SAN DIEGO (KGTV) - A transgender San Diegan is calling for change when it comes to blood donation.Currently, the FDA’s recommendation to blood establishments is that in the context of the donor history questionnaire, male or female gender should be self-identified and self-reported for blood donation.Van Levy of Pacific Beach is non-binary transgender, meaning Van does not identify as male or female. Van goes by gender-neutral pronouns like 'they', 'them', 'their', or just Van.Van tells 10News when they reached out to the San Diego Blood Bank, they were told they would not be able to donate if they could not fully complete the donor history questionnaire, which has two gender-specific questions. Van was told if they cannot fill out 'male' or 'female' on the questionnaire they would not be able to donate blood. “It was really hurtful and painful, it reminded me we haven’t progressed as much as a lot of us like to believe we have, it just hurt," said Van. The two gender-specific questions are, in the past 12 months, have you:Male Donors: Had sexual contact with another male?Female donors: Had sexual contact with a male who had sexual contact with another male in the past 12 months?Helen Bixenman is Vice President of Quality and Regulatory Affairs at the San Diego Blood Bank. She's in charge of making sure blood from the San Diego Blood Bank is safe and pure, free from transfusion-transmitted infections. “It’s important for people to understand we have a wide range of questions, and these questions pertain to the safety of the donor as well as the safety of the blood products. They include medications, how you’re feeling, travel, risk behaviors," said Bixenman.She says they must adhere to the strict regulations and requirements of the FDA and AABB. She says if anyone fails to fill out the entire donor history questionnaire they will be turned away from donating blood.Van wants to see this regulation changed and believes it marginalizes a group of people who only want to help their community. “I definitely understand the rules and regulations that they have to adhere too and I think that there's ways to remove gender from the questions to get to same answers they’re seeking to protect people receiving blood," said Van. Bixenman says the San Diego Blood Bank does not want to turn people away from blood donation. She says this is the first time they've encountered the situation and that she would consider bringing the issue up to advocacy groups and the FDA. 2505

SAN DIEGO (KGTV) - A San Diego woman bought a puppy for her kids. Four hours later, it was dead. Team 10 investigative reporter Jennifer Kastner spoke to local veterinarians who say that a new state law is, in part, to blame. “It was beautiful. It was sweet,” says Enjoli Spaulding of her former Golden Retriever puppy. The San Diego mother of three had been looking for a family Golden Retriever for some time. She checked with formal breeders but the prices were high. “Those dogs are about ,500, minimum,” she tells us. Then she found an adorable Golden Retriever puppy for 0 on a buy-sell website called Recycler.Spaulding, along with her mother, Kathy Pardini, met the seller in a parking lot.“[The puppy] seemed like it had been very loved,” says Pardini. Spaulding adds, “She gave me a vaccination record. She also gave me a bill from the vet when the dog had a physical exam.” The deal appeared to be legitimate, so Spaulding handed over the cash, and they went to surprise her son at school. “He said, ‘Mom, you got me a dog! My very own dog!’ He was just over the moon,” she tells us.The family took the puppy home and played with it in the backyard. “My daughter got her tea set ready,” says Spaulding. Then the playtime took a terrifying turn. Parvovirus suddenly wreaked havoc on the puppy’s bowels and it was bleeding. The puppy was rushed to the hospital, where he was put down. The family was devastated. “The vet told me the dog had been sick for a long time. This was not a new situation,” she tells 10News.“It was surreal,” adds Pardini.Spaulding says the seller would not return her calls. She also discovered that the puppy’s paperwork from the seller was apparently forged. “It was a completely fake document,” she says. She has since filed a police report.Dr. Scott DiLorenzo is a veterinarian and owner of Escondido's Animal Urgent Care. “We have seen an uptick in these cases,” he tells 10News. He says a new California law is part of the problem. It bans pet stores from selling dogs, cats and rabbits, unless they come from shelters or rescues. The law was intended to stop harmful breeding operations like puppy mills. Yet now, consumers aren't always sure where to turn to for specific breeds that they want. “There's just limited sources for people to go out and get the breeds that they want so they're turning to unvetted websites,” adds Dr. DiLorenzo.The American Kennel Club writes, in part, to 10News, "The uptick in this trend corresponds precisely with the implementation of California's new ban on the sale of purpose bred pets at regulated pet shops…”San Diegan Lisa Hexom says she got scammed with a sick dog, too. “I don't want to lose him,” she cries from the veterinary hospital. You have a couple of bad actors that don’t know how to operate the vehicle responsibly,” Zack Bartlett with LimeBike said. “The community seems to be behind the technology.  