SAN DIEGO (KGTV) - San Diego Police officers who fired shots at a man in Rolando last year were justified in their use of deadly force, the San Diego District Attorney’s office announced Monday. Body camera video recorded by San Diego Police shows the officers engaged in gunfire with Joe Darwish on June 23, 2018. Police responded to a disturbance call at the condo on Rolando Court. When they smelled smoke, they called firefighters to the scene, the DA’s office said in a news release. Firefighters forced entry into the home but were met with gunfire. Darwish shot one officer in the back with a large caliber weapon, according to the DA’s office. The wounded officer eventually managed to roll onto his stomach and crawl away from the line of fire. Darwish also shot a second officer during the exchange of gunfire. Darwish had also been hit in the face and arm from one of the officers’ shotguns. “This harrowing incident shows just how quickly a routine call for service can turn deadly for police officers who suddenly found themselves in the line of fire, trying to protect their wounded fellow officers and keep the shooter from endangering members of the public,” said District Attorney Summer Stephan. “It’s a tribute to these officers’ bravery and quick response that the gunman didn’t injure more people or kill the officers and firefighters involved.” Darwish had been wearing a bulletproof vest. He was armed with two homemade guns: an assault weapon and a 9 mm semi-automatic pistol, according to the DA. Neither gun was registered. Our source said the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For 7 weeks, 10News had been trying to confirm this with the DA’s Office. After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office stated it was "exempt from disclosure".This afternoon, we emailed the DA's Office for new comment. SAN DIEGO (KGTV) — Residents in one City Heights neighborhood say they're upset their streets have become a constant "demolition derby."In the Ring video, a loud crashing sound is heard at night, before a frantic Yesenia Zepeda goes outside her home in late April. A hit-and run driver struck her girlfriend's car parked on Dwight Street near 47th Street. It is the second time her girlfriend's car has been struck outside the home in a 4-month period. "It's ridiculous and it's dangerous," said Zepeda. Last week, that danger played out again on her Ring camera, as a car collided with an SUV carrying a mother and a one-month-old baby, who appeared to be okay. "It was heartbreaking to see," said Zepeda. Zepeda fears more heartbreak may be just around the corner. "I hear screeching all the time," said Zepeda. She and other neighbors say crashes and close calls are a constant. "You really can't see anything at night," said Zepeda. Zepenia points to the dark street, speeding cars, a sharp turn, and one very narrow street. Other videos show just how tight that squeeze is. Sometimes, two-way traffic is not possible. Zepeda has contacted city officials, asking for streetlights, signage to help slow speeds, and turning a section of 47th Street into a one-way street. A city spokesperson issued the following statement: “In April 2017, a 24 hour traffic study was conducted and the data concluded that this location does not qualify for traffic calming measures. Although the data did not warrant traffic calming measures, in May 2017, the City installed 2 speed limit signs on Dwight and 47th Streets and painted a yellow centerline at the intersection of 47th and Dwight. SDG&E crews and contract firefighters helped patrol power lines to ensure they were safe and free of debris, so we could begin safely restoring power. SAN DIEGO (KGTV) -- San Diego County has taken its first step into the dreaded "purple" tier of the state's four-tiered COVID-19 reopening plan, leaving just one week to determine if the county will be forced to shutter nearly all of its nonessential indoor businesses."It would take a significant change in trajectory," Supervisor Nathan Fletcher said Wednesday.State officials reported that San Diego County had an unadjusted new daily coronavirus case rate of 8.7 per 100,000. The adjusted case rate dropped to 7.4 per 100,000, above the baseline of 7, qualifying the state for the purple, or most restrictive tier of the reopening plan. Last week's unadjusted case rate was 7.8 per 100,000.In recent weeks, the region had an unadjusted rate well above the purple tier guidelines, but a significant effort to increase the volume of tests had allowed for an adjustment to bring it back to the red, or substantial, tier.According to the reopening plan, a county has to report data exceeding a more restrictive tier's guidelines for two consecutive weeks before being moved to that more restrictive tier. A county then has to be in that tier for a minimum of three weeks before it may move to a less restrictive tier.San Diego County has been in the red tier for months, skirting but ultimately avoiding the purple tier, which would necessitate the closure of almost all indoor operations of nonessential businesses. Recent trends have shown a slow but steady increase in infection numbers."People are tired of the pandemic and letting down their guard," Supervisor Greg Cox said. "We need to do better. We need to do a lot better and we can do better."If the county cannot drop its adjusted daily case rate below 7 per 100,000, indoor operations in locations such as restaurants, museums, places of worship, breweries and retail businesses will have to either close entirely, move to outdoor operations only or modify in other ways.Dr. Wilma Wooten, the county's public health officer, said retail operations, including indoor shopping centers, will be limited to 25% of building capacity, down from the current 50%. Schools, unless they have already restarted in-person learning, will be restricted to distance learning. SAN DIEGO (KGTV) -- San Diego Police officers responded to a call from a Pacific Beach woman who recorded a confrontation with a solicitor claiming to be a charity worker.Sarah Jarzabek said she began recording the incident at around 3 p.m. Saturday when the man became increasingly aggressive toward her and her neighbor."Scared to death, honestly," Jarzabek told 10News, after reflecting on the incident. Jarzabek and her friend Emily Herton were watching a movie at her home when a stranger knocked on her door. "He said that he came from Ohio, from Cleveland," Herton told 10News. "He said he was trying to raise money for some missionary work for children."The women admit they thought it was a joke but as the man continued with his story claiming to be a missionary and spreading God's love, they felt something did not seem right."He had four different I.D.s behind his one I.D.," Jarzabek said. When she told him that they did not have cash to give, she said the man angrily left her front door and marched toward her neighbor's home. That is when she started to record him on her phone. "I was going to warn [the neighbor], and then the guy, he flips a switch," Jarzabek said. The 12-second video shows the man lunging toward Jarzabek trying to cover the camera then take multiple swings. "He chases me across the street, and screaming that he's going to kill me," Jarzabek said. Jarzabek said she and Herton barricaded themselves inside her home and called 911. San Diego Police told 10News that the man was gone by the time an officer responded. An SDPD spokesperson says that because the man did not actually touch Jarzabek, officers did not file an official report. After the incident, Jarzabek posted the video on Facebook and recruited the help of their local Guardian Angels. Within hours, many people replied on the post about their recent encounters with the same man.The people commenting on the post said he was some sort of charity worker describing himself as a Christian missionary, domestic abuse organization volunteer, or reformed criminal organization volunteer. Commenters also described the man becoming confrontational when they refused to give him money. Other commenters claim to have seen him scoping out neighborhoods in Ocean Beach and other San Diego communities. Jarzabek hopes her post raises awareness about dealing with questionable door-to-door solicitors."It takes a lot to make me feel endangered, and this guy literally shook me," said Jarzabek.San Diego Police said they would like to speak with the man in the video.
