SAN DIEGO (KGTV) - 36 students reportedly felt sick at a Bay Terraces elementary school due to possible construction-related fumes, according to the San Diego Fire Department.San Diego Fire-Rescue crews responded to Zamorano Fine Arts Academy around 10:30 a.m. following the reports of students feeling ill. Crews said the kids complained of not feeling well and were being held in the school's cafeteria.An ambulance brought one child to a nearby hospital, SDFD said. Around 11:45 a.m. SDFD began releasing students who were being held in the cafeteria. A nearby construction site was in the process of pouring resin when the smell caused some children to start feeling sick, according to San Diego Unified School District. State Route 163 was closed in both directions from Interstate 805 to I-8 shortly after.San Diego Gas and Electric said crews must let the line "bleed out," which could last hours. SAN DIEGO (KGTV) — A former San Diego Sheriff's Department Captain accused of operating an illegal firearms trafficking business was arrested Friday.Former SDSO Capt. Marco Garmo is accused of operating the illegal firearms trafficking business, at times from his office at Rancho San Diego Station, authorities say. The indictment also accuses a fellow Sheriff's deputy, Lt. Fred Magana, prominent San Diego jeweler Leo Hamel, firearms dealer Giovanni Tilotta, and El Cajon resident Waiel Anton with aiding the Captain's business.Officials say Garmo was operating the illegal business during his entire tenure as Captain at the Rancho San Diego Station. The 27-year veteran of the department, who retired in September, is accused of beginning the business for profit and to gain future donors for an anticipated campaign for San Diego County Sheriff.RELATED: San Diego Sheriff's captain on leave during criminal investigationFriday morning, Magana and Hamel both plead guilty to charges including engaging in the business of dealing in firearms without a license, false statement in acquisition of a firearm, and conducting firearms transaction in violation of state law.Both admitted to aiding Garmo's business by making "straw purchases" of firearms, or purchases of firearms on behalf of someone else. The pair also admitted to creating false records to conceal those purchases, and offering to promote Garmo's weapons. As part of his plea, Hamel admitted to buying a variety of handguns from Garmo and making purchases in which Garmo would falsely report that he had acquired the guns for himself, not Hamel. Anton is charged with also giving "kickbacks" to Garmo for referrals.Investigators accuse Tilotta, the owner of Honey Badger Firearms, with organizing Garmo's straw purchases and submitting false firearms records. While law enforcement officers are allowed to resell off roster guns in certain instances, Garmo was reportedly warned by the ATF that excessive resales for profit could violate federal law. Officials say Garmo acquired about 146 firearms between March 2013 and February 2019 and sold or transferred 104 of them.Investigators also accused Garmo of lying about tipping off a cousin, who was a partner in an illegal marijuana dispensary called Campo Greens, of an impending warrant search he had received for the business. The tip off allowed the business to clear any products or cash before authorities arrived.Sheriff Bill Gore said in a statement Friday that Garmo's actions do not represent the department:"In the spring of 2017, the San Diego County Sheriff's Department learned an employee was possibly involved in misconduct. Upon confirming the information and determining the misconduct potentially involved criminal activity, the Sheriff's Department requested an investigation by the Federal Bureau of Investigation (FBI) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The FBI and ATF conducted a thorough investigation and the United States Attorney's Office, Southern District of California, issued indictments on one current Sheriff's employee and one former employee. I want to thank our federal law enforcement partners for their diligence on this case, and I have the utmost confidence in the criminal justice system.Acts such as these are a violation of public trust and tarnish the reputation of law enforcement. I am disappointed by the actions of these two individuals, as they do not reflect the values of this department and its thousands of trustworthy, hard-working employees. The Sheriff's Department will not tolerate criminal behavior amongst its ranks and will hold its employees accountable for their actions."Magana and Hamel are out on bail and scheduled to be sentenced on Feb. 21, 