We’re also in 45 markets, so this isn’t our first rodeo. SAN DIEGO (KGTV) -- After questions from Team 10, organizers of KAABOO San Diego announced it was postponing this year's festival until 2021. Concertgoers told Team 10 they had difficulty reaching anyone for answers. “We all know this isn’t happening, there’s no festival taking place. Please just give us a refund,” said San Diego resident Vince Matthews.Matthews loves music and travels to festivals all across the country. He has been to KAABOO in Del Mar every year since it started in 2015. He spent more than 0 for early bird VIP tickets for this year’s KAABOO festival. “Last year was the first festival ever that I’ve done VIP and once I did it, I realized there was no going back to general admission!”With the pandemic and COVID cases rising, Matthews wanted to know what was going to happen with KAABOO. As more large events got canceled, he was convinced it was likely not going to take place. Still, he had yet to receive any concrete information from festival organizers.“I reached out to them usually every couple weeks by email,” Matthews said. “I get the same form email that says please be patient."Patience was running out. As of Monday early afternoon, the last update posted on KAABOO’s social media accounts was June 15th. It said, in part, that they “will need just a little more time to determine our position as it relates to this year’s installment of KAABOO.” It told fans they would be hearing from KAABOO shortly.Matthews is frustrated by the lack of communication as we now head into the month of August.“There's nobody touring, there is no festival, there is no lineup. It's not going to happen,” Matthews said.KAABOO is under new ownership. It was announced last year that Virgin Fest was taking over the brand. In addition to the new ownership, the festival was moving from the Del Mar Fairgrounds to Petco Park.As of Monday morning, it still listed the September festival dates on its website.Team 10 contacted Virgin Fest founder Jason Felts. On Twitter, he told investigator Melissa Mecija that emails went to “ticket buyers last week about a possible scaled down social distanced version for 2020.”However, he determined with cases increasing that it wasn’t “a safe decision in the end and not the multi-sensory experience that KAABOO guests experience or deserve.”Team 10 spoke to four people who bought tickets. Nobody received the email that the festival claimed to send to ticketholders.KAABOO organizers released this statement to ABC 10News: With everything in the world moving so far and fast in just the last couple of weeks, we needed a little bit of extra time to be sure we were making the right go-forward decision for our beloved festival. Unfortunately, it is not the best news... We are postponing the 2020 installment of KAABOO San Diego.After much consultation with stakeholders in local government, artists and music industry friends, and members of the San Diego community, we know it is safest and best for everyone to look ahead and plan a bigger and bolder edition of KAABOO for September of 2021.All current pass holders will receive an email in the next few days outlining a special offering for those who choose to hold their passes for KAABOO 2021. SAN DIEGO (KGTV) — An Ohio man accused of pepper-spraying 11 San Diego Police officers during a demonstration last month has pleaded not guilty.Denzel Draughn, 28, pleaded not guilty on Wednesday to felony counts of unlawful use of tear gas against a peace officer and 11 felony counts of use of force against a peace officer.On Aug. 28, a group of demonstrators protesting the shooting of Jacob Blake in Kenosha, Wisc., marched through downtown San Diego.See Sky10 video of the demonstration below:Police say that as the group neared 9th and E Streets, a vehicle that was following the group failed to stop at red lights. After police stopped the driver, a crowd began to form near the car and officers who pulled the vehicle over.SDPD says that the group ignored demands to back up from the scene, prompting one officer to pull out pepper spray. Police say one person tried to knock the pepper spray out of the officer's hand, forcing the officer to discharge the spray.Several police officers then tried to arrest the person. As the officers were placing the person in custody, a pepper spray canister fell on the ground. Officers say Draughn picked up the canister and sprayed it twice, hitting 11 officers.SDPD says Draughn fled but was later found and arrested.If convicted, Draughn faces probation to 11 years in jail. He was released on 0,000 bail Wednesday evening."Peaceful protest is a time-honored tradition in our country, and now more than ever it’s critical that we protect an individual’s important First Amendment right.
