CORSICANA, TX — Three juveniles in Texas have been arrested on felony charges after allegedly drinking from two juice bottles inside a Walmart store then putting them back on the shelves.The Corsicana Police Department says around 10 p.m. on August 23, officers were made aware of a Facebook post that showed a video of a suspect taking a drink from two separate juice bottles then putting them back on the shelves at Walmart.Walmart's management removed the products from the shelves as soon as they were made aware of the incident.All three suspects were identified and taken into custody. Some of the language echoes President Trump's anti-media messaging. The Ohio Department of Health's "Stay at Home Order" specifically includes "distributors of medical equipment."In a recorded message to its employees, workers are being told, "We are happy to report AmeriMark will remain in operation during this period...in this unparalleled time, we are excited to serve AmeriMark customers."The company has not yet responded to our inquiry."My concern is that there are a lot of elderly women working here," said another worker concerned about passing the virus from person to person.The State's StanceDuring Tuesday's news conference, Lt. Governor Jon Husted acknowledged confusion over the definition of an "essential business" and referred employers to Ohio's coronavirus website."It's written in plain language, we ask you to follow the language and use your best judgment," said Husted. "We make one type of envelope for the postal service--I'm afraid of losing my job if I don't show up."A news release issued by by the company on March 17, said "precautionary measures have been put in place at both our office and manufacturing facilities as we continue to operate in our regular course of business."Cenveo, based in Stamford, Connecticut, identifies itself as a "world leader in the management of print and related offerings" and has not yet responded to our inquiry.Essential Crafting?Even craft stores, like Michaels and Joann Fabric and Craft Stores continue to remain open despite health concerns among employees."Crafting is non-essential," said one Michaels employee. "Are they above the rules?"A company release addressing the COVID-19 outbreak said "we are taking precautionary measures to ensure our corporate offices, stores, distribution centers and other facilities minimize the risk."In a message to Joann customers, the company said "now more than ever it is important to safely provide what these Americans need to support their livelihood, mental wellness and community giving."Among those items, the company is encouraging customers to help make "protective non-surgical masks and gowns during this critical time."The company adds that it is "taking action to ensure we are protecting our facilities, customers and teams across the nation."Ask Sherwin WilliamsA worker at a Sherwin Williams paint plant in Massillon asks, "Since when is bodyfiller and paint essential? Complaints are growing nationwide about workplace safety issues related to coronavirus. The Occupational Safety and Health Administration, or OSHA, has received more than 6,500 nationwide on a federal level since February.One trial lawyer who works in employment law says she expects the number of complains will keep going up.“Where I really think the numbers are going to escalate is in the retaliation world, where employees bring issues to their employers' attention about failing to implement appropriate administrative or engineering controls or social distancing measures and then they feel that they have suffered an adverse employment action as a result of bringing this to their employer's attention,” said trial lawyer Laura Lawless.OSHA recently updated its guidance on COVID-19-related workplace safety. It now suggests wherever possible and feasible employers should require masks at work.This guidance is something Lawless says everyone was waiting on. She says for states or cities that already had a mask mandate it was easier to enforce at work already, but for states that don't have this mandate, it was harder until now.“At least you can now turn to CDC guidance and OSHA guidance as an employer and say look even if you disagree with us for a political reason or personal expression reason, we're following the guidance from agencies that are meant to look out for your health and safety,” said Lawless.Still, there are concerns OSHA isn't going far enough in other areas. One big criticism among employee protective organizations, workers organizations and unions is that OSHA’s guidance on COVID-19 isn't a regulation and doesn't really have any teeth.Virginia and Oregon are two states looking to fill in the gap with their own worker protections.If you see issues in your workplace, the employment lawyer recommends being reasonable in your approach and not getting too emotional in your reaction. The team went to work.Wide-awake brain surgery might sound like a nightmare to many, but it was the only way doctors at Jewish Hospital's Brain Tumor Center could remove the tumor that had stolen Alley's sense of taste without damaging the vital tissue nearby."Of all the places to pick, it's kind of right in the spot you wouldn't want it to be," DiNapoli said, gesturing to a scan of Alley's brain in which the tumor stood out as a circular mass of solid white.Even a slight mistake could permanently rob her of her ability to produce spoken or written language — and, if she were fully anesthetized, her team might not know until she woke up."I knew he needed me to talk to do his best job, so I talked the whole time," Alley said months later, laughing. "There was never a time where I was like, ‘We need to stop,' and I started freaking out. It was very smooth.
