The founder and CEO of a fitness business in Phoenix says he intends to file a lawsuit against Governor Ducey in response to his executive order closing select businesses.The executive order said that as of 8 p.m. Monday night, gyms, bars, waterparks and tubing areas will all have to close to try to help slow the spread of the coronavirus.Tom Hatten, Mountainside Fitness CEO, said during a press conference Monday that the governor’s move is "arbitrary" and lacks clarity.“If this is truly as bad as we are being told, I don’t think health clubs closing tomorrow is going to solve the problem. I don’t think tubing is going to solve the problem,” Hatten said. “I don’t think closing a movie theater that hasn’t been open is going to solve the problem.”Hatten also called for unity from the governor, saying that if the governor is serious about coronavirus, the executive order shouldn't be limited to bars, gyms, and movie theaters.A representative for Mountainside Fitness says several other large gyms are taking part in the lawsuit as well, though that has not been confirmed with the other gyms.Dozens of members showed up to work out at Mountainside Fitness as soon as it opened Tuesday morning.Those like John Kiesewetter say they agree with the CEO's reasoning to remain open if other businesses aren't also forced to close. He says regular physical activity puts them in a better position to beat the virus."It seems to be unfair that things like casinos are still open but gyms, they are not. So, anyone who's healthier, who keep our distance, are the people who go to the gym and clean our equipment, so I think it was the right decision," Kiesewetter said.Governor Ducey said Monday that local authorities will have the ability to enforce the new rules, with a focus on educating the public.This story originally appeared on abc15.com. 1859

The Department of Veteran's Affairs (VA) is facing a huge undertaking as COVID-19 vaccines roll out to the general public.More than 418,000 healthcare workers and 10 million patients will eventually get the COVID-19 vaccine through the VA.The department received 73,000 doses of Pfizer's COVID-19 vaccine this week, and residents and staff at long term communities run by the department are first in line to be inoculated.There are about 17,500 veterans living in VA long-term care facilities across the country, and several thousand more work in those centers.The vaccine could not have arrived sooner for those staff members and patients."I know a lot of VA medical centers are going through COVID surges right now, alongside with their communities," said Dr. Jane Kim, the Chief Consultant for Preventive Medicine at the VA.Most vaccines are mandatory for military members. For now, the COVID-19 vaccine is still voluntary. That's likely due to the limited supply of the vaccine and because it's only under Emergency Use Authorization right now.Still, veteran doctors want to reassure their patients."I got the vaccine yesterday," Kim said. "I had a sore arm yesterday, but my arm feels good today. I feel fine today. I would recommend this vaccine to my family and also my patients when it's available for them and it's their turn."More than 5,500 veteran patients and 87 VA staff members have died of COVID-19 since the start of the pandemic. That doesn't include state-run veteran's homes.The VA is not responsible for providing COVID-19 vaccines to those state-run veteran's homes. 1596

The Department of Justice this week is sending a strong message to American cities: if you can't stop crime, federal agents may be on the way.On Wednesday, Attorney General William Barr announced the launch of "Operation Legend" — named after a 4-year-old boy, LeGend Taliferrom, who was shot and killed while he was sleeping in Kansas City last month.Kansas City is one of several American cities dealing with an uptick in crime. According to the Department of Justice, violent crime is up 40% since last year, with at least 100 murders so far this year.The New York Times recently reported the top 25 largest American cities had seen a 16% increase in murders in recent months.What is "Operation Legend?"The mission will send around 100 FBI, ATF and DEA agents, as well as some U.S. Marshals, to Kansas City to aid in crime prevention.Agents are not expected to assume command of active investigations but rather serve as a deterrent to violent crime."Operation Legend will combine federal and local resources to combat the disturbing uptick in violence by surging federal agents and other federal assets into cities like Kansas City, a city currently experiencing its worst homicide rate in its history," Barr said in a statement.Kansas City will not likely be the last place federal agents go. The Department of Justice on Monday filed complaints against 11 individuals believed to be members of the?Central American migrant caravan, accusing them of illegally entering the United States.After a month-long journey by bus, train and on foot, about 100 migrants arrived at the San Ysidro port of entry on the US-Mexico border on Sunday evening, preparing to claim asylum. About 20 to 30 migrants spent the night inside an immigration processing center in Tijuana, Mexico.An organizer of the caravan vowed they would remain at the immigration processing center until "every last one" is admitted into the United States.Two Salvadorans, six Hondurans, and three Guatemalans face charges, a federal law enforcement official told CNN.Ten of them face a misdemeanor charge for allegedly entering the US illegally. Another individual is alleged to have entered the country after they were previously deported, and faces a felony charge.The probable cause statement alleges many of those charged were seen in an area known as Goat Canyon, about 4 miles to the west of the San Ysidro port of entry, on the US side of the border, the official said. Others were seen on the US side of the border about 2 miles west of San Ysidro in an area known as "W-8." 1263

  

The Dallas Police Department said on Tuesday evening that two of its officers and a civilian loss prevention officer were shot at a Dallas Home Depot. The Dallas Police confirmed earlier in the evening that the two officer were in critical condition. Dallas Police Chief Renee Hall said late Tuesday evening that all three victims are out of surgery in a Dallas hospital. "We're asking for your continued prayers for them and their families," Hall said. The shooting reportedly took place around 4:11 p.m. local time.  In a press conference, police identified Armando Juarez, 29, as a person of interest. He is believed to have left the incident driving a white pickup truck. Around 9 p.m. local time, Juarez was arrested after a car pursuit involving Dallas Police and a white pickup truck.Hall said that Juarez will be charged with multiple counts of aggravated assault on a police officer, and also had an outstanding warrant for his arrest. A female passenger in Juarez's truck was also detained after the chase, Hall said. In 2016, Dallas experienced one of the deadliest ambushes on law enforcement in recent US history, as five officers were shot and killed while patrolling a Black Lives Matter protest.  1285
