SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. SAN DIEGO (KGTV) - Loved ones are speaking out more than a week after a bloody melee that injured eight guards at Donovan state prison in Otay Mesa.The violence erupted two Sundays ago, around 4 p.m., inside the recreation yard. Corrections officials say there were about 20 inmates in the yard when one of them attacked a guard. His fellow guards rushed to help. In the mayhem that followed, four inmates allegedly assaulted guards. Six of the guards suffered stab wounds.Christina Armstrong's longtime boyfriend, correctional officer Malcolm Billingsley, was in the middle of it."The best way I hear him describe it is a 'melee, just chaos' ... There was so much going on, it was hard for him to pinpoint each action that was taken," said Armstrong.Corrections officials say a warning shot by one of the guards ended the altercation. As the guards were rushed to hospitals, news filtered out to loved ones."It was frightening not knowing for several hours what was going on. It was terrifying," said Armstrong.Billingsley was not stabbed, but suffered a back injury and possible nerve damage to his hand."It's hard for him to everyday things. He can't take care of our son, let alone play with him. He's in a lot of pain," said Armstrong.His fellow guard Roland Milan was stabbed in the face and suffered a brain bleed. His wife Marcy says he's had four plates inserted into his face."A stab wound to the face, to the mouth area. All his upper teeth were knocked out," she said.Sources say in all, eight guards were injured, including one with a fractured bone in his back.Armstrong says because of an ongoing investigation, she can't reveal details of the melee, but says the guards fought hard for their lives and the lives of their fellow guards."They are all heroes. SAN DIEGO (KGTV) -- In an effort to help San Diego's homeless population, the City of San Diego is proposing a third storage facility the homeless can use to store their belongings. The city organized a town hall in July to gather input for the facility that would be placed on 54th and Lea Street.According to the San Diego Housing Commission, the facilities provide a "safe place for individuals who are experiencing homelessness to keep their belongings as they look for work, attend classes, or meet with a service provider or doctor."One of the centers, located on the 200 block of 16th Street, provides bins for more than 400 homeless individuals. Although the centers provide a service to San Diego's homeless population, some residents have made their opposition clear. Before one of the facilities opened in Sherman Heights, residents voiced their concerns. Neighbors told 10News they worried the facility would increase illegal activity and pose safety concerns in the area. To address concerns, security was placed inside the building as well as patrols sent out into the neighborhood. SAN DIEGO (KGTV) - Lifeguards removed a body found floating in the ocean off Sunset Cliffs Friday morning, according to San Diego Fire-Rescue.First responders were notified about 9:30 a.m. about the remains near Point Loma Ave. Lifeguards removed the body and transported it to their headquarters, officials said.The person had been in the water “a while”, according to San Diego Police.Officers told 10News they would be handling the discovery as a death report and not sending a homicide team to investigate.The person's identity and cause of death were not immediately available. 590