2020.Anton and Garmo are set to be arraigned Friday. SAN DIEGO (KGTV) — A Camp Pendleton Marine was taken into custody this week after border officials say the Marine was trying to smuggle immigrants through a port of entry.The junior-enlisted Marine was taken into custody early Monday morning by U.S. Customs and Border Protection personnel at the San Ysidro Port of Entry, according to the 1st Marine Division at Camp Pendleton. The Marine was reportedly bringing undocumented immigrants into the port.The Marine is being held in civilian custody and CBP and the Naval Criminal Investigative Service were investigating. The lead authority in the case has not been determined.RELATED: Attorneys for Marines accused of human smuggling call public arrests illegalThe Marine was not part of military personnel currently serving at the border to assist CBP and Border Patrol agents, Camp Pendleton said.The Camp Pendleton Marine is the latest military member from the base to be charged in an immigration scandal. In July, 23 Marines were detained over human trafficking, drug distribution, and weapons charges, according to the base.Of those 1st Marine Division Marines, six have pleaded guilty at court martial appearances. Thirteen Marines have approved pre-trial agreements requesting separation from the Marines instead of court martials or waiving separation board processes. SAN DIEGO (KGTV) - A Del Mar woman wants lifeguards to put more signage up on Dog Beach that warns of riptides after her dog was dragged out to sea."As the tide goes up it fills up and as the tide goes out it flows out," Deputy Lifeguard Chief Lifeguard Mark Rathsam said, describing the movement of water between the San Dieguito Lagoon and the ocean."If you get caught in that you're gone," said Mark Waters, a long-time surfer and volunteer surf club coach at Westview High School.On Wednesday, Joanne Goss took her 4-year-old Dachshund Hank and her rescued chocolate Labrador to the beach. A large dog started playing with her Lab as they were walking toward the ocean, steering clear of the fast flowing river below.The owner of the big dog tried to get his dog's attention. "When he threw the ball, the Mastiff ran, the Lab ran and Hank ran," Goss said choking up. Hank was ripped out to sea with the current.Goss sprinted into the water, soaking her fanny pack with her phone inside. Waters saw the danger and took off."Threw off all my clothes except my shorts and just ran," he said.He swam out into the fog hoping to find the dog, and hoping he wouldn't be too late."I thought I saw him get rolled over in a wave and then I heard the sound of a drowning animal," he paused, "that just pierced right into my bones and I was just like, 'Oh my god, I've got to hurry."Swimming faster, he finally reached Hank."He was the happiest dog on the planet when that happened. He jumped up on my chest and he's up in my arms, so I kept him on my chest," Waters said.Hank was so excited he scratched Waters making him bleed. Waters said he knew the "big fish" like sharks wouldn't be in the area for an hour or so, and then he started to look around to get oriented. "I look back there's no shore, I looked in all directions, you can't see anything," said Waters.He stayed calm and laid on his back, holding Hank out of the water. He said he looked at his watch and knowing the tide, he would ride it back in in the next couple hours.Back on the beach, Goss felt sick to her stomach. "We lost sight of Mark, and I thought Mark had died," Goss said.She said she felt responsible.A friend of Waters called lifeguards. The friend comforted Goss, reassuring her Waters would be OK. Finally, they saw the rescue team return with Waters and Hank.Goss was overjoyed. She and Waters said they want more signage posted warning the public, especially visitors, of the dangers of the river.10News asked lifeguards what could be done. They said there's eight signs posted north of the river and two on the south side. Rathsam explained they don't want to post "so much that people ignore it, because that's what ends up happening, and not so little that people can't see it. So we strategically place it where it's the most visible."He also said with the huge change in the tide, it's nearly impossible to put more signage up without moving it by hand every few hours.Waters and Goss hope that by at least telling their story, they can get the word out, so their close call prevents a tragedy."It really made me feel good to save the dog, it really did and um it was probably one of the best things I've done in a long time," Waters said.Goss said she will be buying Hank a life jacket. 3279
