SALT LAKE CITY, Utah -- A Salt Lake City K-9 officer has been charged with aggravated assault in connection with an April 24 incident.Officer Nickolas John Pearce, 39, responded to a report of domestic violence that day. Pearce is accused of commanding his K-9, Tuco, to bite Jeffery Ryans, even though Ryans was on his knees and had his hands in the air."When K-9 Tuco engaged and was biting Ryans, [Pearce] continually praised and encouraged K-9 Tuco," a probable cause statement said. "While he was being attacked by K-9 Tuco, Ryans expressed extreme emotions reflective of pain from being bitten by K-9 Tuco and plead with the officers to stop the biting. He questioned why he was being attacked when he was not resisting."Ryans suffered large lacerations and required hospitalization for his injuries. After receiving treatment for his injuries, Ryans was booked into the Salt Lake County Metro Jail on a charge of violating a protective order. In an interview with KSTU on Wednesday, Salt Lake County District Attorney Sim Gill said they looked to see if the force used was reasonable."And in this case, the conclusion of our attorneys when we reviewed the body cam video, we looked at the reports that were generated, and we could find no lawful reason to use that police dog in the fashion that it did and resulting in the injury caused on Mr. Ryans," Gill said.(Warning: the following body camera video contains graphic language and violence) 1458

SAN DIEGO (CNS and KGTV) - San Diego's City Council voted 6-3 Tuesday night to place restrictions on sleeping and living in vehicles on city streets and parking lots. The vehicle habitation ordinance goes into effect immediately and restricts people from living in their vehicles anywhere within 500 feet of a school or residence. It also places an overnight ban between from 9 p.m. to 6 a.m. anywhere in the city, with the exception of approved lots. According to a news release from the city, the ordinance aims to address illegal dumping, public urination and drug use on city streets and in parking lots. “We are creating a balance that provides opportunities to those in need while protecting our neighborhoods from behavior that creates unsanitary conditions and hurts quality of life,” Mayor Faulconer said. “If you want to work toward finding a permanent home, we have programs that can help. We will not allow the proliferation of ‘van life’ culture that takes advantage of San Diego’s generosity and destroys community character.”The ordinance will be enforced using criteria including sleeping, bathing, meal preparation, grooming items and containers of human waste. Councilmember Monica Montgomery, who voted against the ordinance, released a statement after the vote expressing disappointment. 1315

SALEM, Mass. (AP) — A lawsuit filed by the Satanic Temple alleges an advertising company unfairly refused to display billboards promoting a ritual offered by the group to help people bypass abortion rules in some states. The group, based in Salem, Massachusetts, announced Wednesday that it sued Lamar Advertising in Arkansas state court for alleged religious discrimination. The Louisiana-based company did not immediately respond to a request for comment. The Satanic Temple says Lamar refused to display eight billboards in Arkansas and Indiana promoting what the group calls its “religious abortion ritual.” The Satanic Temple describes the ritual as a “sacramental act that confirms the right of bodily autonomy.”By performing the ritual, the group says, people can claim a religious exemption from mandatory waiting periods, counseling, ultrasounds and other measures that some states require before an abortion can be performed. The group says it submitted five designs to Lamar to be displayed near crisis pregnancy centers. In one of the images, a bowl of cake batter is shown with the text, “not a cake,” next to an image of a sperm and egg with the text “not a baby.” It’s accompanied by text saying, “Our religious abortion ritual averts many state restrictions.”Lamar rejected the billboards and said their content was “misleading and offensive,” according to the suit. The Satanic Temple alleges that the rejection was based on religious discrimination. 1474

SACRAMENTO, Calif. (KGTV) -- California organizations and prominent businesses leaders are rallying support to repeal part of Proposition 13, a landmark vote that limited property taxes statewide. The portion organizations have taken aim at would leave property tax protections in place for homes and residential properties, but would substantially increase taxes on commercial property, creating a so-called “split roll,” according to the Sacramento Bee.A group that supports the initiative to change Prop 13, Schools and Communities First, has gathered 860,000 in an effort to get the measure on the November 2020 ballot.RELATED: San Diego ranked third for hidden costs of owning a homeThe state’s Legislative Analyst, Mac Taylor, concluded that the changes most years would result in an additional revenue of to billion.Proposition 13 was passed by California voters in June of 1978 and limits property tax. Prior to the passage of Prop 13, each local government throughout the state could set its property tax annually. This meant the average rate throughout California was nearly three percent. Under the proposition, a property’s overall tax rate statewide is limited to one percent.RELATED: Gas tax repeal qualifies for November ballotTaxes on property are already one of California’s largest sources of government revenue, raising billion in the 2014 to 2015 budget year, according to the Legislative Analyst’s Office. The chart below paints a picture of what happened to tax revenue following the passage of Prop 13 as well as revenue in recent years. One of the reform’s biggest proponents, The San Francisco Foundation, says the revenue could be used for schools, health clinics, infrastructure and other community services.“This is a watershed moment for California,” said Fred Blackwell, CEO of The San Francisco Foundation. “Closing these tax loopholes will restore over billion every year in desperately needed resources for our schools, clinics, and other critical services. It is an investment in a brighter future—expanding access to opportunity and bringing greater racial and economic inclusion to the Bay Area and across the state.”RELATED: San Diego tax increase proposal moves forwardGroups like the California Chamber of Commerce, however, oppose the plan split roll plan. The chamber says higher commercial taxes would be passed on to consumers. The CalChamber board added that, if changes to Prop 13 pass, they fear local governments would move toward approving commercial retail development instead of badly-needed housing developments.  2624
