SAN DIEGO (KGTV) — The City of San Diego could go to court to invalidate a landmark pension reform measure that voters overwhelmingly supported in 2012.The City Council is expected to meet in closed session the week June 10 to decide whether to ask a judge to throw out Measure B. The measure switched most new hires from pensions to 401(k) style retirement plans. More than 65 percent of San Diego voters supported Measure B in 2012. The problem, however, is that the measure got to the ballot via a citizens initiative, but then-Mayor Jerry Sanders campaigned on its behalf. Labor unions challenged the initiative in court, contending the mayor's involvement meant the city needed to meet and confer with them. The state Supreme Court agreed, and an appellate court ordered the city to make its employees whole, plus pay them 7 percent interest. The courts, however, did not invalidate Measure B, instead directing the city to work out a compromise with the unions. On Thursday, City Councilman Scott Sherman and former Councilman Carl DeMaio held a news conference pushing the city to protect Measure B."Right now we are being asked to go against what our bosses told us, and I don't think we should do that," Sherman said, adding that the city spends 0 million a year now meeting its minimum pension obligations. DeMaio said he would work with a coalition to go to court to protect Measure B. "I'm talking about putting the City of San Diego back on the brink of bankruptcy, let alone telling voters that they don't have a say on where their tax dollars go," he said. Early estimates indicate the amount needed to make employees whole ranges from negligible to million.Michael Zucchet, who heads the Municipal Employees Association, said the only rational way to move forward is to invalidate Measure B."It is time for the City and its citizens to move forward by ending the Prop B debacle with the least amount of additional litigation and expense, and at the same time help address the City’s severe recruitment and retention challenges brought about because San Diego is the only City in California with no defined benefit pension nor Social Security benefits for newly hired employees," Zucchet said in a statement.Mayor Kevin Faulconer said in a statement he would oppose any effort to get rid of Measure B. "Voters demanded pension reform and we should respect that, plain and simple," Faulconer said. The mayor cannot vote, however, in the decision facing the City Council. 2500

SAN DIEGO (KGTV) -- The brother-in-law of a woman killed in a murder-suicide in Paradise Hills spoke to 10News about her relationship with the father of her young sons.On the morning of Nov. 16, 29-year-old Sabrina Rosario and her four sons were shot by the boys' father in a home on Flintridge Drive, according to San Diego police.Rosario and three of her sons died, and the boys' father -- identified as 31-year-old Jose Valdivia -- shot himself to death after killing the family members.As of Sunday afternoon, Rosario's 9-year-old son, Ezequiel, was in an induced coma at Rady Children's Hospital.RELATED: Parents, 3 children killed in Paradise Hills murder-suicideKarl Albright, Rosario's brother-in-law, told 10News, "No one thinks it's going to happen until it's happened."Albright said he has so many questions about what led Valdivia to gun down his wife and children. According to Albright, Valdivia's infidelity broke Rosario's heart a year ago, and she decided to end things."She had made her mind up that it's over, and he didn't want to accept that," Albright said. "He wanted it back. And he tried to, the love way, and then he tried the fear way, and he tried every way in between to try to break through, but she stood her ground."Albright said Valdivia's threatening texts and stalker behavior escalated six months ago when he bragged about purchasing a gun.Albright explained Valdivia would tell Rosario, "I'm going to come over and kill myself in front of you guys. I'm going to kill you guys, then kill myself."Rosario told him that he sounded like the boy who cried wolf, according to Albright.A records search shows two cases of domestic violence in 2019. On Nov. 15, police said Rosario spent the whole day at court obtaining a restraining order against her husband.When he called that night, she told him she had no other choice. He never called back.Albright said she told him that their problems would be solved, and her children would be safe."Even what they were living in, and what she was going through in the house, she had an umbrella over the kids, and it never fazed them," Albright said.Instead, the next morning, police said the children's father came into the granny flat on Flintridge Drive and shot his wife and four children in the head before shooting himself.Rosario and 3-year-old Enzi died at the home. Five-year-old Zuriel, 9-year-old Ezequiel, and 11-year-old Zeth were rushed to the hospital. Zuriel and Zeth did not make it.Life will never be the same for relatives who live next door."Now that Thanksgiving is coming up and Christmas. We've already got Christmas gifts for the kids and for her," Albright said.Those gifts will remain under the tree in their honor."They were fun-loving. They were well-raised. SAN DIEGO (KGTV) -- The man accused of assaulting a Pacific Beach woman while she slept in her own home was in court for the first time on Monday. Jeffrey Hanze pleaded not guilty to the charges, which include sexual assault during a burglary. The 55-year-old was arrested in L.A. County on October 29th for the crime. Police say Hanze broke into a home in Pacific Beach on October 1st, getting in through an open window, then assaulting a woman while she slept. The woman woke up to the assault and Hanze got away.On Monday, the judge agreed to increase his bail from 0,000 to a million dollars and issued a protective order for the victim. A background check shows Hanze has a criminal record, including two felonies in San Diego County and several sex crimes dating back to 2011 in Arizona. Hanze is due in court again on November 15th.    913
