SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. We are grateful for the Court's comprehensive enforcement of environmental law and look forward to review of an alternative in an EIR that will allow this historic building to survive as part of a successful new project. He has not said what he will do with his newfound wealth. SAN DIEGO (KGTV) -- A group of women is trying to appeal the decision by a judge to release the 'Bolder than Most' rapist, Alvin Quarles. Quarles is set to be released in Jacumba Hot Springs by Nov. 30. The women, including two of his victims, created a petition called Your Voice has Power. They are collecting signatures to be delivered to District Attorney Summer Stephan's office. Cynthia Medina and Mary Taylor were both assaulted by Quarles in the late 1980s. They are worried that he will re-offend when he's released. "He will re-offend. I fear for your daughter, your sister, your grandmother, your mother, your boyfriend, your son," said Medina. Judge David Gill ordered the 56-year-old's release at a hearing on October 12th. He will be forced to wear a GPS tracker. Quarles earned his nickname because authorities said he attacked women at knifepoint while they slept and often forced his victim's male partner to watch or participate in the sex crimes. Jacumba Hot Springs residents call the release outrageous, saying it's not the first time a sexual predator has been released into their community. "It's become the junkyard for these terrible criminals. SAN DIEGO (KGTV) — A Malayasian national faces voyeurism charges after a video camera was discovered in the bathroom of a San Diego flight last May.Choon Ping Lee was arrested this week and charged with video voyeurism within the special maritime and territorial jurisdiction of the United States, ABC-affiliate KTRK reported.Court documents revealed on May 5, a passenger on United Airlines flight 646 from San Diego to Houston discovered a blue light flashing in a first-class bathroom. The woman took the device to the flight crew, who in turn brought it to officials at George Bush International Airport.Security at the airport confirmed the device was a video recording device, KTRK reported. Officials reviewed the device's footage to discover it recorded a man installing it in the bathroom, documents say. Airport surveillance connected the man's clothing with footage of him boarding the plane on departure and leaving when it arrived in Texas.Investigators said they also found footage on the device from another flight, where at least two women were captured on camera aboard an Emirates flight.Lee also works for Halliburton, which provided FBI investigators with Lee's travel itinerary and footage of him wearing the same jewelry as seen in surveillance video as well, documents revealed.The company issued a statement to KTRK, reading: "Halliburton is aware of the situation and is cooperating with the FBI and U.S. Attorney's office in their investigation. We have a robust Code of Business Conduct and expect every employee to abide by the standards contained in the Code and all applicable laws."If convicted, Lee could spend up to a year in prison, face a fine, or both. 1696

SAN DIEGO (KGTV) - A missing former Navy SEAL reported missing earlier this month has been found, according to police.San Diego Police said Johnathan Steven Surmont, 45, was located in Los Angeles during the time he was reported missing.RELATED: San Diego Police searching for missing Navy SEAL veteran"A citizen" called SDPD to tell them Surmont was in Los Angeles, at which point the department's Missing Persons Unit confirmed the information."Although Surmont’s current whereabouts are not known to SDPD, he is no longer considered at-risk or a missing person," the department said in a release.Surmont was reported missing after he was last seen in August, telling his wife he was in a "rough place" in Los Angeles, according to a missing person bulletin from the SDPD. His vehicle was found four days later, on Sept. 3, in La Jolla. 866
