SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834

SAN DIEGO (KGTV) --  At 14 stories high, The tower apartments in downtown San Diego have some nice views. But when you're trying to get down without an elevator - it can be a challenge. Carol Clark says she was left with no choice but to take the stairs from her 13th-floor apartment to go the grocery store on Thursday afternoon. "I did it today but trust me I was breathing heavy when I came in," she said. Clark is one of the 200 senior residents living in the high rise building - a building designated for people over the age of 65. The residents say they've lost count on how many times they elevator has gone out. That's why they decided to call 10News for help. Although the second elevator was working when 10News arrived, residents tell us that wasn't the case for most of the day. They say it's something that happens a lot lately. "There are people here with walkers and wheelchairs," Clark said. "I'm scared to death for them."One neighbor in a wheelchair broke down in tears during our interview. "It's people's safety," he said. "Not just mine, but everybody else."The building is undergoing renovations - which residents say they appreciate. But they say the upgrades don't make it ok to shut down one of the two elevators and leave them with an elevator that they describe as unreliable at best. "Everybody is extremely upset," Clark said. "And the thing is we don't seem to be getting many answers."The residents told 10News they've taken their concerns to management many times but have seen no changes. They say they hope something is done soon, before an emergency happens and it's too late. 10News called the on-site manager and the property management company but have not yet received a response. "It's a stressful situation not knowing if something happens are they gonna be able to get downstairs," Clark said.   1901

SAN DIEGO (KGTV) - A heartbroken local woman says her brother was killed in a Phoenix park while trying to 'protect his friends.'"He was infamous for making people laugh. He had a heart bigger than his being," said Amy Clark, Isaac Clark's sister. Last month, Isaac Clark, 23, moved from San Diego to Phoenix to be closer to his 4-year-old son. He had a job lined up doing event setup. Last Wednesday, Clark found himself in a park around 1 a.m. His sister Amy says he was checking on two friends, who had been evicted and were living in a car.Police say he heard a vehicle being vandalized, and headed toward the sound before realizing it was his friends' car. That is when the suspects approached Clark, sparking a fight. Clark was stabbed multiple times. He would die at the hospital."I feel like he died a hero. He tried to do the right thing. He was trying to protect his friends," said a tearful Amy Clark.Three people were arrested. Police say Maurice James, 24, and Eldon Sandoval, 18 are facing second-degree murder charges. A third person, Chantel Ben, 21, faces hindering prosecution chargers."They took my one-and-only sibling. They took my one-and-only baby brother from me," she said.An emotional vigil was held at that park a night after the incident. Clark's sister is haunted by their conversation about the violence in the world right before he left San Diego. "We were saying we just need to be more kind, more empathetic," she said.A grieving sister says that kindness was nowhere to be found In that park, early that morning."We need to get justice because he now has a 4-year-old son who has to live without him," she said.A GoFundMe campaign has been set up to help with funeral expenses and to set up a fund for his son. 1753

SAN DIEGO (KGTV) - A first of it's kind scholarship is up for the taking for female high school seniors pursuing a college sports career.Solana Beach athletics wear company, HYLETE, calls it their "GRACEDBYGRIT" scholarship."We all experience these gritty moments in our lives and those gritty moments are what define us, they give us our strength and it's what you do with those gritty moments that gives you your grace," Vice President of HYLETE Kate Nowlan said.Nowlan played Softball and swam in high school. She said sports have a huge impact on young women, "they have a greater chance of success professionally but also their self confidence is higher."A 2014 Ernst & Young and espnW study found 52% of female executives played sports in college. "This is one small way we can contribute to someone's success," Nowlan said, referring to the ,000 scholarship they're awarding for the first time.High school seniors must have a minimum 3.0 GPA, be pursuing college sports and have a story of overcoming adversity. The applicant must write an essay and complete a short video describing that trying moment and how it taught her grace.Nowlan said her grit came when she was 20-years-old and became Maggi's mother, "she was often in my front pack while I finished my degree which was definitely a graceful way of doing it, but a really hard time in my life." SAN DIEGO (KGTV) - A 29-year-old Cal Fire firefighter who died Monday after a training hike is being remembered. Yaroslav Katkov was hiking Sunday with his crew from Cal Fire / San Diego County Fire Station 16 in De Luz when he had a medical emergency, Cal Fire Director Thom Porter said. Katkov was flown to Temecula Valley Hospital in Riverside, where he died Monday morning. His cause of death was not specified. “On behalf of all Californians, Jennifer and I extend our sincere condolences to CAL FIRE Firefighter Yaroslav Katkov’s family, friends and colleagues during this difficult time. It’s the work of brave firefighters like Yaroslav that keep our communities safe, and we are deeply grateful for his service,” said Governor Gavin Newsom. Newsom and Porter ordered flags at the Capitol and Cal Fire facilities to be flown at half staff.Porter said Katkov joined Cal Fire as a seasonal firefighter in August 2018.
