A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

A bus aide with Mesa, Arizona Public Schools has been arrested for the sexual abuse of a preteen boy with autism. Mesa police report that on Tuesday they arrested 18-year-old Samantha Rose Poirier. They say she reported to them that the preteen boy tried to kiss her and asked to see her "girl parts." Police say the victim, who is reported to have the mentality of a 7-year-old, gave a much different story. He says Poirier grabbed both sides of his face and kissed him, then made him touch her breast under her shirt. Police report that they reviewed the bus video and audio recordings, which allegedly show Poirier grabbing the boy’s face and kissing him as the boy described. They say the video also shows Poirier facing the victim and nodding as the victim pulls her shirt down and reaches into it. Poirier reportedly threatened the boy by saying they would both be in trouble if he told anyone about the "kiss and touch." Poirier was arrested for sexual abuse and contributing to the delinquency of a minor. In a statement, Mesa Public Schools said Poirier was hired in August 2017 as a part-time bus aide. She was placed on administrative leave Monday, and dismissed from employment on Wednesday."Mesa Public Schools' first priority is the safety and security of our students," Executive Director Helen Hollands said. "On Friday, March 23, transportation department administration contacted Mesa Police Department when they learned of possible inappropriate behavior between Samantha Poirier and a student. A bus carrying Houston-area band students fell into a 50-foot ravine in Baldwin County, Alabama, early Tuesday morning, killing the driver, police said.The crash and rescue effort closed down Interstate 10 in both directions near the Florida state line.The bus struck a bridge support when it landed in the ravine, and inspectors need to make sure the bridge is sound before reopening the interstate, he said.A wrecker was pulling the bus out of the gulley as Alabama State Trooper Capt. John Malone spoke to reporters."The bus came to rest on one side down in the ravine. Those had to either be brought up by ropes or rappelling individuals from the fire department during the rescue operation. Some were carried out by either deputies or other law enforcement," Baldwin County Sheriff Huey Hoss Mack said, explaining that the depth of the ravine complicated rescue efforts.First Class Tours, which operated the bus, identified the driver as Harry Caligone, a longtime employee of the company"We are deeply saddened for this loss. We offer our heartfelt condolences to his family," the bus company said.Mack said several injured people were taken to 10 hospitals in Baldwin County, the Alabama cities of Mobile, Daphne and Fairhope, and Pensacola, Florida. He estimated there were about 45 people on the bus.Sacred Heart Hospital in Pensacola received 18 of the patients, according to its website.Six or seven Medevac helicopters transported patients to hospitals, the sheriff said. One patient remains critical, he said, and five are in serious condition. The rest of the injured, including a Baldwin County deputy hurt during the extrication process, suffered minor wounds, he said.A video of the crash showed a bus on its side in a grassy aqueduct as rescuers with flashlights scoured the area. Firefighters looked down from a bridge, a line of emergency vehicles lining the road leading up to the bridge.The bus' front axle appeared separated from the vehicle and at least two doors to luggage compartments had been ripped off the side. The roof of the bus also appeared damaged.The bus was traveling west, carrying the students home from Central Florida when it drove into the median on Interstate 10 and then into the ravine at Cowpen Creek, about 5:30 a.m. (6:30 a.m. ET), Mack said.The creek runs through the ravine, and there is water in the creek, but the bus did not land in the water, said Baldwin County Sheriff's Maj. Anthony Lowery.The last victim was extricated from the crash shortly before 9 a.m. (10 a.m. ET), Mack said."The next thing we needed to do was get blankets up here. Of course they were cold. It was 40 degrees this morning."Mark Kramer, a spokesman for Channelview Independent School District in unincorporated Harris County, Texas, said, "A charter bus transporting Channelview High School band students was involved in an accident on Interstate 10 in Alabama early this morning. At this time, details are limited."First Class Tours said in a statement that the bus was carrying students home from Orlando, Florida, and the company is cooperating with investigators."Our prayers are with the injured and their families at this time," the statement said.Baldwin County runs up the eastern edge of Mobile. A man is dead after falling off a ladder while cutting a tree branch following Hurricane Irma.Hillsborough County, Florida Fire Rescue responded to Puritan Road in Tampa, at approximately 2:54 p.m. on Thursday, after receiving a call about a person down.Upon arrival, firefighters found 60-year-old John Knight on the ground.According to a witness, Knight was cutting a tree branch when it hit him and knocked him off his ladder, causing him to fall between 20 to 25 feet.Firefighters pronounced Knight dead at the scene. 559

  

A fire tore through a 2nd-story Chicago home overnight, killing six children, two adults and a dog, the city's fire commissioner said."We have not had this in many, many, many years -- this amount of fatalities and injuries in one location," Commissioner José Santiago said Sunday morning.But if not for the quick actions of a nearby woman who smelled the fire, he said, the outcome could have been even more tragic.The fire started on the 2nd floor of the building, Santiago said.
