SAN DIEGO (KGTV) - Homeless encampments have moved into the site of previous fires in University heights, sparking more fire concerns.March 2018. Amid a firefight along Highway 163, bystanders on the Vermont Street Bridge looking on soon after the flames spark. Fire crews would put out that fire without any major damage. Months later, a smaller fire erupted in the same area, near another encampment. Marybeth Chruden and the University Heights Community Association organized a petition drive, leading the San Diego City Council to approve more than a million dollars for canyon abatements across the city, including one at the University Heights site in July.In the past few weeks, that site looked a lot different."Shocked, but in a way, not surprised," said Chruden.Chruden's group posted photos on their Facebook page of homeless encampments and the surrounding mess."It shows they are very comfortable, out in the open ... We see people smoking and little campfires down there. The fire danger still high with dry materials in that canyon," said Chruden.Chruden says after several requests on the city's 'Get It Done' app, crews cleared out the area Wednesday morning, except for one mattress. The problem? She expects the homeless to move back in soon."Maybe tonight, in three days or four days. Within a week, something will be going on down there," said Chruden.Chruden believes regular visits to the area by city crews are needed, possibly twice a month. 10news reached out to Councilmember Chris Ward's office for a comment and are waiting to hear back. 1574

SAN DIEGO (KGTV) -- For quite some time, it looked as if it would never happen, but now it's a great to be an Aztec, as ground has finally been broken on the SDSU West Mission Valley Project. And what an exciting times it is, as the centerpiece of the plans includes a brand new stadium. "It will become the signature project that defines the future. Not only for SDSU, but for higher education in California," says San Diego State President Adela de la Torre.The project will include an innovative educations district, 86 acres of land used for a park and recreation, affordable housing, a hotel, and of course, a 35 thousand seat stadium "I can't wait to see the team run on to Basher field and enjoy the cheers of 35 thousand fans,"says de la Torre.Equally excited is Aztecs Director of Athletics JD Wicker."We are building a stadium for Aztecs football, international and professional soccer, concerts, and any other event you can think of. You name it, we'll host it."And who knows, maybe someday San Diego will see the return of the NFL.Jack McGrory, a member of the SDSU Board of Trustees, says the new stadium will be built with the NFL in mind. "That's really their minimum specification for the NFL, 55 thousand seats. We can do that down there."The SDSU West Project wasn't easy, as many challenges were dealt with along the way. But as San Diego Mayor Kevin Faulconer describes it, it's time to write the next chapter for Mission Valley."SanDiegans should take great satisfaction in knowing that the future of this land is finally set. SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights.The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses.All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis.He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. She explained that businesses that would be impacted the most by purple tier restrictions, like restaurants and gyms, are not the cause for the local increase in COVID-19 cases.The lawsuit said despite the data provided by Dr. Wooten, the CDPH still denied the request without any justification based on science or data.Both the law firm that filed the lawsuit and the County of San Diego refused to comment on this matter, stating they do not comment on pending litigation. 2646
