This decision means that some people facing flawed deportation orders can be forcibly removed with no judicial oversight, putting their lives in grave danger," Gelernt said.The justices ruled in the case of man who said he fled persecution as a member of Sri Lanka’s Tamil minority, but failed to persuade immigration officials that he faced harm if he returned to Sri Lanka. WASHINGTON (AP) — For decades, there were tales from fishermen and tourists, even lots of photos, of a mysterious killer whale that just didn't look like all the others, but scientists had never seen one.Now they have.An international team of researchers says they found a couple dozen of these distinctly different orcas roaming in the oceans off southern Chile in January. Scientists are waiting for DNA tests from a tissue sample but think it may be a distinct species.The National Oceanic and Atmospheric Administration felt confident enough to trumpet the discovery of the long rumored killer whale on Thursday. Some outside experts were more cautious, acknowledging the whales are different, but saying they'd wait for the test results to answer the species question."This is the most different looking killer whale I've ever seen," said Robert Pitman, a NOAA marine ecologist in San Diego. He was part of the team that spotted the orcas off Cape Horn at the tip of South America.How different? The whale's signature large white eye patch is tiny on these new guys, barely noticeable. Their heads are a bit more rounded and less sleek than normal killer whales and their dorsal fins are narrower and pointed.They likely mostly eat fish, not marine mammals like seals, as other killer whales do, Pitman said. Fishermen have complained about how good they are at poaching off fishing lines, snatching 200-pound fish away.Pitman said they are so different they probably can't breed with other killer whales and are likely a new species. At 20 to 25 feet long (6 to 7.5 meters), they are slightly smaller than most killer whales. In the Southern Hemisphere, killer whales are considered all one species, classified in types A through C. This one is called type D or subantarctic killer whales.Michael McGowen, marine mammal curator at the Smithsonian, said calling it a new species without genetic data may be premature. Still, he said, "I think it's pretty remarkable that there are still many things out there in the ocean like a huge killer whale that we don't know about."Scientists have heard about these distinctive whales ever since a mass stranding in New Zealand in 1955. Scientists initially thought it could be one family of killer whales that had a specific mutation, but the January discovery and all the photos in between point to a different type, Pitman said.He said they are hard to find because they live far south and away from shore, unlike most killer whales."The type D killer whale lives in the most inhospitable waters on the planet. It's a good place to hide."Pitman got interested in this mysterious killer whale when he was shown a photograph in 2005. When he and others decided to go find them, they followed the advice and directions of South American fishermen, who had seen the whales poaching their fish.After weeks of waiting, about 25 of the whales came up to the scientist's boat, looking like they expected to be fed. Equipment problems prevented the scientists from recording enough of the whale songs, but they used a crossbow to get a tissue sample. Pitman said the whales are so big and their skin so tough that it didn't hurt them, saying the arrow "is like a soda straw bouncing off a truck tire."Pitman said he'll never forget Jan. 21 when he finally saw his first and then a bunch of the type D orcas."For 14 years I was looking for these guys. I finally got to see them," Pitman said.He acknowledged that he did sound like the revenge-seeking captain in the classic novel "Moby-Dick.""I guess I know how Ahab felt, but for a good reason," Pitman said. 3606

VISTA, Calif., (KGTV) — The man and woman accused of fatally stabbing a Carlsbad woman in March appeared at their preliminary hearing on Wednesday. Ian Bushee and Malissa James pleaded not guilty to all charges, including murder and burglary. The District Attorney called several witnesses, playing 911 calls and never-before-seen police body camera footage in the courtroom. The 911 call was from the victim, Marjorie Gawitt.Dispatcher: 911. What's your emergency?Marjorie: (inaudible) I've been attacked. That was the beginning of Gawitt's dying message on the morning of March 11, 2019. The 63-year-old woman was sleeping in her Carlsbad home alone when police said Bushee and James tortured and stabbed her fifty times in the face, neck, and back. Dispatcher: We've got help sent out to you, Marjorie. Who did this?Marjorie: I don't know. It took everything Gawitt had left in her to make that 911 call. The call was so tragic, officers testifying on the stand became choked up while listening to Gawitt's voice. Because of her final act of courage, Officer Randy Noa found her minutes later, still alive. On his body camera video, you can hear him trying to speak to Gawitt."You okay ma'am? Oh. Ma'am. Is he still in here or did he leave? (PAUSE) I can't hear you, ma'am," Officer Noa said, breathing heavily."It looked like she was trying to say to me that he was gone. But it was hard," Officer Not testified inside the courtroom. The District Attorney also played a second body camera video, worn by Officer Derek Harvey. On it, you can hear him trying to console the victim. "Ma'am, you're going to be okay. The paramedics are going to be here, any second, okay?" Officer Harvey said. Minutes later, Harvey's camera recorded him finding what looked to be the weapon on the counter."Her eyes were clouded, dilated and fixed," Officer Harvey said. "I knew she was... probably not going to make it." He was right. Despite the paramedics arriving quickly, Gawitt died at Scripps La Jolla Hospital. With the only eyewitness now gone, investigators were back at square one. What they did know was that the victim's gold car was missing, so they worked to track that down. Hours later, surveillance video captured the victim's stolen car in San Marcos. The suspects were taped walking around near a masonry warehouse and at a 7-11 store. Investigators said the two later ditched the stolen car in San Marcos, and for some reason, rode a bus back into Carlsbad. The two were later arrested near the original crime scene. Police said it turns out Gawitt's home was not the first the pair had ransacked that day. "I looked up, and I said something is missing here," neighbor Patricia Gapik said. That same morning, Gapik noticed her sewing basket and her daughter's flute were gone. Random items were also scattered near her sliding glass door. "I then realized that someone was in my house," Gapik testified. "I was scared."Luckily, Gapik was asleep the entire time, and never confronted the burglars. But investigators later found that the two cases were connected. They found some of Gapik's belongings inside the car left in San Marcos. The suspects, Ian Bushee and Malissa James were the same. Thursday morning, the Medical Examiner will be giving his testimony on Gawitt's fatal injuries. 3303

  

VISTA, Calif. (KGTV) — A double shooting in North County has left one woman dead and a man hospitalized Saturday.A caller reported two people suffering from gunshot wounds, one was not breathing, at a home in the 1800 block of Hartwright Road just before 7 a.m., according to San Diego County Sheriff's Department.Deputies and Vista Fire personnel arrived to find one woman with a traumatic gunshot wound. She was pronounced dead at the scene. A man suffering from a suspected gunshot wound was transported to a nearby hospital with "severe" injuries, deputies say. Deputies said his prognosis is unknown.The San Diego County Medical Examiner has not released the identity of the woman pending family notification. Sheriff's investigators were still investigating the cause of the shooting Saturday.Anyone with information connected to the shooting is asked to call the Sheriff's Homicide Unit at 858-285-6330 or Crime Stoppers at 888-580-8477. 952
