Diego Tuesday afternoon. The power outage was reported around noon and affected 24,067 people throughout San Diego. As of 7 p.m., the San Diego Gas and Electric outage map showed 3,352 customers without power. Neighborhoods affected include: City Heights, Chollas Creek, Oak Park, Kensington, Talmadge, W State College, Rolando, E State College and La Mesa.
