SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. SAN DIEGO (CNS) - A woman was killed when she walked into the path of two marked police cruisers in the Hillcrest community of San Diego, police said Sunday.The vehicles were going westbound in the 100 block of West Washington Street when the woman, standing on the north curb line of the street -- and not in the crosswalk -- walked into the cruisers' path a little after 11 p.m.Saturday, the San Diego Police Department reported.She was struck by both cars and rushed to UC San Diego Medical Center, where she was pronounced dead. 540

SAN DIEGO (CNS) - A man waiting for an Uber was stabbed in San Diego Sunday morning, according to San Diego police.At 2:08 a.m., a 37 year-old male was waiting for his Uber ride on the corner of 8th Avenue and B Street when he was approached by two female suspects and a male suspect, all in their 20s. The victim began talking to one of the women when she reached into his pocket and stole his cellphone. The suspects ran away and the victim chased them. After he caught up with them, the male suspect turned and jabbed the victim in the right arm.The victim began to bleed and witnessed the three suspects running away and getting into a red Chevy Camaro that fled westbound on B Street. SAN DIEGO (CNS) - A man who allegedly gunned down another man during an altercation in Lincoln Park pleaded not guilty today to a murder charge. Michael Ortiz, 31, is accused in the Nov. 7 killing of 25-year-old Eziquio Ruiz-Saucedo of National City. Ortiz faces 50 years to life in state prison if convicted of murder and an allegation of discharging a firearm in the killing.Police received reports just after 9 that night of gunshots fired in the parking lot of a shopping center at 300 Euclid Avenue, SDPD Lt. Andra Brown said. According to the lieutenant, the men were involved in a physical fight and at some point, a handgun was brandished and both men were shot.At Ortiz's arraignment, Deputy District Attorney Jeff Dort alleged that Ortiz brought a gun to ``what was probably going to be a fistfight.'' The prosecutor said Ortiz was shot with the same gun used to shoot the victim, but did not elaborate on how that occurred.Ruiz-Saucedo died at the scene, and Ortiz was hospitalized with non- life-threatening injuries, police said.Ortiz was being held on million bail and his next court date is a Jan. 12 status conference. 1145
