SAN DIEGO (KGTV) - Republican Assemblyman Randy Voepel is being called a valor thief, but his accusers have not produced hard evidence to back up their claims. Navy veteran and Republican state assembly candidate Larry Wilske addressed the media on Monday in front of downtown's USS Midway. He and others say the former mayor of Santee, Voepel, misrepresented his military service record. "This is serious business. It's a slap in the face to veterans," says Wilske. Wilske was joined by private investigator and retired Master Chief Petty Officer Terence Hoey, who has been looking into Voepel's military records.  "He's not a purple heart recipient, although he's repeatedly stated that he is and his chief of staff has doubled down on his claim," says Hoey. They're also alleging that Voepel falsely claimed he had combat experience in Vietnam. However, military discharge documents sent to us by Voepel's staff show that he served on the USS Buchanan and was awarded a ribbon for combat action, and was awarded other honors related to his service in Vietnam. The Wilske supporters believe the discharge documents have been forged. “This document has been altered, thus rendering the form essentially void,” says Hoey. Voepel’s staff denies that Voepel ever claimed to have been awarded a purple heart and 10News couldn’t find proof of the claim, anywhere. Additionally, a military service record provided by Hoey does not include a purple heart award in his list of decorations. Wilske and his supporters say there are multiple credible witness testimonies and video evidence that’ll reveal the whole truth, but they have yet to be fully produced. Wilske and Hoey deny that their allegations of stolen valor are tied to political mudslinging. “The one thing we can't square here is that round peg with Voepel and his wild and comedic claims,” adds Hoey. There was one alleged witness at Monday’s press conference. He said he’s a veteran who met Voepel at a recent political event and claims Voepel lied to his face about his service history. SAN DIEGO (KGTV) - San Diego County homebuyers could be gaining an upper hand in negotiations as the region's housing market slows.A new report from real-estate tracker CoreLogic says 2,936 homes changed hands in San Diego County in November, an 11 percent drop from November 2017. Meanwhile, the rate of home-price appreciation slowed to 4.6 percent year-over-year. The median home price was 5,000 in November."It's a good time to get in there," said Mark Goldman, a San Diego loan officer with C-2 Financial. "There's more selection of homes to purchase, and there's probably sellers who are more willing to consider offers maybe a little bit below their list price, and so forth."CoreLogic says Southern California as a whole has seen its biggest sales drop in three years. The company says higher interest rates and the volatile stock market could be contributing to buyer pullback. The average rate for a 30-year-fixed is now 4.55 percent, up about a half percent from a year ago. Goldman said qualifying families, even with a few percent cash down, should be able to get an offer accepted in this market."Be cautious, make an offer at a good price, work with a professional realtor who can guide you to a reasonable price, but if you're going to be in that house five years or so, I think you'll be happy," Goldman said.Goldman said the market is coasting at a rate of appreciation that is more sustainable. He said the 6 to 8 percent annual price growth could not last with wages not growing nearly as fast, he said. SAN DIEGO (KGTV) - San Diego Police announced Tuesday the arrest of a man suspected of sexually assaulting an elderly woman in a nursing home in Hillcrest. Detectives took Lusean Arline, 48, into custody Monday for the crime which occurred Oct. 27. Police did not release the name of the nursing home, but administrators with Balboa Nursing and Rehabilitation Center confirmed with 10News the attack happened in their facility.Police said the 88-year-old victim was inside the nursing home when Arline illegally entered the facility. He sexually assaulted the woman, who was in her bed, officers said. San Diego Police Sex Crimes Unit investigators collected evidence at the scene, including male DNA which was processed by the Crime Lab and loaded into the Combined DNA Index System (CODIS). Arline is currently being held on a parole violation. SAN DIEGO (KGTV) - San Diego City Councilman Chris Cate sent a letter to Gov. Gavin Newsom's office on Monday, asking that comedy clubs in San Diego be allowed to reopen safely.The letter requests that performances be allowed to reopen in outdoor settings, with shows lasting no longer than an hour."We're not talking about concerts here where thousands of people are sitting next to each other," Cate said. "These are performances that are done while folks and individuals are having dinner in a restaurant setting, properly distanced, why should they be treated any differently?"Earlier this month, some comedy clubs, like The Comedy Palace in Kearney Mesa, moved their comedy shows outdoors, only to find out they were in violation of public health orders and made to stop.George Salek, co-owner of The Comedy Place, said they have a lot of outdoor space, and people were able to observe social distancing."Eighty people is what we're trying to put in 5,000 square feet," he said. "It's really safe."Cate said San Diego's entertainment industry is an important part of the economy."I think anyone who can fit the confines of what we want to have done," Cate said. SAN DIEGO (KGTV) -- San Diego County has taken its first step into the dreaded "purple" tier of the state's four-tiered COVID-19 reopening plan, leaving just one week to determine if the county will be forced to shutter nearly all of its nonessential indoor businesses."It would take a significant change in trajectory," Supervisor Nathan Fletcher said Wednesday.State officials reported that San Diego County had an unadjusted new daily coronavirus case rate of 8.7 per 100,000. The adjusted case rate dropped to 7.4 per 100,000, above the baseline of 7, qualifying the state for the purple, or most restrictive tier of the reopening plan. Last week's unadjusted case rate was 7.8 per 100,000.In recent weeks, the region had an unadjusted rate well above the purple tier guidelines, but a significant effort to increase the volume of tests had allowed for an adjustment to bring it back to the red, or substantial, tier.According to the reopening plan, a county has to report data exceeding a more restrictive tier's guidelines for two consecutive weeks before being moved to that more restrictive tier. A county then has to be in that tier for a minimum of three weeks before it may move to a less restrictive tier.San Diego County has been in the red tier for months, skirting but ultimately avoiding the purple tier, which would necessitate the closure of almost all indoor operations of nonessential businesses. Recent trends have shown a slow but steady increase in infection numbers."People are tired of the pandemic and letting down their guard," Supervisor Greg Cox said. "We need to do better. We need to do a lot better and we can do better."If the county cannot drop its adjusted daily case rate below 7 per 100,000, indoor operations in locations such as restaurants, museums, places of worship, breweries and retail businesses will have to either close entirely, move to outdoor operations only or modify in other ways.Dr. Wilma Wooten, the county's public health officer, said retail operations, including indoor shopping centers, will be limited to 25% of building capacity, down from the current 50%. Schools, unless they have already restarted in-person learning, will be restricted to distance learning. K-12 schools already in session can continue, Wooten said.The county's testing positivity rate actually improved, declining 0.3% from last week to reach 3.2%, but remains high enough for this metric to remain in the orange tier.The state's health equity metric, which looks at the testing positivity for areas with the least healthy conditions, increased from 5.1% to 5.3% and entered the red tier. This metric does not move counties backward to more restrictive tiers, but is required to advance.The state data reflect the previous week's case data to determine where counties stand. It is usually updated on Tuesdays, but this week's update was rescheduled because of the election.County public health officials reported 404 new COVID-19 cases and three new deaths Wednesday, raising the region's case total to 58,106 and the death toll to 904.Of the 15,345 tests reported Wednesday, 3% returned positive, maintaining the 14-day rolling average of positive tests at 3%.Of the total number of cases in the county, 3,983 -- or 6.9% -- have required hospitalization and 921 patients -- or 1.6% of all cases -- had to be admitted to an intensive care unit.Seven new community outbreaks were also confirmed Wednesday, two in business settings, three in restaurant/bar settings, one in a grocery setting and one in a health care setting. Over the previous seven days, 25 community outbreaks were confirmed.
